In response to these violations, the Department requested the following:- a map depicting the LOD of the project based on a survey of the current disturbance -survey points for the LOD staked/flagged in the field-the area of disturbance in square feet-a site restoration plan that includes a BMP inspection and maintenance schedule. The Department received a response to the violations from the operator on 1/4/22. The Department reviewed the response and posted it electronically in the NOV database so that it is available for public review. The response did not include the requested map of the LOD based on a survey, the area of disturbance is square feet, or a plan that included a BMP inspection and maintenance schedule. The response did indicate that an E and S plan had been completed for the site and was now present at the site. During the site inspection, the following was observed:-Sediment was present on the public road. Elevated conductivity was observed inside the earthen containment berm that surrounds the production tank. An operator response was received by the Department on 11/8/22 stating that the impacted material was removed and disposed of, and a new tank had been installed. On 11/23/22 a follow-up inspection was conducted and elevated conductivity was still observed in soil inside of the containment berm for the production tank (IR: 3462090). Outstanding violations were issued.Findings:-The area that exhibited elevated conductivity due to a leak in the corroded tank appeared to have been remediated. No elevated conductivity readings were obtained in that area of the containment (Photo #1). -The new tank was not hooked up to the well. -The pipe that had previously been attached to the old tank was not capped off (Photo #2), and a slow drip of fluid was observed coming from the pipe and hitting the ground below.-The substrate that was below the leaking pipe was stained and exhibited elevated conductivity (Photos #3-4).I informed Bryan Goletz of Diversified of my findings. According to Diversified in the NOV response dated 11/8/22 related to the first violations issued on 10/24/22, "The tank was not in service at the time of the inspection and the well doesn't produce fluid when in production". However, the fluid in the old tank during the initial inspection was at least shoulder height. And fluid is slowly, yet actively dripping from the pipe that should terminate at the tank.
