Open Letter: Freezing Israeli collaboration is a legal obligation

Dear Board of the Faculty of Geosciences at Utrecht University, dear Prof. Wilco Hazeleger, Prof. Marc Bierkens, Prof. Tine Beneker, Drs. Liduine Bremer, Tom van Munster, Drs. Carin van de Weerd-Nijboer, dear colleagues,

On December 11th 2023, an Open letter: Neutrality normalizes Genocide signed by 1,024 faculty, staff, and students at Utrecht University was sent to the UU's College van Bestuur. The letter urged Utrecht University to take a firm stance against Israel's crimes committed against 2.3 million Palestinians in the Gaza Strip. Another letter endorsed by 1,275 UU students and faculty criticized Utrecht University's policy of neutrality. No update on behalf of the university has been offered. Today, the urgency to take a stand resonates profoundly within our community, particularly in light of the Copernicus Institute of Sustainable Development's recent announcement of opening two PhD and one Postdoc positions in collaboration with Israeli Ben-Gurion University. Copernicus' collaboration with Ben-Gurion University is anything but neutral given the university’s active role in the Israeli occupation of Palestine, evidenced as follows.

Our paramount concern lies in the dire situation unfolding in Palestine, particularly the plausible case of genocide perpetrated by Israel against the Palestinians in Gaza, as determined by the International Court of Justice (ICJ) in The Hague on January 26th, 2024. According to Human Rights Watch, Israel has failed to comply with the court’s order to prevent genocide and continues to wage war in Gaza. As of today, 31,470 Palestinians have been killed, approximately two-thirds of which were children and women. The bombing across the Gaza Strip has inflicted permanent damage on critical infrastructure, including eliminating access to clean water, food and electricity. The soil has been poisoned, rendering it unsuitable for sustaining life, while hospitals and health facilities have been decimated. The restrictions to provide sufficient food and humanitarian aid place at least half a million people at risk of starvation and death.

Israel has also targeted Gaza's schools and universities, resulting in the tragic deaths of at least 94 university professors. On January 17th, 2024, Israel demolished the last remaining university in Gaza, Al-Israa University in the southern region. The destruction of educational institutions reflects a systematic campaign to eradicate Palestinian educational systems, committing what 350 scholars from Flemish Universities have termed "educide", actions aimed at obliterating Palestinian culture, its principles and values, perceived as a threat to Israeli rule. It is therefore crucial to acknowledge that the ICJ's order is legally binding and extends to all state parties to the UN Genocide Convention, including the Netherlands and its public institutions like Utrecht University.

Israeli universities, including Ben-Gurion University, play a foundational role in the Israeli occupation of Palestine and violations of Palestinians’ rights. Jewish-Israeli anthropologist Maya Wind traces this in Towers of Ivory and Steel: How Israeli Universities Deny Palestinian Freedom (2024), detailing the censorship of academic pursuits and restrictions for Palestinian students and scholars, the use of promotional material to cultivate an international reputation of academic freedom, critique, and dissent, the provision of moral and legal justifications in support of Israel’s offences and their involvement in Israeli’s military industries. Campuses were strategically placed to facilitate the expulsion of Palestinians during the Nakba, which continues through their ongoing military support in advancing the state's agenda. Overall, Israeli universities help to uphold the Israeli apartheid regime.

Concerning Ben-Gurion University, the university has actively contributed to denying educational opportunities to the Bedouin Palestinian community in the region and has facilitated the development of Israel's military-industrial complex, at times treating Palestinian land as a testing ground for military strategies and technologies (Abu-Saad 2016, 2018; Taraki 2010Wind 2024). Ben-Gurion University maintains institutional ties and collaborations with the Israeli Ministry of Defence and its military,  and prominent Israeli weapon companies such as Elbit Systems, Israel Aerospace Industries (IAI), and Rafael Advanced Defense Systems. Recently, Ben-Gurion University developed multiple military technologies in partnership with Elbit systems, Israel's largest weapons company and main provider of military equipment.

Wind's (2024) research underscores the existence of blurred boundaries between university campuses and military training bases. Ben-Gurion University collaborated with the state of Israel to relocate military bases to the Beer Sheba metropolis, encouraging thousands of career soldiers and their families to enrol in specialized degree programs. The university offers an accelerated BA program tailored for fighter pilots, allowing them to complete degree requirements while serving actively in the military, thereby training soldiers for research and development in Israel’s military and military industries. In partnership with the Beer Sheva Municipality, the Israeli military, and private investors, Ben-Gurion University established the Gav-Yam Negev advanced technologies park, situated at the edge of the university campus. It houses military industries and is anticipated to become Israel’s primary research and development center. This park offers veterans prestigious employment opportunities and encourages soldiers to remain in Beer Sheba following their military service. Ben-Gurion University ex-President, Rivka Carmi, hailed the facilities at the advanced technologies park as a “realization of our vision” (quoted in Wind, 2024, p.109).

In recent years, the university’s involvement with the Israeli Defence Force (IDF) has only increased. In the late 2000s, half of the university’s high-tech park was reserved for the establishment of an IDF Technology Campus. In 2018, the head of the Ministry of Defence team overseeing the move explained that the move of the IDF’s ICT and intelligence units to Ben-Gurion University “will reinforce the academia-defense ecosystem that exists in the Negev Region.” Following the inauguration of the first building of the IDF Technology Campus in 2019, the University President remarked “I am looking forward to watching the rest of the army's tech campus grow, and of course to overseeing BGU’s collaboration with the military as the units themselves move south.” In the President’s 2023 report, he stated "Central to the University's strategy for growth is strengthening our connections with key IDF ... technology units – in intelligence, communications and cybersecurity. Over a decade of planning and collaboration are finally paying off, as the first of several IDF schools and specialized units have relocated to the University’s Advanced Technologies Park and the surrounding areas."

In light of the outlined above, we align ourselves with the urgent calls made by Dutch Scholars for Palestine, as well as Jewish scholars and students at Dutch Universities, to take a decisive stance against the plausible genocide and war crimes perpetrated by the Israeli government in Gaza. We call for:

1.   The suspension of the collaboration between Ben-Gurion University and the Faculty of Geoscience at Utrecht University and the closure of the three academic positions at the Copernicus Institute of Sustainable Development.

2.   The freezing of all academic agreements and collaboration projects and programs established between Israeli Universities and Research Centers, and the Faculty of Geoscience at Utrecht University.

3.   The initiation of a broad conversation for the establishment of an ethical code of conduct on academic collaborations and partnerships with academic and non-academic institutions at different levels within the Faculty.

4.   Active institutional and financial support to engage both students and staff in discussions about genocide prevention and intersectional justice connected to the Faculty’s committed interest in supporting decolonization and the respect of human rights.

We want to emphasize that our stance is not directed to individual Israeli scholars or our colleagues, but rather to sever institutional ties with a university whose historic and continued support for Israel's military expansion enables the ongoing occupation and assaults in Palestine. Given the far-right Israeli government's entrenched power and its militaristic agenda, which dehumanizes the Palestinian people, it is evident that internal mechanisms alone will not suffice to prevent genocide. Therefore, we issue an ethically-driven call for the international community to intervene with all available measures, including academic boycotts, divestment and sanctions.

This call follows other universities such as the Federal University of Ceará in Brazil and the University of Johannesburg in South Africa that already severed connections with Ben-Gurion University, as well as the commendable decision of the Law Faculty at the University of Antwerp and four Norwegian Universities that have cut ties with other Israeli universities. This is a necessary step towards demonstrating responsibility over our own prevention of genocide and holding perpetrators of human rights violations accountable.

We align with the call for academic and cultural Boycott, Divestment and Sanctions (BDS or PACBI), which is centred on targeting institutions, not individuals, in order to hold them accountable for their role in violating human rights. The movement explicitly “rejects in principle boycotts of individuals based on their identity”. This campaign draws inspiration from the Anti-Apartheid movement in South Africa, which urged the international community to uphold its responsibilities and sever ties with apartheid regimes, and successfully contributed to end apartheid in the country. Renowned Jewish historian Ilan Pappé, Jewish author Naomi Klein and Jewish Voice for Peace all contend that BDS campaigns represent one of the most effective measures the international community can employ to exert pressure and end genocide in Palestine.

Thereby, our call reflects an ethical and moral position aligned with the ruling of the International Court of Justice as Utrecht University, like all public institutions in the Netherlands, is bound by the UN Convention on the Prevention and Punishment of Genocide and bears a responsibility to prevent complicity and deter genocide. Freezing cooperation with educational and knowledge institutions is not new to Utrecht University. The university already severed cooperation with institutions in the Russian Federation and Belarus in 2022. This also shows that it is clearly possible, and that the mechanisms exist to discontinue academic exchange. Not only would it be ethically consistent to do it again in the case of Israel’s higher education institutions, it is also a moral, and legal imperative to prevent genocide.

We, the undersigned—comprising academic, administrative staff, students, and alumni of the Faculty of Geosciences (and beyond) at Utrecht University (UU)—urge the institution to take concrete actions to halt the genocidal war on Gaza and the Palestinian people. A collaboration with Ben-Gurion University is a disservice to the values that the Faculty (and UU) uphold. We request the Faculty Board and the Science-Geo Ethics Review Board to issue a public statement in response to our call with the urgency that this critical issue deserves.
