84 | EMAIL: Clay Cross Mike, on yesterday's (Tuesday's) show you mentioned that using encryption is like whispering in public. I agree with that, and I also agree that good encryption should always be legal. However, I disagree with just about every argument I hear on twit to support this position. I'll have to simplify my thoughts in order to avoid a TL;DR response, but basically it is that the fourth amendment limits the government's authority, not their capability. Police have the capability to listen took you whisper in public right now. As a thought experiment, should a safe maker be allowed to manufacture a cheap consumer safe that was absolutely burglar proof (assuming it was installed correctly), if in doing so it was also impossible for the police to break into it with a warrant? I don't mean that question pedantically, what do you think? On the other hand, the second amendment was designed to limit the government's capability (by giving the population an ability to resist), and therefore, at least conceptually, forms a much stronger position on which to base an argument for encryption.
