Very bad story that came with pictures on Daily Mail. The reporter basically randomly copy-pastes quotes from an email "interview," mixing up facts, giving wrong names for animals presented on images. The images that got published were printed, scanned, and then uploaded online in horrible quality, which produced a lot of negative comments towards me (the photographer).

Overall, around 10 pictures were published in Daily Mail, and a few in newspapers. With a split of 50/50 (which is way below average), that should have given more than 100 GBP. I received payment about 9 month after publication. If not for weekly (!) reminders for the duration of this period (I am good at managing my email client and creating automatic reminders for myself), they would have "forgotten" about the deal for sure. The excuse were quite typical for every news agency: 1) spam filtered 2) a few months-long vacation (probably whole agency staff at the same time) 3) "we though we paid you a long time ago" (answer came up not a single time) 4) just absence of reply - the most common one.

What I learned from this experience: news agencies are perhaps not a good idea for animal/wildlife photography; you need very good negotiation skills and be very specific and insistent; you have to ask exact quotes to know what each individual publication earns and double check if that's correct before you let them publish; you have to be very insistent about checking the story before it's published and refuse to work with the agency if they are not willing to cooperate on this step; and, lastly, make sure they know at least basics about image processing and printing. Negotiating things after publication is pointless - there will be a lot of excuses about "not our fault."

I risked with another new agency (that looked way more respectable and I recognized a few photographers I know who published with them) for the second time and generally regret it.

They also required several talent, different ethnic backgrounds. Usage local and worldwide, no loadings for talent or photographer.

Also in the mix, the budget had to include a stylist, and hair and makeup artist.

We considered that the budget would probably not cover the model/talent fees.

The shoot could run to 20 days plus. Given that i pay my assistant $300 per day, the assistant alone would be due $6,000 on a 20 day shoot.

One highly experienced pro shooter I discussed the scope of the job with, before I mentioned the budget, said $250,000. He has been in the biz for 40 years.

An intern once responded to my email to say the policy of the magazine was to use free photos in order to "keep costs of publishing the magazine to a minimum." They charge $4.75 per issue, printed monthly.

I got paid upon delivery of images first & last time because I demanded it. Payment is supposed to be made a week after delivery of images and inspection. Whereupon they try to find deductions on the pay. I threatened not to give them the images unless a check is provided upon delivery of images.

However, if they want to see true oppression they don't even have to leave their fancy NYC state of the art offices. All they need do is read the mandatory contract they demand freelance photographers sign. Not that they have that much work to hand out. Their day rate for an 8 hour day is $200. Now they will tell you the newspaper biz is tough times. However, even when they were making enough bank to buy the Boston Globe for over a billion, their day rate was still $200 -- it's been 200 for at least 2 decades. Of course their photo editors know it's crap -- when they tell you the rate they look like they just got caught at awards dinner with a leaky Depends. As bad as the day rate is, their contract is worse. But don't take a poor photographer's word for it. Here it is:

This letter sets forth the agreement between you and The New York Times Company ("The Times") for freelance
photography services you may be commissioned to provide on assignment to The Times.
1. (a) The Times will pay you a day rate as agreed upon by you and The Times. Payment will be made for acceptable
material on submission of an invoice within thirty (30) days of completion of the assignment. Any terms appearing in your invoice
that add to or change the terms of this agreement will not be binding.
(b) The Times will reimburse you for reasonable expenses provided that you submit documentation acceptable to The
Times within thirty (30) days of incurring the expenses. The Times determines the rate at which film and mileage are reimbursed.
2. At the conclusion of each assignment, you will deliver to The Times all film, video and/or other recorded images and/or audio
resulting from the assignment (the "Work"), as well as complete and accurate information for captions. The Times will credit you on
published Work according to its crediting policies. The Times is not obligated to publish what you submit and will not be responsible
for the loss or damage of Work.
3. You acknowledge that the Work has been commissioned by The Times as a contribution to a collective work and that The
Times’s interest therein arises as a “work for hire” under the Copyright Act. The Times hereby assigns to you a joint copyright interest
in and to the Work such that the worldwide copyright in all Works created pursuant to this agreement shall be deemed joint works
owned by The Times and you. In the event the Work is deemed not to be a “work for hire,” you hereby assign to The Times a joint
copyright interest in and to the Work to effect joint copyright ownership.
4. Subject to the limitations set forth in paragraph 5 below, as joint copyright owners of the Work, The Times and you shall each
have the irrevocable, non-exclusive right to exercise any and all rights granted by the United States Copyright Act, including, but not
limited to, the right to reproduce, display, distribute, sell and transmit the Work throughout the world, in any media now known or later
developed, to sublicense the foregoing rights, and to create derivative works; provided that neither you nor The Times shall have the
right to grant rights in the Work which would purport to restrict the rights of the other party under this agreement. In exercising your
rights hereunder, you may not use the name of The New York Times or The International Herald Tribune.
5. You agree that you will not exercise any of your rights under paragraph 4 above with respect to any Work published in the
printed edition of either The New York Times or The International Herald Tribune, or any successor newspapers thereto (collectively,
the "Newspapers", individually, the "Newspaper"), or on nytimes.com or iht.com, until ten (10) days after such publication (the “First
Publication Date”). With respect to any Work that The Times has not published, you agree that you will not exercise any of your
rights under paragraph 4 above until twenty-four (24) hours following the First Publication Date of another image from that
assignment.
6. Notwithstanding that The Times and you own a joint copyright in the Work, neither party shall have any obligation to share
revenues generated from its exercise of the foregoing rights, except that The Times will pay you fifty percent (50%) of the gross
receipts received by The Times from the syndication of the Work. The Work is "syndicated" when it is sold individually, and not as
part of the Newspaper or along with other works published in the Newspaper, to a third party, for republication in any form. Thus, for
example, the inclusion of the Work in The New York Times News Service is not a syndication for which compensation would be owed
under this paragraph.
7. You agree that with regard to any assignment you carry out for The Times, you will take care to avoid conflicts of interest or
the appearance of conflict, and you will otherwise comply, to the greatest degree possible, with the applicable provisions of the
policies on Ethical Journalism set forth at http://www.nytco.com/pdf/NYT_Ethical_Journalism_0904.pdf. For example, in connection
with any assignment for The Times, you will not accept free transportation, gifts, junkets, or commissions. Prior to accepting an
assignment, you agree to disclose to The Times any financial interest you have in the subject matter of that assignment.
8. You represent and warrant that you will not sign or otherwise be a party to any agreement, release, waiver or other document
relating to the Work as a condition to shooting an assignment. You further represent and warrant that you are entitled to grant to The
Times the foregoing rights in and to all Work submitted to The Times and that the Work will be original and unaltered and that it will
not infringe another's copyright or trademark, violate any person's right of privacy or contain libelous or otherwise unlawful material.

Standard Agreement

You agree to cooperate fully with The Times in responding to and defending against any third-party claims relating to the Work. Your
obligations under this paragraph and paragraph 7 will survive any termination of this agreement.
9. You are an independent contractor, and as such you do not receive any benefits as an employee of The Times. The Times
will provide you with IRS form 1099 at the end of the year reflecting all amounts paid to you for that year.
10. This letter constitutes the entire agreement between you and The Times regarding your freelance photography services from
this date forward, and supersedes all prior agreements on this subject matter. Either party may terminate this agreement upon thirty
(30) days written notice to the other. No amendment or waiver shall be valid unless in writing and signed by both you and The Times.
11. This agreement has been made in accordance with New York State laws and will be construed and enforced under those laws.
Any action to enforce this agreement shall be brought exclusively in the federal or state courts in the City of New York.

When confronted, this person got very angry and upset, repeatedly refused to pay, denied any wrong-doing (repeatedly cited her status as an authority in copyright law, I assume to claim immunity from violating copyright), insulted my photography, intimidated the student who submitted the photos to the point of hysteria and tears via phone and / or email, and threatened me with libel in the form of featuring a negative story about my photography business in the school paper and school magazine.

The invoices are still unpaid to this day. They were probably discarded immediately.

To be fair, I was stupid and didn't register my copyrights quickly enough, and so legal counsel advised me to not pursue things any further. Additionally, I was concerned about the student, since I did not want his grades or concentration to suffer.

I realize this situation is very specific, so I probably won't stay anonymous for long, but holy cow was that a frustrating experience!

Good luck trying to get any other expenses covered.It should be noted that sometimes they can be okay to work with. If it's an easy job and you have good information it can be just barely worth your time.

More often than not they have expectations that are unreasonable (want a lit portrait but don't want to pay for light rental?) and don't pay enough for the headache. ($400 is not the best day rate! I don't know how you would stay in business unless you shot for them every day).

I have been sent to a location to a shoot without the story, and then was emailed the story in the middle of the shoot (while I cannot check email), and then have gotten criticized for not shooting to the story.
Up to 3 monthsYou rarely (if ever) get paid on time. Jack Antwerp, the DOP doesn't seem to give a shit about paying the photogs on time, you only get paid when you borderlines harass the team to get paid.

They will charge Real Estate agents and homeowners a fair price of around 200 euros per case.
The photographer however will only receive 50 euros out of that.

The photographer has to run as an independent company(so they don't have to pay absence of leave and so on).

The photographer needs to have high end only photographic equipment(full frame body, top of the line lenses, speedlites etc). Must bring all equipment for free.

The photographer must own a car and make it available for free, mileage are in general not covered. Only in certain rare cases.

The salary of 50 euros is what a employed photographer(without bringing car and equipment) and normal benefits would be paid in these countries. So this is an extreme case of underpaying photographers!

They are well known in the photographic community for this way of doing business.

The business model is to contact young girls they find in model communities and others. Sometimes they will contact girls under the name "Peer Mikkelsen".
The message will always claim that they have noticed this particular girl and want her to participate in Queen of Scandinavia.
They will claim connections to various inter nation beaty contests.
What they actually want her to do is pay up 40 euros to participate in a casting. They are promised to get 2-4 photos and a goodie bag with a value of 40 euros.
The photos are real, but the goodie bag will never show up.

And here comes the part that relates to photographers:
Usually they will lure photographers into working 6 hours or more for free making various "all profit goes to…" claims. In one case they paid the photographer 200 euros for 6 hours of constant photographing hundreds of girls, no extra payment for post processing photos afterwards.

The girls will actually get the photos(just fast snapshots, no time is spend on each model) through Dropbox, so that part is true at the least.
