Though small-scale fracking has occurred in the state since the 1980s, recent discoveries of significant new oil reserves have created potential for much larger onshore and offshore fracking operations. Current regulations require public disclosure of fracking chemicals, except those deemed "trade secrets."

Arizona has limited crude oil and gas production, mostly concentrated in Apache County in the northeastern part of the state.
In 2019, conservation groups sued the Trump administration for leasing 4,200 acres of public lands in the Little Colorado River basin to oil and gas companies without conducting new environmental reviews or doing tribal consultation. Supporters of the lawsuit have also raised concerns about groundwater depletion and pollution.

The Fayetteville Shale is the center of fracking in the state, though falling natural gas prices have recently brought drilling to a virtual standstill. Prior to that, the region had experienced a dramatic increase in earthquakes, which studies linked to fracking wastewater disposal. Complaints of earthquakes and noise, air, and water pollution led to lawsuits and greater industry scrutiny. The state responded to earthquakes by banning new disposal wells in some areas. Drilling operators must disclose chemicals used in fracking, except those deemed "trade secrets."

California10001 to 100kIt's complicatedYesThe California Department of Conservation's Geologic Energy Management Division is primarily responsible for fracking regulation: https://govt.westlaw.com/calregs/Browse/Home/California/CaliforniaCodeofRegulations?guid=I468B9D20D48411DEBC02831C6D6C108E&originationContext=documenttoc&transitionType=Default&contextData=%28sc.Default%29
In 2015, California adopted strict new rules requiring oil companies to increase monitoring/reporting of water use/quality, expand seismic analysis and public disclosure of fracking chemicals. In 2019, the state enacted additional laws to shift regulatory priorities further toward environmental protection and reducing greenhouse gas emissions. Actions included halting approvals of hundreds of fracking permits while environmental impacts were studied, and consideration of new strategies to strengthen public health protections, including significantly expanded buffers in populated areas. Another piece of legislation forbids state entities from entering into lease agreements aimed at developing petroleum infrastructure on federally protected lands.

Colorado10001 to 100k500 to 1000 feetYesRules governing fracking come from the Colorado Oil and Gas Conservation Act, which grants the Oil and Gas Conservation Commission regulatory authority. Rules are here:
http://cogcc.state.co.us/reg.html#/rules
However, significant changes are underway. SB181, signed into law in 2019, overhauls state oil and gas regulations and requires greater prioritization of safety and human health. The law grants local government more authority to regulate/restrict the industry. Existing rules must be rewritten and are thus subject to change in 2020 and beyond.

At the end of the 2019 legislative session, a proposal (SB 200) was approved by the Senate Environment and Natural Resources Committee to ban fracking. Whether SB 200 can prevail in the 2020 legislative session remains in question, with opponents arguing for modernization of Florida's oil and gas regulations rather than imposing an outright fracking ban. GeorgiaNoneIt's complicatedN/A
Although Georgia has no oil and gas production, the state passed its first fracking law in 2018, which updated drilling rules and increased environmental protections. The law created an oil and gas board to oversee drilling, increased opportunities for public involvement in advance of fracking operations, and beefed up companies' accountability for groundwater quality, abandoned site cleanup, and fracking chemical disclosure. The law also grants greater local government control over fracking activities.

Most fracking in Kansas occurred near the Oklahoma border until 2017, when the KCC received an application to frack in the Flint Hills. Residents protested, concerned in part about water contamination risks from two types of injection wells: enhanced recovery wells and wastewater disposal wells, as well as increased earthquake risks from disposal wells. To reduce earthquakes, the Kansas Corporation Commission has taken measures restricting wastewater injection wells and quantities in areas reporting increased seismic activity.

Additionally, residents of so-called "Cancer Alley" along the Mississippi River have raised renewed concerns about further oil, gas, and petrochemical development. Louisiana has a preemption statute and other laws limiting local control. As the Permian Basin has boomed, oil and gas drilling in New Mexico has increased dramatically. So have spills. Numerous communities have banned or restricted fracking, but their authority remains in question since the precedent-setting 2015 federal court ruling that Mora County's ban conflicted with state and federal law. In 2019, the legislature passed the Produced Water Act, a bill permitting wastewater re-use. The act also restored OCD authority to assess penalties for industry violations of the Oil and Gas Act.

While North Carolina has only limited shale gas reserves, the state ushered in the possibility of increased fracking in 2014 when its moratorium was lifted under the Energy Modernization Act. The act and subsequent legislation curtails the ability of local governments to enact their own oil and gas regulations, though some municipalities continued to maintain moratoriums. Fracking has played a major role in reviving oil production in the Bakken Shale. Although generally industry friendly, in 2014 the state tightened restrictions on flaring to reduce emissions. Starting in 2016, North Dakota saw massive protests against the Dakota Access Pipeline, which now moves millions of barrels of fracked crude oil through the state weekly. In 2017, ND raised the reporting threshold of spilled oil, gas fluids, and wastewater from one barrel (42 gallons) to 10 barrels (420 gallons).

The Department of Mines, Minerals, and Energy - Oil and Gas division regulates fracking in Virginia. Regulations are here: https://law.lis.virginia.gov/admincode/title4/agency25/chapter150/
Fracking here is concentrated in the Marcellus Shale, in southwestern Virginia. In 2017, the legislature rejected a bill that would have exempted companies from providing disclosure of certain fracking chemicals considered "trade secrets." A number of counties and municipalities in Virginia have imposed local fracking restrictions or bans.

Recent legislative actions include the 2011 Natural Gas Horizontal Well Control Act, which updated the permitting process for horizontal drilling and added environmental protections. However, lawmakers failed to enact a series of recommendations of environmental impact studies mandated by that law that were intended to protect residents, including more stringent setbacks and noise buffers. A 2018 law made it easier for producers to drill despite landowner objections. A growing petrochemical industry along the Ohio River is raising additional concerns about fracking impacts.

WisconsinNoneThe Department of Natural Resources regulates the oil, gas and mining industries: http://docs.legis.wisconsin.gov/statutes/statutes/295 https://dnr.wi.gov/topic/Mines/Sand.html
While the state lacks significant oil and gas reserves, western Wisconsin has been a leading producer of silica-rich sand mining that feeds the fracking boom elsewhere. Communities concerns about environmental health impacts have led to lawsuits against mining companies over air and water pollution, health problems, and diminished property values. Some communities have imposed zoning restrictions and moratoriums to study the impacts. Demand for frac sand began cooling in 2015, triggering bankruptcies from some major operators. Wisconsin law mandates that companies conduct mine reclamation.
