Because of the information in these reports and scores, they result in disproportionate denial of renters of color from housing. This session will cover common FCRA claims against tenant screening companies, as well as potential civil rights claims, including under the Fair Housing Act.

However, servicer errors in applying payments and calculating escrow and other payment changes often cause servicers to claim fees that are not owed and treat consumers as in default once they emerge from bankruptcy. This panel will discuss using Bankruptcy Rule 3002.1 (and proposed changes to the rule), and claims and remedies under bankruptcy and consumer law, to address final cure problems. It should be of interest not only to bankruptcy specialists but also attorneys who handle foreclosure cases (even if you do not have bankruptcy experience).

At the same time, both federal enforcers and plaintiff class attorneys have turned attention to this market practice. The FTC, for example, obtained $10 million in consumer redress and an injunction against ABCMouse for deceptive automatic renewal charge for online children's learning programs, and for promising "Easy Cancellation" but making it difficult to cancel so that "hundreds of thousands of consumers who visited the ABCmouse cancellation path nevertheless remained subscribed." The course will categorize and examine state regulation in this space, and will examine public enforcement and class litigation related to negative option contracts brought under federal and state UDAP, ROSCA and other laws.
