Section 1118(c) of the Elementary and Secondary Education Act as amended by the Every Student Succeeds Act (ESSA) states that Comparability of Services require local education agencies (LEAs) be able to document that the services provided with state and local funds in Title I schools are comparable to those provided in non-Title I schools. State and local funds must be used in participating schools to provide services that, taken as a whole, are "at least comparable" to services in schools that do not participate in the Title I program.

The LEA demonstrates comparability by annually comparing student/instructional staff ratios of its Title I schools to its non-Title I schools.

If an LEA serves all the schools in its district with Title I funds, the LEA must use state and local funds to provide services that, taken as a whole, are “substantially comparable” in each building.

The comparability requirement does not apply to an LEA that has only one building for each grade span since the district cannot conduct comparability testing or, if an LEA has two schools, one is a large school of which is twice the size and/or the other is a small school less than 100, the comparability requirement would not apply.

Given these requirements, ALL LEAs met the 2024-25 ESSA Title I Comparability Reporting.

ALL LEAs should keep a copy this letter and data submitted in the 2024-25 school year district audit file.
