Dutch Treatment: The Netherlands & Tech Giants
Tech giants like Google, Apple, and Facebook incur huge Euro fines from European Union data privacy authorities. Regulators Continue to Focus on “Dark Patterns” in Negative Option Marketing
These days, consumers can obtain everything from newspapers to meal kits to credit monitoring services through subscriptions. The prevalence of these services, and the ease with which consumers can sign up, have gotten the attention of regulators who are concerned that some negative option marketing might confuse or trick consumers. The CFPB, FTC, and state AGs have been particularly vocal about practices they deem “dark patterns,” and continue to focus on the area.

Recently, the CFPB put out guidance warning covered companies and service providers that “dark patterns” surrounding negative option marketing violate the Consumer Financial Protection Act’s prohibition on unfair, deceptive, or abusive acts or practices.

Homomorphic Encryption with Skyflow’s Avradip Mandal
Imagine being able to perform any computational operation over any kind of data but do it while the data is fully encrypted. That is the promise of fully homomorphic encryption.

Fully homomorphic encryption was first theorized in the 1970s, but the first proposal for a plausible construction of a fully homomorphic encryption scheme didn’t arrive until 2009. We are now in the fourth-generation of fully homomorphic encryption and although performance is still a blocker for many applications, there’s been a series of major breakthroughs allowing real world application to take advantage of the approach.

Dr. Avradip Mandal received his PhD from the University of Luxembourg where his research focused on cryptography, in particular homomorphic encryption and theoretical symmetric key cryptography. He joins the show to describe what homomorphic encryption is, how it works, the history, and breakthroughs. Topics:

EFF awarded him a Pioneer Award in 2012 for his work in hardware hacking, open source, and activism. He’s a native of Kalamazoo, MI, he holds a Ph.D. in electrical engineering from MIT, and he lives in Singapore.

By engaging on these platforms, users are sharing mountains of behavioral data that paint a clear picture of their lives, from political beliefs to deep-seated thoughts.

One of the major use cases he’s working on at 0PN is called ‘Do Track,’ which is a response to the shortcomings of the current ‘Do Not Track’ mechanism that we have in place today. Jennifer Quaid is an Associate Professor and Vice-Dean Research in the Civil Law Section at the University of Ottawa, Faculty of Law. On Friday, the FTC announced what would ordinarily be an unremarkable enforcement action against a company for unsubstantiated earnings claims. The FTC alleges that WealthPress, an investment advice company purporting to offer training from experts on trading strategies, made a series of unsubstantiated earnings claims such as “make $24,840 or more every single week,” “track the BIG money,” and the opportunity may “quite literally transform your life.”

Without a doubt, 2022 was a packed year for privacy-related news and developments. But according to Goodwin Partner and IAPP Westin Emeritus Senior Fellow Omer Tene, 2023 is set to call and raise the stakes. To be sure, 2023 didn’t hesitate. Surveillance Capitalism Part 1: Our review of a landmark documentary
In this episode, Sarah returns to the podcast to help Rich dive deep into a review of VPRO's landmark documentary: Shoshana Zuboff on surveillance capitalism.

Surveillance capitalism is the core of the business model for today's Big Tech companies like Google and Facebook. It's not about your email address, phone number or social security. Surveillance capitalism is all about collecting voluminous amounts of rich, behavioral data on platform users to develop models that predict future behavior. These predictions can in turn be sold to advertisers that are looking to reach niche markets. Predictive models developed by Google and Facebook are so sophisticated that they can practically guarantee advertiser success.

The key here is that Big Tech is selling predictions, not data. In fact, the models are so advanced that they can even be used to manipulate users' behavior.

Shoshana Zuboff is a Harvard Professor and author of the groundbreaking book The Age of Surveillance Capitalism. She has been researching the area of surveillance capitalism for years and asserts that in order for surveillance capitalism to work, it must happen through stealth and obfuscation. In other words, users of platforms like Google Search and Facebook must be so hooked on using these products that they don't see how the monetization model works. The more engaged users are, the more behavioral data that can be collected, and the more precise those predictive models can be.

We hope this episode will spur some thinking about what type of personal data is truly valuable to Big Tech and get you to reevaluate your own use of various web-based products.

Using Domestically Sourced Recycled Content? Look Beyond the Recycling Process
We periodically stumble across older FTC investigations that have new relevance, and post about them as reminders. That happened recently as we get more questions about the use of recycled content and the desire to tout U.S.-based manufacturing. Although the FTC’s Enforcement Policy Statement and regulation regarding Made in USA claims do not mention how to evaluate recycled content, in a 2014 FTC Staff Advisory Opinion the Staff declined to consider the recycling process as a “new life cycle” and disregard the origin of the jewelry returned for recycling.

Fighting Fintech Fraud with Sardine’s Soups Ranjan
Fraud can be crippling to a business. It hurts your revenue, reputation, and customers. Fintech fraud is a super complex space, with bad actors using a variety of attacks like identity attacks, credit card theft, and phishing scams, it’s a lot for any company to tackle on their own. Sophisticated fraudsters leverage weaknesses in protocols like SMS, the phone system, email, and DNS.

Soups Ranjan, CEO and Founder of Sardine, joins the show to discuss the different types of fintech fraud attacks that take place and how Sardine uses machine learning to automatically detect and prevent fraud.

Soups has a PhD from Rice University in denial-of-service attack prevention and has been working in fraud detection for a decade across companies like Yelp and Coinbase. With a strong background in data science and a ton of real world experience, Soups is an expert in this space.

We're hearing a lot about the metaverse these days. So far, the technology seems more hype than anything. Even though market adoption is low, it's evident privacy will be an even larger concern in this emerging world than today's "flat" internet.

In this episode of Privacy Files, Brian Tillman (Mr. Metaverse) fills in for Sarah to provide his perspective on the overarching privacy concerns in this immersive virtual world.

With Mark Zuckerberg and Meta leading the industry in developing metaverse technology with Horizon Worlds, and given Zuckerberg's poor track record on data privacy, it's only natural to be concerned about users' personal data.

Perhaps the most significant privacy concern in the metaverse is the collection of biometric data. This includes voice and facial recognition, iris scanning, eye tracking, and the analysis of unique body movement patterns that are unique to an individual.

Rich and Brian also discuss the scope of the metaverse and cover some interesting applications of the technology.

Eatrides comes to the Commission at a particularly busy time with wireless competition concerns top of mind for many Canadians and the government set to ask the Commission to play a pivotal role in implementing Bills C-11 and C-18. Konrad von Finckenstein is someone who knows quite a bit about the challenges faced by new CRTC chairs, having served in the role from 2007 to 2012. He was recently appointed to the Order of Canada for his many contributions to public life and he joins me on the podcast to reflect on those experiences in the context of the CRTC. Our conversation reflects on what is involved in launching entirely new programs, ensuring public engagement, and developing policies that enjoy both public support and can withstand potential legal challenges.

A Third Way Emerges - Light Touch
India -soon to be the world’s most populous country, a fast growing economy with a highly sophisticated tech sector. It’s a country with a digital rupee in circulation and digital identity cards. Since independent India has forged an independent path between “east and west.”
About a year ago, the Modi Government withdrew a bill based on Europe’s comprehensive privacy-centric approach to personal data privacy, GDPR. In November 2022, a very different bill was proposed by the Ministry of Electronics and Information Technology – the Digital Data Protection Act. What caused the change and where is India headed?
In Episode 109, Stephen Mathias of the premier Indian law firm Kochhar & Co explains the new approach. Expected to be adopted by mid-2023 in a final form, it is very different from either the GDPR strict and privacy-centric approach or the U.S. model of sectoral and partial rules without an overarching federal code. India’s will use a “light touch” approach. It will leave many details open to evolving technology and future administrative rule-setting. Explore this very different model for national regulation of data privacy and security.

CFPB Tackles Fine Print in Consumer Financial Contracts
Downloading an app, buying a product or service, or otherwise interacting with a company frequently requires consumers to consent to multi-page contracts. In a new proposed rule, the CFPB would require nonbank financial companies subject to the CFPB’s supervisory jurisdiction to register any use of such form contracts if they contain terms that seek to waive or limit consumer rights and legal protections.
