House Bill 3495 limits provides that all time-based insurance policies regaring roofing repair claim must allow for at least 12 months to be filed but not more than 24 months after the damage is sustained. Government Affairs believes that the limit is an illogical cap on recovery and could present issues with home inspections if those inspections reveal unknown damage from storms or wind that insurance would then be alleviated from covering.

**Update: In discussions with bill authors and the Insurance Commission, this bill would be somewhat expansive, preventing insurance policies from requiring roofing claims to be made in less than 12 months. Those with policies which do not have clauses regarding timing of filing roofing claims would be unaffected.

HB3409BushInternal Nickname: Bush LTA Bill / Repair Cap Bill
House Bill 3409 is another potential amendment to the Landlord-Tenant Act which would expand tenants' rights regarding deduct-and-repair and would alter the liabilities for landlord and tenant if there was determined to be a breach of contract on behalf of either side. Government Affairs has decided that we will monitor this bill to ensure that it does not undergo further changes, but we are neutral under the current language.

HB2977OlsenHouse Bill 2977 would require sellers to disclose what, if any, roads a buyer would be required to repair or maintain. The bill also instructs OREC to create new forms for such a disclosure. OAR Gov Affairs Team is concerned this bill creates an unnecessary new form. This could likely be accomplished by modifying current disclosure laws and forms, rather than creating new and separate forms. If the bill simply amended the current forms with a line to notify buyers of a private road, we would support.Oppose

HB3238GannHouse Bill 3238 provides that any agreement between landlord and tenant that is not in conflict with the Oklahoma Landlord-Tenant Act will be enforced by the court and that if rent is unpaid and the landlord files an action for forcible entry to their property, immediate possession should be granted to the landlord. This bill came out of an interim study that was the result of the court-ordered COVID-19 eviction moratorium. HB3795Roberts, SeanHouse Bill 3795 is currently a shell bill related to abstracting, which we believe is a vehicle for an overhaul of Oklahoma's abstracting system. Ultimately, this bill would lead to a title insurance paradigm and completely eliminate abstracting altogether and fundamentally change the title insurance procedures in Oklahoma. HJR1047MangerHJR 1047 is a bill to allow for further property tax abatement for seniors; the abatement is currently capped and applies only to those seniors whose income is $25,000/year or less. HJR 1047 would remove all limits for abatements. We have chosen to monitor this bill for now and we have reached out to Oklahoma County Assessor Larry Stein to further understand the tax collection impacts of this bill for municipalities. SB1117StanleyThis bill permits county assessors to inspect real property by physical inspection via change detection techniques and imaging software, also known as aerial photography. Government Affairs has made the decision to oppose this bill on privacy grounds, and we continue to have conversations with the legislature and the County Assessor's office regarding this bill. Rep. This bill does not allow a long enough window for real estate contracts to execute, since some take longer than 6 months, and for that reason we are fully opposed, since this would restrict those properties which need a longer contingency period. SB1182RaderSenate Bill 1182 would permit counties with 50,0000+ populations to enact "home rule", giving more power to county commissioners and other county officials on a variety of issues. This is a bill that would take some powers away from the state in service of giving local control where possible. SB1254HowardSenate Bill 1254 potentially exempts members of Congress, members of the Oklahoma legislature, and full-time active-duty military from continuing education requirements to maintain a real estate license by OREC. OAR believes that everyone who sits for a real estate license should be certified and licensed in the same way and that creating two separate classes would muddle the licensing process and create unfair disparities in the market. SB1469HamiltonSenate Bill 1469 would prohibit land ownership by those that are not U.S. citizens, either directly or indirectly through a business entity or trust with exceptions for resident aliens holding a majority interest in a business so long as they remain a state resident. Many of the provisions of this bill are already addressed in United States and Oklahoma law, as there are robust protections in each that prevent foreign ownership from becoming a security risk. SB1609TreatSenate Bill 1609 sunsets the Abstractors Board Revolving Fund and repeals the Abstractors Board in its entirety, reallocating duties and responsibilities where applicable. SB1672BrooksSenate Bill 1672 permits tenants whose landlord is noncompliant with the terms of the rental agreement to pay for repair services of up to $2,000 and deduct up to 50% of the total value of the rent from subsequent payments until the withheld rent equals repair costs. This is a massive shift from the current Landlord-Tenant Act and we believe that it is not one which protects property owners adequately or equitably. SB1720DahmSenate Bill 1720 outsources government licensure of industry to private entities. It could potentially open up the licensure processes to numerous professions, including real estate professions, to substandard practices which are outside the scope of state government. SB1730BergstromSenate Bill 1730 is the Provisional License for Ex-Offenders Act, which establishes standards for licensing authorities to issue provisional, temporary occupational licenses to convicted persons which shall be revoked if another separate offense occurs. SB1750DanielsSenate Bill 1750 would permit home inspection reports to include a cost estimate or cost range for repairs to correct any deficit, with additional services being negotiated separately. SJR39MontgomerySenate Joint Resolution 39 is a constitutional amendment to allow counties to create alternate tax jurisidictions with a 60% vote to levy ad valorem taxes to fund common schools in amounts exempt from limitations, where these jurisdictions would receive no state funding and residents therein would pay no income taxes. We are concerned about the fiscal impact that this could have on the state and also believe that the cleaving of school policy within the state is not an equitable or well-thought out position. SJR45HamiltonSenate Joint Resolution 45, if passed by voters, would create a constitutional amendment to prohibit ownership of land by a business entity or trust of an alien or one that is not a U.S. citizen, with land at issue to be returned to the State within one year.
