Blueberries Harvesting & Packing-Workers will be harvesting blueberries according to color, firmness and ripeness; The workers will be riding, pruning, weeding, hoeing, cleaning, sorting, stacking, boxing, carrying, picking, dumping, folding, grading, sweeping, selecting, labeling, manually changing and dumping lugs, washing and sanitizing blueberries and preparing for market. Work is in inclement weather conditions including extremely hot, humid, cold and/or rainy weather. Workers will pick the ripe blackberries off the bush by grasping the blueberries between their forefinger and thumbnail, then lightly pulling and gently twisting the fruit off the bush and letting the blueberries roll
into the palm of the hand. The blueberries will then be placed in a harvesting bucket being careful not to overfill the container. The filled bucket will be taken to the nearest trailer where it will be dumped. The worker will then get their harvesting bucket back and start the process again. Workers will cover blueberries with netting to keep birds and other insects and wildlife from eating the berries and help prevent bird droppings on blueberries. Workers will repair farm buildings, fences, and other structures using hand tools, such as shovels, and tampers. Soil samples will be taken and fertilizer will be applies accordingly. After harvest season workers will remove dead blueberry bushes and plant new blueberry bushes. Mulch will need to be applied to established and new bushes protect blueberry bushes thru the winter months.

Workers will perform assigned duties as instructed by their supervisor to harvest blueberries and blackberries and maintain field integrity. During harvest, workers will walk down field rows and manually pick fruit by hand, utilizing a one-gallon canvas picking bucket supported by a shoulder strap. Workers will carefully remove fruit from the plants and place them into the bucket, taking specific care not to break limbs, damage the plants, or knock fruit to the ground. Once the picking bucket is full, the worker will carry it to the field truck at the end of the row and unload the fruit into a small tub or container.
In addition to harvesting, workers will perform various field maintenance tasks including tying, staking, and pruning plants to ensure proper growth. Maintenance duties also involve cleaning micro-jets, removing plastic drip lines, and using hands or a hoe to remove dead plants and weeds from the production areas. All general labor—including pulling weeds, hoeing, and moving irrigation pipes—will be performed under constant supervision to ensure tasks are completed according to farm safety and food hygiene standards. Workers are required to report to the supervisor upon completion of an assigned area before moving to the next location and must return all hand tools and containers to the designated shed area at the end of each work day.

The worker must be able to work outside for at least 7 hours a day in all kinds of weather (including heat, cold, and light rain) and be in possession of the requisite physical strength and endurance to work quickly and skillfully with their hands repeatedly at a sustained pace to meet the production standards demonstrated by the supervisor. The employer will provide all necessary tools and equipment at no charge to the worker. However, the employer may deduct the reasonable cost of damages or replacement of such tools if the loss or repair results from the worker's willful neglect or gross negligence; such deductions will only occur after the damage has taken place and after obtaining the employee's written authorization. At its sole discretion, the employer may pay a higher wage rate than the stated AEWR to any worker based on individual performance, specialized experience, or tenure with the operation. This voluntary higher pay is intended to reward performance and does not alter the fundamental entry-level nature of the job requirements.

Employees may volunteer to work additional hours when work is available. While available hours may occasionally exceed the hours offered, such additional hours are not guaranteed. Workers are not required to work beyond the daily or weekly hours stated in the contract, nor on a worker’s Sabbath or federal holidays. Workers should expect occasional periods of little or no work due to weather, crop maturity, or other conditions beyond the employer’s control. These periods may occur at any time throughout the season. If a worker requests a leave of absence during the contract period while work is available, the hours missed during that leave will be deducted from hours worked but still counted toward the total hours offered under the ETA-790 for purposes of meeting the three-quarter guarantee.

PICKING PEACHES, NECTARINES, AND APPLES:
Workers will be assigned a row, usually with a partner, and is responsible for picking all the proper fruit from that row, or half row. Fruits are selected from the tree according to size and/or color standard set by the picking supervisor. The entire tree must be checked to ensure removal of all fruit meeting-picking requirements. Fruits are placed gently in the picking container until container is full. The picking container weighing up to 25lbs. is then taken to fruit wagon and gently emptied into a field bin, taking care of not to spill or bruise the fruit in the container or in the field bin. Workers are to stay on their assigned rows unless directed by supervisor to change, or to help someone out sporadically. Picking units must be kept free of limbs, leaves, or mushy fruit. Fruit harvested specifically for sale at a roadside stand as fresh market specialty baskets in peck or half bushel containers must be field graded. Fruit harvested for sale at a roadside stand, extra care must be used to ensure that each piece of fruit is undamaged and perfect. Workers will be required to pick up and return picking ladders to the ladder wagon provided by the grower at the end of each workday or as directed by the grower or designated supervisor.
PRUNING:
While pruning trees, workers will receive proper tools for the particular job, i.e., saw, pruning tools, and hand snips. The supervisor will set a pattern for each orchard and will demonstrate and communicate this to worker. Workers will be assigned rows of trees and must prune each tree according to the predetermined specification. Workers must remove all resulting material from the fruit trees rendered from performing pruning tasks. When pruning is complete, each worker is required to rake and scatter the resulting brush in the center of the tractor/equipment middles.
THINNING:
While thinning tree, workers will be instructed as to how close together fruit should be spaced, and which fruit are most desirable to leave or take. The supervisor will set a pattern for each orchard and will demonstrate and communicate this to workers. Rows will be assigned to each worker, and it is the responsibility of the worker to complete the trees on the row according to the supervisor's instructions. Limbs must not be torn from the tree, nor should limbs be completely stripped of leaves or fruit. Proper spacing and selection of fruit are critical to maximizing the trees potential yield. Fruit thinners will thin fruit using hands and/or plastic bat to knock off excess fruit taking care to walk around entire tree before moving to the next.
ORCHARD MAINTENANCE:
Workers will be responsible for general orchard clean up. They will rake debris from the land such as sticks, straw, etc. Workers involved in orchard maintenance may be required to hoe trees, girdle, spread fertilizer, pick up roots and limbs, strip suckers or unwanted growth from trees, dig roots suckers, knock fruit off trees, use hand sprayer, remove vines, lay irrigation pipe, repair and maintain drip system, and strap and tie fruit trees.

PRUNING:
While pruning trees, workers will receive proper tools for the particular job, i.e., saw, pruning tools, and hand snips. The supervisor will set a pattern for each orchard and will demonstrate and communicate this to worker. Workers will be assigned rows of trees and must prune each tree according to the predetermined specification. Workers must remove all resulting material from the fruit trees rendered from performing pruning tasks. When pruning is complete, each worker is required to rake and scatter the resulting brush in the center of the tractor/equipment middles.
THINNING:
While thinning tree, workers will be instructed as to how close together fruit should be spaced, and which fruit are most desirable to leave or take. The supervisor will set a pattern for each orchard and will demonstrate and communicate this to workers. Rows will be assigned to each worker, and it is the responsibility of the worker to complete the trees on the row according to the supervisor's instructions. Limbs must not be torn from the tree, nor should limbs be completely stripped of leaves or fruit. Proper spacing and selection of fruit are critical to maximizing the trees potential yield. Fruit thinners will thin fruit using hands and/or plastic bat to knock off excess fruit taking care to walk around entire tree before moving to the next.
ORCHARD MAINTENANCE:
Workers will be responsible for general orchard clean up. They will rake debris from the land such as sticks, straw, etc. Workers involved in orchard maintenance may be required to hoe trees, girdle, spread fertilizer, pick up roots and limbs, strip suckers or unwanted growth from trees, dig roots suckers, knock fruit off trees, use hand sprayer, remove vines, lay irrigation pipe, repair and maintain drip system, and strap and tie fruit trees.

Sweet Corn: Workers will manually harvest and pack sweet corn by hand and machine. Corn harvesting will be performed mule train and corn belt style in crews on approximately 20 pullers. Workers will be pulling sweet corn off the stalk and tossing it into a metal bin on the mule train or corn belt. Workers will walk behind, in front of, or drive the mule train or corn belt. Workers must keep up with the mule train/corn belt as it moves slowly through the field at a speed ranging from ½ mile to one mile per hour. Assemble boxes/crates on the top of the mule train. Packers will pick corn out of the bins and place 48 ears into pre-made crates. Packed crates are then moved to workers who will fold and close the lid of the crates and push them down the conveyor belt system. Loaders will then lift and stack the full crates of corn onto the truck. Timekeepers will count and check the crates as they are loaded onto the truck and maintain daily log of hours and record the number of harvested boxes. Corn is harvested in the early morning hours starting before daylight, while temperatures are cooler. This ensures that the sugar content of the corn is higher and provides a better-quality product. A generator powered lighting system is used during early morning hours. Workers will avoid harvesting ears of corn with discolored husks, unacceptable shanks (longer than 6 inches) or visible worn or damaged shanks. Sweet corn must be harvested by pulling down while bending and reaching to select mature ears. Workers must carefully select ears of corn of correct size and maturity and toss into bin. Workers will assist in Good Agricultural Practices policies. Long-sleeved shirts and long pants are recommended to minimize contact with plants and thereby reduce exposure to cuts and scrapes. Gloves are recommended when working with wooden crates. Workers may be requested to submit to random drug or alcohol tests post hire at no cost to the worker. Failure to comply with the request or testing positive may result in immediate termination. All drug testing will occur post hire and not during the interview process and will be conducted at the sole cost and discretion of the employer.
Agriculture Equipment Operator to operate equipment used to harvest sweet corn. Must have the correct type of commercial driver's license required by State and Federals laws, or international equivalent. Will be responsible for operating the vehicles used to move crops on the farm. Must be able to safely operate the buses that are used to transport workers to and from work sites. Field Vegetable packing will take place on the field.

Workers must be able to perform strenuous manual labor outdoors in all weather conditions, including heat, cold, and rain, for a minimum of six (6) hours per day. The position requires physical strength and endurance to bend, stoop, and stand for extended periods, as well as manual dexterity to repetitively use hands at a sustained pace to meet production standards. This is a fundamental entry-level position; the employer will provide on-the-job training and all necessary tools and equipment at no charge to the worker. Consistent with applicable law, the employer may recover the reasonable cost of repair or replacement of tools if damage results from the worker’s willful misconduct or gross negligence, following written authorization. At its sole discretion, the employer may pay a higher wage rate based on individual performance or tenure, which does not alter the entry-level requirements of this position.

Employees may volunteer to work additional hours when work is available. While available hours may occasionally exceed the hours offered, such additional hours are not guaranteed. Workers are not required to work beyond the daily or weekly hours stated in the contract, nor on a worker’s Sabbath or federal holidays. Workers should expect occasional periods of little or no work due to weather, crop maturity, or other conditions beyond the employer’s control. These periods may occur at any time throughout the season. If a worker requests a leave of absence during the contract period while work is available, the hours missed during that leave will be deducted from hours worked but still counted toward the total hours offered under the ETA-790 for purposes of meeting the three-quarter guarantee.

A written copy of the work contract, or in the absence of a separate written agreement, the certified ETA Form 790/790A which constitutes the work contract, including any approved modifications, will be provided at no cost to the worker in a language the worker understands. Sanitation Requirements: For food and general personal safety purposes, all workers will be required and expected to follow common sanitary practices at all times. This is particularly critical when hand harvesting crops for human consumption. Employees are required to cleanse their
hands by washing them thoroughly with soap and water after using the bathroom and before entering the fields for harvest activities or the packing facility for packing operations.
Workers will perform various duties to plant, harvest, and stage crops grown on the employers farm.
Workers will remove the vegetable (listed above) from the plant according to size and maturity that will be able to be packed and shipped. Then the produce will be placed in a six-gallon picking bucket. After bucket is full the workers will and carry the bucket to a flatbed truck or flatbed field
trailer. A person on truck or trailer will receive the full buckets. This person will either dump the produce in plastic bin or set the full bucket on the truck or trailer. The person on the truck on the trailer will give a token to the picker each time they take a full bucket. This process will be
repeated throughout the day until the scheduled field is picked. Workers will also assist with irrigation and perform weeding duties (remove weeds by hand or with a hoe), along with pulling plastic from fields after harvest has finished.
Watermelons: At harvest, workers will be expected to select the melons based on the standard disclosed to the worker by the supervisor. Workers will walk along rows and cut melons according to size, color, shape and degree of maturity using a knife. Workers will load harvested
melons onto the bus. Also, the workers will be expected to grade, sort, and place in shipping containers.
Sweet Potatoes: Workers will work in all duties involved in planting, growing and harvest sweep potatoes. Workers will plant, cultivate, and harvest sweet potatoes. Workers will cut planting slips, and place in container according to instructions. Workers will use care when working with
potato knife. Workers will walk along row that have been previously plowed. Workers will drip potato slips into ground and cover back up with dirt. Workers will remove weeds manual either by hand or with a hoe. Workers will stoop, bend, and kneel to pick up sweet potatoes using hands
and fingers to dig out exposed potatoes. Workers may grade in the field separating #1s and #2s into separate 5/8 field hampers. Canners, when harvested will be placed into a separate bin. Damaged and diseased potatoes will not be harvested. Full hampers weighting up to 35 lbs. will be
carried to ruck row to be loaded into truck or trailer. Workers will be required to stay on their assigned row. Workers may also be required to wash the sweet potatoes and get the ready for sale.
Workers will perform various duties associated with grading, sorting, and packing onions, watermelons, squash, zucchini, potatoes, corn broccoli, cauliflower, kale, collards, greens, citrus, and avocado. All packing will take place on the farm.
Grading Working carefully remove any field debris and defective produce as defined by grading supervisor as produce moves across grading tables.

management, assign tasks and monitor crop production operations. Train workers in techniques such
as planting, cultivating, or harvesting and in use of safety measures. Train workers in safe equipment
operation. Take directions from managers on work schedules, production requirements, and
conditions of equipment and supplies. Maintain details of personnel actions.
Bus drivers/supervisors will pick up workers, take them to worksite, supervise workers, and
drive them back to their housing. They are required to live in the housing provided by employer
and take workers once a week to the bank, Walmart and to the laundry mat. Must have or be
able to obtain immediately a farm labor contractor license. Background check and random
drug testing will be post hire at employer's expense. Any crew leader (farm labor contractor)
employed under this job order must have a valid state and federal Farm Labor Contractor
Certificate of Registration and must abide by all the requirements of the Migrant and Seasonal
Agricultural Worker Protection Act (MSPA). The employer understands that they are
responsible for assuring that all conditions of this agreement are met regardless of any acts or
omissions of the crew leader
