The rule does not require a policy on absences, but because student attendance and "seat time" drive funding, a policy is strongly suggested. The rule requires that an LEA create by policy an "enrollment measure" for non-traditional student enrollment and requires student tracking and data gathering that would benefit from consistent procedures, if not a policy.
8

State and federal law prohibit discriminatory employment practices in the workplace on the basis of a person's race, religion, national origin, color, age (if over 40), genetic information, disability, pregnancy or pregnancy related conditions (including breastfeeding), and, with the passage of SB296 (2015), sexual orientation and gender identity. Federal law (Title VII) also prohibits sexual harassment in the workplace. A policy stating that the school does not discriminate or tolerate harassment is not required under the law but is strongly suggested. The policy should include complaint procedures, including a contact person to whom all complaints are directed, and investigation procedures for looking into the complaint. Policy should also include an employee's rights under state and federal law to file claims with EEOC or the Utah Antidiscrimination Labor Division. This policy should be separate from a student discrimination and harassment policy because different laws apply and not all protected employee classes are protected student classes.
