Course readings also include different perspectives on federal Indian law and current developments. The course will start with an introduction to the American legal system and study of how laws are developed through case precedent, including a close examination of the Marshall Trilogy, three 19th century cases that helped to define the relationship of Tribal Nations to the federal government and the states under the Constitution. Among the topics, the course will cover the legal framework for tribal sovereignty and governments, treaty relationships, historical federal policy and law towards Tribes, the Indian Reorganization Act, civil and criminal jurisdiction in Indian Country, and tribal management of property, water, and other natural resources. The course would also cover recent state and local legal developments relating to California Tribes, including AB 52 that requires government-to-government consultations between Tribes and California government agencies for projects impacting Tribal cultural resources.
