Among the menagerie was the Ativ Q, a hybrid tablet/laptop that can run Windows 8 and Android. There's also the Galaxy NX mirror less camera that runs android, no phone. An ultra book called the Ativ Book 9, both lite and plus models which run Windows 8. Add to that the Ativ Tab 3 Windows tablet, an All-in-one Windows PC called the Ativ One 5. And since they didn't have any extra time they also showed off the previously announced Samsung Galaxy S4 Active, Zoom and Mini phones. | http://news.cnet.com/8301-1035_3-57590154-94/samsung-goes-big-with-windows-8-powered-ativ-line/

A new ruling from a Tokyo court says that Samsung did infringe on Apple's "bounce-back" patent on earlier models of its phones. What effect will this have on your Galaxy S XYZ Mini whatchamacalit? Pretty much nothing as Samsung already changed its interface to use a blue line instead of the rubber-banding to indicate the end of a page. | http://thenextweb.com/asia/2013/06/21/japanese-court-rules-that-samsung-infringed-on-apples-rubber-band-patent/

16 | sl | Apple's fragmented! But developers need only target the latest operating system. ust 1 percent of Apple's App Store visitors still use a version older than iOS 5, released in October 2011. And only six percent are still using last year's iOS 5, the last version supported by the original 2010 iPad and 2009 iPod touch. Apple also expects that adoption of iOS 7 will follow the rapid pace of previous releases, due in large part to the company's aggressive efforts to upgrade users and to prepare developers for the update. 80 | Subject: Brian Brushwood made me cry I was brought to tears of sadness by the apparent defense of Microsoft's mostly on internet connected XBox and their recent 180. He suggested that in the future we would regret the backlash and the 180 MS made. I don't believe the future it presented was the future we wanted. The form of always on and control over purchases was not an acceptable form. It is a great thing the 180 happened. The best reason why is it gives MS or someone else a chance to develope a different approach. An approach that is acceptable and is the future, a better future. Don't think of it as a loss, but rather a chance to get it right. Thanks for the show. - John

74 | Hey TNT crew. On yesterday's show it was mentioned once again that Kinect units were firing off on systems during the Xbox keynote. While this might be true, these activations are most likely due to operator error. When Kinect is first setup, the Xbox goes through a calibration routine called Kinect Tuner. Part of the calibration has the Xbox broadcasting a variety of tones to determine the acoustic properties of the room. This footprint is one of the ways that the Kinect isolates player voice from Xbox output. Microsoft recommends running the tuner whenever there is a major change in the room, like adding or rearranging furniture. The faulty recognition of the Xbox voice commands is most likely the result of Kinect units that are out of calibration. Love the show. Rob Kruss

72 | Just finished listening to the podcast today. They are many reason that Skype Messages are a great idea but here is mine. Imagine being in the military like I am and deployed for half the year like I am. Think about needing to get a message to the wife or kids. Which do you think they would prefer, a voice message or to catch a glimpse of that husband or wife that's been out of their life for some time. Its just as great on the opposite side. Imagine receiving a Skype message from your teenager showing you that awesome report card and saying to you "love you dad.". You can't beat that except for stepping off that plane and seeing your family charging to plow you down. Anyway love the show guys. Dwayne.

37 | - The Supreme Court has unanimously ruled human genes isolated by scientists at Myriad Genetics may not be patented - dispute concerned a 2009 lawsuit filed by the American Civil Liberties Union, which claimed First Amendment was at stake because the patents are so broad they kept scientists from examining and comparing the BRCA1 and BRCA2 genes (assowciated ith overian and breast cancer). The patents issued more than a decade ago covered any new scientific methods of looking at these human genes that might be developed by others. now invalidated - Myriad found the location of a gene associated with increased risk of breast cancer and identified mutations of that gene that increase the risk,” Justice Clarence Thomas wrote for the court. (.pdf) He said isolated DNA is a “product of nature and not patent eligible.” - Myriad may patent its tests, but other are not forbidden from performing their own, non-infringing tests of the genes at issue or of patenting their own tests. That is because the court found that manipulated or synthetic human DNA, in which “a lab technician creates something new” from the original DNA, is patent eligible. | ACLU attny: “Myriad did not invent the BRCA genes and should not control them. Because of this ruling, patients will have greater access to genetic testing and scientists can engage in research on these genes without fear of being sued.” - previously, Women who feared they may be at an increased risk were barred from having anyone look at their BRCA1 and BRCA2 genes or interpret them except for the patent holder, which charged about $3,000 per test or more.

75 | Hi everyone, Yesterday Lamar was concerned about the 'agenda behind' the work that scientists have done many many times that has shown that driving while talking on the phone or texting is very distracting. Well, perhaps I can put this to rest a little. A student in our psychology department here at Algoma University (go Thunderbirds) ran a study for her honours thesis on this. Courtney Parr (working with my colleague Paul Dupuis) found that people were most distracted when using a phone or when using a bluetooth headset talking to a confederate compared to the confederate being beside them. There was no difference between the hands free and the (hand full?) phone condition. The subjects were using a driving simulator (aka my son's xbox driving wheel and Forza 4). The conversations were exactly the same, there was a script that the confederate followed. Courtney's agenda was clear, she wanted to fulfil the requirements of an honours BA in psychology….. 77 | Several Twitter clients seemed to have gone dark this week. Destroy Twitter, TweetDeck (at least the AIR client), even the Digsby integration all seems to be dead. Did something at Twitter change recently (I recall a story a few weeks/months ago about some changes to the API that would potentially hurt 3rd party apps), but it feels like there's *no* option left on the Windows desktop now other than going to the website (a terrible user experience that I've always tried to avoid at all costs, and definitely not conducive to staying on top of things in the way that having a client always open at the edge of my screen was). Any chance this can get covered on the show? As they used to say over on that other network, "Love. The. Show". 79 | Hey guys. Callum Orr from sunny Scotland here. Just thought i would pitch in some thoughts about the statements made about nintendo not wanting to license out their games. I think iyaz was entirely correct that it is just a bit of a backwards move to think that not moving with the current trend of gaming into mobile will save them. However it is exactly what has probably kept them afloat for the past few years. This is where i think they could be HTC's knight in metroid armour. they could either purchase or strike a deal with perhaps one handheld manufacturer, htc springs to mind as they constantly produce incredible hardware but dont seem to get any real benefits from it. and they could license out their ips to that single manufacturer? this way htc has some real muscle behind it, hopefully giving consumers a reason to pick up their amazing devices, and nintendo moves with the times a little and can augment their dwindling options. just a little thought. cheers!

39 | - new study says tools for hands-free internet connectedness takes driver's mind off road. “What we really have on our hands is a looming public safety crisis with the proliferation of these vehicles,” said Yolanda Cade, a spokeswoman for AAA, whose Foundation for Highway Safety released the study - study notes that in certain cars, drivers can dictate e-mails or text messages. (with something like siri and bluetooth, many cars can do this) - David Strayer, a neuroscientist at the University of Utah who for two decades has applied the principles of attention science to driver behavior, led the research: What makes the use of these speech-to-text systems so risky is that they create a significant cognitive distraction. The brain is so taxed interacting with the system that, even with hands on the wheel and eyes on the road, the driver’s reaction time and ability to process what’s happening on the road are impaired. - talking on a phone while driving creates the same level of crash risk as someone with a 0.08 blood-alcohol level. reason for the heavy load created by the technology was not totally clear. One reason appears to be the amount of effort required to talk to the dashboard, which is greater than talking to a person, who can interrupt and ask for clarification. | - automakers aren't being held to any real standard. In April, the federal government recommended that automakers voluntarily limit the technology in their cars to keep drivers focused. - - More than half of all new cars will integrate some type of voice recognition by 2019, according to the electronics consulting firm IMS Research. The auto companies argue these systems are safer because they are hands-free. - technology in cars will get smarter, more robust. does gov need to officially intervene?

47 | Why Pandora bought an FM radio station | http://thehill.com/blogs/congress-blog/technology/304763-why-pandora-bought-an-fm-radio-station
48 | - Christopher Harrison, asst. general counsel at Pandora, explained in a post at thehill.com why Pandora bought KXMZ-FM, a terrestrial radio station broadcasting out of Rapid City, South Dakota. - Pandora pays two royalty streams: sound recordings & publishing rights. By buying a terrestrial station, Pandora enjoys better rates. - in 2012 a settlement between ASCAP (entity that reps publishers) and radio operators gave lower rates to Pandora competitors like iHeartRadio (owned by CC) because CC owns terrestrial radio stations. By buying a single radio station in South Dakota, Pandora can qualify for the lower rates. - cnet notes: The preferential royalty rates are expected to snag savings worth less than 1 percent of its revenue versus the rates it is currently paying. Based on last year's top line, that equates to less than $5 million. | -harrison: in late 2012 a major publisher withdrew its new media rights from ASCAP, forcing Pandora to negotiate a direct agreement against a ticking clock. During negotiations, ASCAP and the publisher increased the pressure by refusing to provide Pandora the list of tracks that were being withdrawn, exposing Pandora to copyright infringement liability of up to $150,000 per work. At Pandora’s scale, such liability would be enormous. Faced with such potential liability, Pandora negotiated an agreement that resulted in increased rates. Shortly thereafter, additional major publishers took steps to withdraw their catalogs from ASCAP, again with respect to Pandora. - Pandora also suing ASCAP for discrimination and anticompetitive tactics. It also lobbied Congress to pass an Internet Radio Fairness Act that would set up a panel of judges to set rates. Harrison: "Certain powerful music incumbents see Internet radio as a threat to the status quo. Internet radio must be embraced -- not discriminated against."

If you want to make short-term profits from the stock price, then I am a very bad president. 76 | Sony's position on used game is really astute, I think, because they realize that disc-based games will diminish over time in favor of downloaded games and online gaming. Even if they perceive some revenue loss due to used game trading and game sharing and rentals, they know that the loss will decrease over time as gaming moves away from discs. --Alan

78 | Hey TNT gang – Was listening to today's show and wanted to weigh in with my thoughts on the new Mac Pro. I'm a recording studio engineer in Glendale, CA, and our facility works exclusively on Mac Pros for our audio workstations. We have to use PCIe cards for the Avid Pro Tools HD audio system. Using outboard expansion cards connecting over Thunderbolt is something that a lot of people in my industry have been doing for close to a year now for using Pro Tools HD on MacBook Pros (especially for field recording). I appreciate it's small size and don't really care about the look – our 9 computers are up for refresh and we'll be buying them for the specs. For most professionals that aren't self employed, I assume this is probably the case (especially with the price tag it will probably carry). We say a lot that Apple designs for 80% of users, and I think this is a case where Apple is designing for 80% of pros. Not sure about the physical design, but the power behind it should impress. Thanks guys, love the show. -tim

82 | I was thinking about your discussion of what will become of game consoles. I think the idea of a dongle is a good possibility. What would make sense is if the dongle was compartmentalized in the TV, kind of like inserting a SIM card or microSD card into your phone in a way that is hidden from the exterior appearance, in order to avoid the ugly protusion that the current USB sticks create. In this way, the TV manufacturers wouldn't have to make the device built-in to a piece of hardware with a ten year life cycle, they could use the opportunity to charge comumers extra for the device, and they could provide devices with different capabilities to cater to different markets. You can have your game dongle, your DVR dongle, your interntet TV dongle, and your all-in-one dongle. At appropriate price points of course. --Alan

Since Intel's TV service has yet to start, and therefore has no viewers, it can expect to pay a premium, all the sources - A Reuters source says that Intel hasn't closed any programming deals, but Viacom, News Corp and CBS have reached agreements on certain distribution details - A new detail on the potential service: Intel has suggested preventing viewers from skipping commercials on the first run of a show, said another source. 39 | - Intel is planning its own UI overlay, codenamed “Obsidian,” that it will bring to the mobile OS Tizen and possibly Android. A source working at Intel has tipped Ars with screenshots and video of Intel’s Obsidian project - Tizen, is backed by the Linux Foundation, Samsung, and Intel, hasn't shipped on any physical devices yet. - Samsung announced that it plans to launch Tizen devices later this year, mainly in Eastern markets. Intel's Atom chips have also made appearances in a handful of Android phones and tablets, but the company has yet to publicly announce further Tizen devices. - The Intel reference device that will get the Obsidian UI first is codenamed Josephine. The original “development-ready” date for the UI was set to be in July, but earlier deadlines have since slipped. As Intel has made no official announcements regarding Tizen releases | - The UI also makes use of a rotation to alert users to notifications. Rather than pop bubbles over an icon, the UI rotates the icon 45 degrees and displays a red notification in the bottom corner to differentiate it from the rest of the apps. The diamond element also crops up to display things like contact info.

44 | - Google bans both facial-recognition and voiceprint technology from Glass. last week announced on its Google+ page that it was banning facial-recognition apps. The ban went farther than that; updates to the actual developer policy expanded the ban to voiceprints, saying that any applications that use the camera or microphone to “immediately” identify anyone other than the user “will not be approved at this time.” - At a recent conference, developer Lance Nanek showed off a medical facial-recognition Glass app he built that could—for a set of patient faces entered into the system—allow Glass-wearing clinicians to verify someone’s identity and instantly bring up records on allergies or existing prescriptions, without using computer of any kind - under its developer overview, Google ultimately controls what the display output of any application will be on Glass. This implies that Google could even block people from sending out a face photo, getting it recognized, and then seeing the results on Glass—even if a facial-recognition app isn’t directly written for Glass. The company left open the possibility that future privacy-protection technologies might prompt a policy change. | - members of Congress wrote two weeks ago to CEO Larry Page to ask whether the company would prevent “unintentional” collection of data and whether it would allow facial recognition—demanding a response by June 14. The ban came after the Congressional letter.

72 | On Friday's episode of TNT, in the story about Apple and the potential release of a streaming music service, you missed a biggie. If you live somewhere OTHER than in the U.S.A., then you typically do not have things like Pandora, Spotify, etc. A few countries do have some of these options, but some locations have effectively no music streaming services. I suspect that Apple will be able to do a world wide streaming service, in all the countries where you can currently buy music from them via iTunes. As such, Apple will become the king of streaming in a global sense. We'll find out more on Monday of course. - Mark

74 | Hey TNT crew: I used to work for an organization that looked at the problem of credit card swipe fees. With businesses that make most of their money on smaller transactions (under $20), the cost of the fees is often in their top 5 costs- and moving higher each year. If Google can capture enough transactions across millions of businesses, they can negotiate a lower overall fee. If they get the fee low enough, they can operate at net zero, but collect data, which is their bread and butter anyhow. I want to try Google Wallet, but it isn't supported on my GS3, even rooted, running Cyanogen. Love the show! Mike in DC

12 | tm | The Washington Post and The Guardian reported yesterday that nine tech companies, Microsoft, Yahoo, Google, Facebook, PalTalk, YouTube, Skype, AOL and Apple, gave the NSA direct access to their data through a project called PRISM. All the companies except AOL and PalTalk have denied knowledge of any such program. 62 | - - Forrester Research estimates that U.S. mobile payments will top $90 billion in 2017, up from $12.8 billion last year, but successful companies like PayPal and Square make money by charging retailers fees in excess of what they owe to credit-card companies. - Google has hundreds of developers working on Wallet and spent about $300M buying digital payment startups. But Wallet has been downloaded fewer than 10M times in the two years since its launch, according to Play - Google doesn't renerate fee revenue from the transactions like banks, PayPal, Square do. Google collects consumer data and target ads to them. Google pays such high fees to the credit-card companies it works with, though, that it loses money on every transaction, says Osama Bedier, who stepped down as head of Wallet on May 20 and will shortly leave the company. - only Sprint supports wallet. Verizon, AT&T & T-Mobile block Wallet on their phones and have teamed up to develop their own software, called Isis. MCX, a consortium of retailers including Wal-Mart and Target, is also working on a similar app. | - Larry Page in March gave advertising head Sridhar Ramaswamy control over Wallet. Google may scrap a Wallet credit card it’s developing, according to 3 people familiar with the project. It’s already changed its plans to build a Wallet-compatible Android tablet that can read credit cards for brick-and-mortar retailers, intended to rival Square’s card-reading tool, according to 4 people familiar with that project.

74 | TNT folks, Living in Western Massachusetts we have JUST gotten Peapod in our area. I am not so sure about getting fresh things delivered through Amazon but would be willing to try it. I am with you Tom, being home for the delivery is a challenge. However, I would love the ability to order the groceries and pick them up at a specified place along my route back home from work. It would greatly reduce time spent in the store and also allow me to just swoop in and pick it all up quick. They could even do curbside takeaway style. You drive up and they recognise your car and bring them out to you. Regards, Phillip Dudas Chicopee, MA
