The basement was flooded with 30 ft of water, and even though they pumped it out, it's still seeping in from side walls. running water but has not been tested, so just use it to flush toilet. All dependent on ConEd. You can enter your apt w/ photo Id & keys. They said to check the emails they'll be sending out updates often11

116JohnNoSun 2:30pmThe basement was completley flooded and even though they've pumping out water, they have to wait on a bunch of parts to come in from NJ, including a huge generator they hope will power the building. The management team should have a better idea of the situation and will send an update monday afternoon. From resident who talked to Building mngt "the buildings life safety system needs to be replaced,no timeline given but seem optimistic"3

75Wall StreetYesTues 10:30amConEd was able to restore power to 75 Wall at around 2:00 am (11-5-2012). There is still no heat/hot water, and the gas supply is nearly gone. UPDATE: The elevators are up and running (11-6-2012)9

90Washington StreetNoNoNoSun 4:00pmHere is what the building maintance guys in the lobby who have been working in the basement told me at 4pm: Latest update from ConEd is that it will be a "few days" before power gets restored. The power is completely dependent on ConEd's response time. They have to replace the entire electrical system downstairs after extensive floor to ceiling flooding. Residents can enter any time, all day & all night to get things. Just bring flashlights

UPDATE 6pm Sunday: building management sent email that today they finished pumping water from the basement and that the electric equipment there is "drying" tonight. This seems inconsistent with the other information posted here. <- can you clarify, what is inconsistent with the above paragraph? A: Management is indicating that ConEd isn't at the building yet, when ConEd has told us otherwise. <- just to clarify, it was from the mouth of the maintenance guys at the desk, saying what the update was from ConEd, no detail was given whether they had or had not entered the building

According to ConEd at Sun 2pm coned inspectors are at the building and should be able to give us an eta on power today. Global estimate is Nov. 9th. If you call coned and give you phone number they will call you directly with an update. )
Any real estate lawyers at 90W? Would like to know what our options are in terms of rent reduction or reimbursement of living expenses if making alternative arrangements.

A: NOT LEGAL ADVICE but yes, some of us are lawyers living in the building. Unsure of options until management answers the question of whether we will get a pro data reduction in rent for the days the apartment was uninhabitable (or at least the days during which 90 Washington was uninhabitable while neighboring buildings like those in Battery Park City already had power restored). Once management says no to that, we should assess legal options regarding withholding rent, etc. Strength in numbers will be important in this regard; we ought to draft a letter signed by as many tenants as possible.

A: Not intended as legal advice, but you should reference your lease to see if you there any act of God exceptions. I imagine you won't be the only one seeking rent to be refunded, so management will have to make a decision regarding all those seeking some kind of reimbursement.
