On 1/6/23 a follow-up inspection of the F M Demurry Well site was conducted in related to violations issued on 12/19/22. I was accompanied by Chase Ambrose (PA DEP).According to the NOI, the plugging for the site was scheduled to being on 10/12/22. On 12/19/22, violations of 102.4(b)1 and 78.53 were issued for failure to design, implement, and maintain BMPs. In response to these violations, the Department requested the following:- a map depicting the LOD of the project based on a survey of the current disturbance -survey points for the LOD staked/flagged in the field-the area of disturbance in square feet-a site restoration plan that includes a BMP inspection and maintenance schedule. The Department received a response to the violations from the operator on 1/4/22. The Department reviewed the response and posted it electronically in the NOV database so that it is available for public review. The response did not include the requested map of the LOD based on a survey, the area of disturbance is square feet, or a plan that included a BMP inspection and maintenance schedule. The response did indicate that an E and S plan had been completed for the site and was now present at the site. During the site inspection, the following was observed:-Sediment was present on the public road. Less sediment was present on the public road compared to the previous inspection (Photos #1-3).-The rock construction entrance was clogged with mud and did not appear to be properly maintained (Photos #2-5).-The Erosion and Sediment Control Plans (Photo #6) were present a mailbox (Photo #7) that had been installed along the access road. The plans appeared to be incomplete:- no surface waters were included in the drawing-no contours were included on the drawing-no LOD was included on the drawing -the BMP section of the plan did not indicate how the disturbed area would be stabilized -Straw-bales along the access road LOD were not anchored or trenched in (Photo #8).-Ineffective and improperly installed silt fences was observed on throughout the site (Photo #9-11).-According to the personnel present at the time, some perimeter BMPs had been removed because the E and S crew was on their way to the site to install new controls (Photos #12-14).-A small topsoil stockpile was observed near the plugging location. No elevated conductivity readings were obtained in that area of the containment (Photo #1). -The new tank was not hooked up to the well. -The pipe that had previously been attached to the old tank was not capped off (Photo #2), and a slow drip of fluid was observed coming from the pipe and hitting the ground below.-The substrate that was below the leaking pipe was stained and exhibited elevated conductivity (Photos #3-4).I informed Bryan Goletz of Diversified of my findings. According to Diversified in the NOV response dated 11/8/22 related to the first violations issued on 10/24/22, "The tank was not in service at the time of the inspection and the well doesn't produce fluid when in production". However, the fluid in the old tank during the initial inspection was at least shoulder height. And fluid is slowly, yet actively dripping from the pipe that should terminate at the tank. Outstanding violations of 78.57(a) and 78.54 are being issued.

I was accompanied by Chase Ambrose (PA DEP).During the inspection the following was observed:-A well tag was observed on the wellhead (Photo #1).-The operator's information was displayed and visible at the well site as required by OGA 3211(g), however the well permit number was not posted (Photo #2). -Some corrosion was observed on the well and production equipment (Photos #3-4).-It appears that a drain valve plug on the production tank is leaking (Photo #5).-Saturated gravel below the production tank exhibited elevated conductivity (Photo #6). -The earthen containment appears to be lined (Photo #7). I informed Bryan Goletz of Diversified of my findings. Violations of 78.56(a) and 78.57(a) are being issued for failure to contain production fluid in a tank.

I conducted a site inspection on June 7, 2023 at conventional well 033- 25481. I screened around the production equipment with my 5x Altar gas meter, no methane or combustible gases were detected. I observed where the soils have been remediated from the crude oil release. The area has been seeded and mulched. I screened the area using a Hanna Soil Probe for conductivity. All screenings were less than 1,000 uS/cm. Violations have been noted and immediately corrected.

An above ground marker with the permit number affixed was observed on site. The plugging certificate will need to corrected as it states a below ground marker was installed. According to the plugging certificate submitted to the Department on 1/31/2023, plugging operations were completed on 1/10/2023. Using a Bascom Turner Gas Explorer gas detector, the Department screened the ground surface around the monument/marker and the monument for gas. Sustained methane detections (0.308% - 0.438%) were observed inside the monument. The monument is a hollow steel casing approximately 4-5 feet tall. A slight hydrocarbon odor was observed. No methane detections were observed around the monument at ground surface.

Based on the Departments observations at the well, the operator failed to plug the well to stop the vertical flow of gas within the well bore. See violations remarks section.

I was accompanied by Chase Ambrose (PA DEP).According to the NOV response that was received by the Department on 2/7/23, the well was shut in, the tank was removed, and a new tank will be installed when a contractor is available.During the site inspection, the following was observed:-The corroded tank was no longer present at the well site (Photos 1-8), thus correcting the violation of 78.56(a)3.-The area where the tank and containment berm had been was graded.
