On March 9, 2021, the Supreme Court dismissed the pending appeal (DHS v. New York et. al. - 2nd Circuit) and the 7th Circuit also dismissed the government’s appeal.

As a result of these decisions, the order left standing is the final judgment from the Northern District of Illinois from Nov. 2020 that vacated the public charge rule nationwide.

Therefore, DHS has withdrawn its 2019 public charge rule
