Survey:   Protection of Freedoms Bill & Vetting&Barring
Part 5 of the above Bill has started its progress through the House of Lords having completed its Commons stages in October.   Fair Play for Children and numerous other bodies have expressed deep concerns about aspects of Part 5 of the Bill because we fear proposed changes to Vetting and Barring will put children at risk and remove many now able to be checked under CRB from the possibility of being checked.

It is proposed that only the applicant will be sent a disclosure certificate and the employer will have to ask the applicant to view the copy

It is proposed that those convicted of offences against children only be placed on the Children Barring List if they apply for a relevant post in the future
Currently they are placed on the Barring List automatically on conviction.  This has happened since the 1930s.

Fair Play believes in the idea that 'Secondary Access'  is a key issue in determining whether vetting should take place
The argument is that whilst someone may be supervised within a children's activity, the trust s/he builds with children there can be and is exploited in the community where they all live.   Such access created within a scheme cannot be supervised outside.

The Bill proposes a considerable restriction on who can be checked - if they are 'supervised' then they cannot be checked.
This means, for example, that many volunteer applicants will no longer be checked on the assumption they will be supervised.  Fair Play believes this is unrealistic and could lead to unsafe people gaining access.

Fair Play argues that it would be best practice for the Act, if passed, to be subject to area pilots before full implementation
This was done very successfully with "Sarah's Law" (prospective partners able to view records of 'intended' re information on child convictions) - scheme then appraised and run out nationally.

Fair Play argues that all legislation that could affect children should be assessed against our obligations under the UN Convention on the Rights of the Child
Curently this is not done, the UNCRC is not mentioned in any Govt briefings on the Bill.  All proposed legislation is assessed against the European Convention on Human Rights

CRB Volunteer Checks are Free Because Employers whose work involves children are charged extra for Checks on paid employees to cover this.  Fair Play says this is unfair and a tax on employers
