Equitable servicesLEAs that receive ESSER money must provide equitable services to students and teachers in nonpublic schools located within the LEA as required under Elementary and Secondary Education Act Section 1117. LEAs must engage in timely and meaningful consultation with representatives of nonpublic schools.

Maintenance of EffortAs a condition of receiving ESSER funds, states must maintain support for elementary and secondary education in FY 2020 and FY 2021 "at least at the levels of such support that is the average of such State's support for elementary and secondary education ... in the three fiscal years preceding March 27, 2020."

Continue to compensate employees"To the greatest extent practicable," entities receiving ESSER funds must continue to pay their employees and contractors during coronavirus-related disruptions or closures.

Provide technical assistanceThe SEA must, when applicable, provide technical assistance to LEAs on the use of ESSER funds for remote lerning.

Initial Reporting RequirementSEA must have in place the necessary process and system required under 2 CFR Part 170.

Quarterly Reporting RequirementThe state must comply with reporting requirements of CARES Act, Division B, Section 15011(b)(2) and submit quarterly reports to ED "at such time and containing such information as [the department] may reasonably require in the future." (2 CR 200.327-200.320)

Fund guidanceESSER funds are governed by the Education Department General Administrative Regulations, the Office of Management and Budget's Guidelines to Agencies on Governmentwide Debarment and Suspension, and the Uniform Administrative Requirements. Additionally, ED established ESSER-specific rules in a Federal Register notice.
