4/22/18Men's Club D4Alliance IIFort Worth IIMorrow, VictorMorrow, VictorOtherThe TRU Disciplinary Committee has received a report relating to the conduct of Alliance roster players and those that were present on the Alliance sideline during a match vs Ft. Worth on April 22, 2018.

Based upon the reports of the Match Officials, as well as the submissions in responce to the notice of those reports, relating to the Alliance vs Ft. Worth match on April 22, 2018, the TRU DC makes the following findings:
1) Members of Alliance sideline entered the field of play without permission of the Match Official in violation of the Laws of Rugby and the USA/TRU Disciplinary Rules and Sideline Policies;
2) The conduct of the Alliance sideline fell far below the expected standards, if not violated the Laws of Rugby and the USA Rugby/TRU Disciplinary Rules and Sideline Policies, sufficient to prompt Match Officials to view as such and to report such conduct/behavior.

The TRU DC recognizes and takes into consideration in this ruling, Alliance’s efforts to foster admirable qualities related to the philosophy and culture expected from TRU Member Clubs and encourages Alliance to continue those efforts. That said, lapses occur and the TRU DC views this as such and admonishes Alliance to re-double their efforts in this regard, refresh their familiarity with the Code of Conduct, Sideline Policies and other related standards, as well as communicate such to their members. This is especially poignant as Alliance has earned the right to continue play into the TRU Playoffs. Alliance’s conduct/behavior will be under close scrutiny and Alliance is placed on notice that any further reports of similar conduct that is the basis of this report may have serious detrimental affects of Alliance and it’s members that may include jeopardizing TRU/USA Club Membership, the assignment of Match Officials and the imposition of remedial conditions (i.e. mandatory sideline video submissions, mandatory match video submissions) for continued membership and/or participation.

Match Officials are the most precious resource our sport presently needs and the development of those, especially younger athletes, are essential to not only the growth of rugby, but it's very survival. All Match Officials shall not only escape ridicule, insult and abuse, but shall be treated with respect, encouragement and appreciation before, during and after the match, at all times.

Please take steps to ensure that all Match Officials (including TJs/ARs & #4s) are treated with respect and any instructions from those officials (including TJs/ARs & #4s) are not only complied with, but are complied with without complaints, derision or contest. Additionally, please ensure that no one enters the field of play without the express permission of the Match Official and compliance with the the Sideline Policies/Protocols are strictly adhered to.

The TRU finds the following:

1) The original sanction of 3 weeks/games for the incident on April 14th is justified, and perhaps even generous. Those sanctions are AFFIRMED.

2) The calculation of the date certain to return to play on April 30th erroneously included D2 qualifying matches that neither player would be eligible to play in due to USA Eligibilty Regulation 3.5(d), commonly known as the "50% rule", and a D1 Women's match misidentified as a men's game. The TRU considered that players had already been given a date certain by the DC, that the DC viewed the two players to be equally culpable and deserving of similar sanctions, and the precedents that might be set both in terms of the complexity of future enforcement, and the potential inequity of sanctions early season vs. late season and single-side club player vs. multi-side club player.

In light of the above, the calculation of the date both players are eligible to return to play has been REVISED. Both Mr. Myeni and Mr. Davidson shall be eligible to play on May 5th, 2018, three (3) weeks after the date of the original incident. This means that neither player shall be eligible for the RRRC semifinal on May 4th, but both players will be eligible for the final on May 6th should their teams advance.

Mr. Lindani Myeni (CIPP 2362215) of Glendale Merlins & Mr. Charles Davidson (CIPP 2047640) of Dallas Harlequins were each issued Red Cards in their match on April 14, 2018 for striking an opposing player, multiple times, in the head. After consulting with Red River Rugby Conference (RRRC), as this was a match played within the GU or the the TRU, (Dallas, Texas), the TRU DC has disciplinary jurisdiction in this matter.

Since neither Club, nor player submitted anything for review to the DC, nor was video submitted by any party, a comprehensive review/finding is limited to the Discipline Reports, which suffice as the basis of this review. It is the finding of the TRU DC that Mr. Lindani Myeni (CIPP 2362215) of Glendale Merlins & Mr. Charles Davidson (CIPP 2047640) of Dallas Harlequins each struck an opposing player, multiple times, in the head. The TRU DC further find that this was not an isolated “dust up” that involved only these two players in a "tit for tat” exchange, but rather stemmed from other actions and/or causes and involved some form(s) of retaliatory action(s) by these players.

It is the decision of the TRU DC that Mr. Myeni & Mr. Davidson are each suspended for three (3) weeks/matches.

It was reported that Mr. Petaia had committed several infringements prior to this one, most notably being penalized for a late tackle.

This was Mr. Petaia’s first match following a three (3) week/match suspension.

Considering Mr. Petaia had only just returned from suspension, thus receiving a Red Card in successive matches, committed repeated infractions culminating in a dangerous tackle, it is the decision of the TRU DC that Mr. Petaia is suspended for nine (9) weeks/matches.

Since this suspension will extend beyond Austin Huns's current XVs season, this suspension will carry forward through into next season and Mr. Petaia will be ineligible for the first seven (7) matches of the 2018-19 season. Calculation and satisfaction of this suspension will be determined by the Club Mr. Pataia registers for the 2018-19 season (presumably Austin Huns).

If Mr. Petaia is a 7s player, he and/or his club must show proof of prior 7s play and request that any Austin Huns 7s Tournaments be considered towards the suspension and the DC will make a determination, if requested and demonstrated. Since the 2018-19 XVs season has yet to be scheduled, any Club that wishes to play Mr. Petaia, must request clearance from the TRU DC to verify compliance and satisfaction of the sanction

TRU DC has reviewed all submissions from Dallas Reds, Mr. Hernandez, the initial report and the video of the tackle. It is the opinion of the TRU DC that the tackle was dangerous, as it involved the lifting of the leg with an upward movement after contact, resulting in the tackled player going beyond parallel and caused the tackled players’ head and shoulder area to make the initial contact with the ground. It is also the opinion of the TRUD DC that Mr. Hernandez did not act in a malicious manner, did not drive the player into the ground, nor made any intentional attempt to injure the tackled player. The TRU DC also recognizes that Mr. Hernandez’s lack of disciplinary history mitigates in his favor, as does the Mr. Hernandez’s statement he submitted that recognizes the dangerous nature of this type of tackle, as well as the importance of proper tackling form, which also significantly mitigates in his favor. It should also be noted that Dallas Reds submitted video of the tackle, which also mitigates in Mr. Hernandez’s favor, in that it allows the TRU DC to review the matter without the lens of subjectivity to alter the event. The IRB Appendix sanctioning for this type of situation is: Lower End = 4 weeks/matches; Middle Range = 8-weeks/matches and High End = 12+ weeks/matches. The TRU DC has taken all of this into consideration and feels that the mitigation factors warrant a sanction below the Lower End and is of the opinion that the action, circumstances and mitigation factors warrant a three (3) match/week suspension.

Taking into consideration Dallas Reds’ schedule and all relevant factors, Mr. Hernandez is eligible to return to match play on April 22, 2018.

2/24/18Men's Club D2San AntonioWest Houston LionsJones, ColeCornett, JuanOtherOn Saturday, Feb. 24, 2018 during the SARFC v W Houston Match, Juan Cornett (CIPP 2357879 with SARFC) came onto the playing enclosure/field from the spectator section and made contact with a W Houston player. It was immediately following an altercation between players and it was reported that Mr. Cornett then yelled at the West Houston team, swearing and threatening them, although Mr. Cornett denies such.

It is the ruling of the TR DC, that Mr. Cornett is suspended from Match Play and/or prohibited from attending any San Antonio RFC matches for two (2) matches. This suspension is based on: one (1) match suspension for entering the field of play/playing enclosure; and, one (1) match for making contact with a player.

The TRU DC recognizes Mr. Cornett’s lack of disciplinary history, as well as his acceptance of responsibility, both mitigating factors that the TRU DC has taken into account and which account for the lowered sanction.

Entry onto the field is strictly prohibited and usually leads a more inflamed situation, and cannot be tolerated. While the person who does so may do so in an effort to protect or de-escalate a situation, it rarely does so and can easily and quickly inflame the chaos that a Match Official may be trying to diffuse, as well as incite others to do the same. As such, sideline policies are in effect for good cause and reasons.

Mr. Cornett may return to Match Play and/or attending SARFC Matches on March 25, 2018. In the event that the “postponed” 2/10/18 match vs HARC is rescheduled and played prior to the end of the reinstatement date of March 25, please advise the TRU DC and the return to play/attendance date may be revised.
