END of the Diligent Search (Chapter II, Art 6): In case their is no response from any of the sources consulted, the diligent search will be considered carried out three months after the consultation was made. FAIR COMPENSATION (Chapter III, Art. 7): The amount shall be determined by agreement between the rights holder and the beneficiary. The beneficiary is to make a judgment call and decide in each case, which are the relevant resources to consult. Right holder side wanted "remuneration", but the ministry specifically kept "fair compensation", since this was agreed in the directive. The Danish implementation seems to be very true to the original text. Most details are in the executive order connected to the law. The order and interpretation of it seems to be quite pragmatic and in line with the spirit of the directive; to make it "easy" for beneficiaries to find and make orphan works available to the citizens.

that provides users with a non-exclusive licence for 7 years to use an Orphan Work (subject to completion of a diligent search). The NCA may refuse to grant a licence if it considers that the proposed use or adaptation of the work is not 'appropriate'.

A positive addition in the UK legislation is the ability to make commercial use of an orphan work (as well as cultural use). A negative one in the UK is the requirement for an escrow payment and the fact that it does not revert to the body paying in the event of no revenant right owner appearing. The NCA is entitled to charge a 'reasonable licence fee' for the 7 year terms (bearing in mind similar fees charged for similar uses of in copyright non-orphan works). This fee will be held by the NCA for 8 years.

The result of the diligent search, no matter if the works was found to be orphan or not will be registered in a database established at MIBAC.
