Obstacles are so financial (court costs, fees lawyer) and social (discrimination by the majority population and state authorities). In Romania, free legal aid is provided only to people with an average monthly income per member family up to 300 RON (about 65 EUR). This threshold is extremely low in relation to the gross minimum wage on the economy, and the way of proving the material state is done with an impressive number of documents, so few people belonging to vulnerable groups really have access to justice. Additionally, lawyers pro bono - an instrument to support social justice - is not regulated and encouraged in Romania, which prevents lawyers from supporting social causes in their communities and engaging in strategic litigation which would advance the protection of human rights. At the same time, there is a serious lack of understanding from the courts, magistrates and public institutions regarding access to justice from the perspective of human rights. The staff of the Romanian courts does not recognize the vulnerability of certain people and considers, for example, that HIV / AIDS infected persons, Roma, children or single mothers are not among the vulnerable groups.
