AThe Preliminaries items included herein shall apply to the whole of the Works as specified and described in all the Contract and the rates and prices inserted by the Contractor shall be deemed to apply to the whole of the Works to be carried out under the Contract including Provisional Sum Works.

BThe Contractor shall be deemed to have allowed against clauses in these Preliminaries such rates and/or prices as are required for Preliminaries items.

CIn the absence of any rates or prices against any item or items in these Preliminaries, any monetary cost attributable thereto shall be deemed to have been included elsewhere in the Contract or that no compensation is required in respect of that item.

DUnless expressly provided otherwise in the Contract, the documents forming the Contract are to be taken as mutually explanatory and any rate or price inserted herein shall be deemed to provide for and cover the complete and total requirements of each and every part of the Contract.

EIn the event that no rate and/or price is inserted by the Contractor in respect of any item or items in these Preliminaries, no relative payments will be included in relation thereto in Payment Certificates, the Final Account and the Final Account Certificate.

FAny rate or price entered in the Preliminaries shall be at the sole risk of the Contractor and shall be binding on the Contractor and no adjustment will be made in the Final Account or the Final Account Certificate other than in accordance with the requirements of the Conditions of Contract.

GThe Contractor shall agree with the Superintending Officer on a schedule of monthly/stage payments for Preliminaries items for the duration of the Contract. The Superintending Officer reserves the right to adjust the Preliminaries payment schedule to reflect actual progress of the Works against the Construction Programme/ Works Program.

HPayment for Preliminaries on insurances (if applicable) and the security deposit/performance guarantee(s) shall be based on the premiums and service fees paid and the balance sum priced herein shall be apportioned based on the Contract duration.
