Applicants are a family of three Venezuelan nationals residing in Chile since 2016. I note PA's
spouse has not declared complete 10 years of past education/employment history as required. PA
has been accepted to Red River College for ESL pathway program. Cost of first year of studies is
approximately CAD$37,000, including tuition per LOA, and cost of living expenses in Winnipeg.
Tuition for the following year is approximately $15,000. Applicants have demonstrated some funds in
the form on bank statements but I note recent large and unexplained deposits. Not satisfied funds
are in place. I have concerns that the applicants are using the SP process as a means to enter
Canada given their weak establishment to Chile and weak ties to Venezuela. Both countries have
been impacted by instability in recent years. On balance, I am not satisfied re: BFs. Refused.

I have reviewed the application. I have considered the positive factors outlined by the applicant, including statements or other evidence. However, I have given less weight to the positive factors, for the following reasons: -the client's previous studies were in an unrelated field. The client's previous employment and educational history demonstrate an inconsistent career progression. My prove of funds is my dad personal savings account with $100,000 balance . Tuition for whole course is less than $30,000 . I have challenged this and ircc request out of court settlement .
