What does giving info look like? Does it have to be in response to every employee or can it be liek giving wide notice to the whole company once a quarter or someting like that?When an employee notifies you of a need to take leave that may be covered for FAMLI, you need to notify that employee individually. Regular company-wide notification is an excellent idea but is not sufficient to meet the notification requirement. Do those new contact roles (finance, legal, payroll, etc.) grant MyFAMLI Employer+ access, or are they informational for FAMLI outreach only?The new contact roles allow FAMLI to target correspondence to the person within your organization who need that information most and does not impact access at this time. Additional enhancements are planned for the future.

I am encountering situations where I have to inform the employees AFTER they've taken "SICK" time, only to find out they qualified for "continuous" leave and this has caused a lot of reconciliation AFTER the "SICK" days ended and having to fix payroll after they've received their regular pay (by taking available SICK time) and then received benefit from the FAMLI division. I understand there is no question asking the employee "have you received any pay from your current (or fomer) employer already and if so, how much?" this question would certainly help the conversation between the employee and the employer to find the best means to move forward about how to handle the "correction." Is it possible to add this question to help ease the administrative burden? Thank you.live answered

When will Colorado SUTA update to handle out of state wages? This is a huge issue every quarter.While we don't have an exact ETA, we do have several enhancements we are looking to implement to improve this process and make it easier on TPAs and employers.

Everyone says "just reach out with questions" but my experience has been that I will sit on hold for hours. Emails go unanswered. The AI answering service is circular, doesn't understand our questions, and pushes us back to the main menu. What is the best way to get a hold of someone when we have problems and questions?Hi. follow up to my original question on FMLA. If I employee my minor daughter, do I have to pay it...or I guess a brodersAll employees of the business are covered if you meet the criteria to be liable as an employer - you employ one individual during twenty weeks in either the current or preceding year. There is no exemption for family members of the business owner.

Last year I missed notice that the FAMLI rate changed from .45 to .44. Annually, when will notice be given of a change or no change? Thank you.Any changes to premium rates will go into effect January 1. We will provide notice in July via newsletters and the formal rulemaking process.

We have one remote employee in Colorado, so I just want to make sure there is not more I should be doing.Unfortunately, Quickbooks does not automatically report filings. You will need to log-in to MyUI Employer+ to report for UI premiums.

I currently do not have any employees. My wife and I operate a food truck business as an LLC partnership. At this time, neither of us is receiving income from the business. Could you please clarify what my role should be listed as for UI Employee?If you report to the IRS as an LLC s-Corp, then you would be responsible for reporting owner wages for UI. If you report to the IRS as an LLC sole-prop or partnership, then owners are exempt.

If you’re paying them to do your payroll, which includes calculating both employee and employer taxes - they should be doing this for you. But it does require you going into your MyUI employer+ account and adding them as a TPA so QB has access to file for you.live answered

We dont have the FAMLI payroll deduction... what should i do?If an employer does not deduct FAMLI premiums from employees, they are responsible for paying the entire premium.

For FAMLI- Tracy Marshall originally stated that FAMLI would run concurrent with FMLA, now we are hearing that employees are being told to use their FMLA first then apply for FAMLI. This is very harmful as employersFAMLI can run concurrently with FMLA, but employees are allowed to reserve their FAMLI to use after FMLA has been exhausted. Employers cannot require employees to use FAMLI, but can incentivize its use concurrently with FMLA through the use of other voluntary programs. For example, STD or other leave programs can be contingent upon usinf FAMLI concurrently with FMLA.

The process for "self employed" individuals is very difficult to employers who also have employees. The guidance from the FAMLI office is inconsistent as to what qualifies as wages. I've gotten guidance to submit payroll wages as a S-Corp owner, total gross income, etc. Where is the specific guidance on what is the correct reporting to be made? Additionally, it makes sense for S-corp owners with employees to submit with their staff by the payroll companies. We are spending a huge amount of time manually filing reports.We require separate accounts for Self-Employed Individuals because we must track your election to participate in the program and verify your income from self-employment to ensure the accuracy of benefit payments. Are Childcare Centers considered a Direct Care Employer?No. Childcare employers are not Direct Care employers. "Direct care employer" is defined as any home care employer, provider agency, or organization that employs direct care workers to deliver hands-on care, services, and support to older adults and individuals with disabilities across home and community-based settings. With respect to quarterly wage reporting, we report the same information to dept of labor and FAMLI. We are a new employer and it wasn't clear that we had redundant reporting requirements and incurred penalties. We still don't know what we might have missed until we incur a penalty. This is akin to reporting our annual tax information to each federal agency and then being penalized for missing one. Is there any plan to streamline reporting into a single stream? If not, why not?live answered

What happens when an employee is in famli and is terminated do to the company cuts for downsizing?These situations can be very fact-intensive, but typically an employee who is terminated during a period of continuous FAMLI leave continues to receive FAMLI benefits through the approved duration.

I have an employee who recently took FAMILI leave for medical reasons. This employee works 32 hours a week and their annunal salary is already adjusted for that. However, when they put into FAMILI for their leave, the actual payments they recieved were reduced from what they were entitled to, because the system was targeting to 32-hours a week instead of 40. But, again, we've already adjusted to that on our end. Is there an appeals process the employee could file to recoup the lost payments, or are they out of luck because they didn't know to file as if they worked 40 hours a week in order to get their full entitled benefit?live answered

Please give TPAs more visability and ability in both systems. In FAMLI, TPAs need to see details on prior filed returns and employee wages and in UI, TPAs need the ability to file adjustments even with another TPA that has current filing capabilities. this is a follow up to my first question. how does the FAMLI division calculate the net pay of the benefit amount. I have an employee who received $872.87 from FAMLI but her four days of SICK she took (that I need to return to her SICK bank) is $1,074.32 and I was told from my payroll processing platform that I need to enter a negative $1,074.32 which may or may not end up with $872.87 as her net pay that she received from FAMLI since I don't know how FAMLI calculates their benefit amountFAMLI benefits are calculated on a sliding scale, with amaximum of 90% of the average weekly wage, so FAMLI benefits will always be less than the regular pay.

I apologize if I missed it… For owners of corporations you were saying they have the choice to buy into the benefit but don’t have to. What I’m not clear on is this true if they have other employees, or is this only the case if they are the only emloyee? So if you have a copropration and have 4 staff, can you exempt yourself and have the benefits for your staff but not yourself?Owners of corporations are able to opt in to FAMLI whether they have other employees or not. If they do have other employees, they need to establish a separate FAMLI account for their individual participation.
