tmThe US DoJ on Friday filed a revised proposed remedy for Apple in the ebook case. Apple was found guilty in July of conspiring with publishers to set ebook prices. The DoJ still wants Apple to drop in-app purchasing restrictions for competitors as well as restrict publishers from using agency pricing for five years. The new proposal reduces the injunction term from 10 years to 5, staggers negotiation with publishers and asks for an external monitor. The DoJ includes a 2010 email from Steve Jobs as further evidence Apple instituted in-app purchasing restrictions as retaliation against Amazon. http://gigaom.com/2013/08/23/in-ebook-case-doj-claims-apple-is-lying-about-how-in-app-purchasing-works/

slPandora Plans To Lift Its 40-Hour Free Mobile Listening Cap On Sept. 1http://techcrunch.com/2013/08/22/pandora-lifting-free-cap/

.

- earnings call yesterday, Pandora executives said that they would lift the 40-hour monthly cap on free mobile listening that was announced back in February.
- second time Pandora has instituted a free cap and then lifted it again — it last lifted the cap in September 2011.
- 2 reasons: the cap was a “blunt tool” for limiting usage and costs, & the company has developed techniques like skip limits that control costs without affecting the listener experience much. The advertising business is also better, & Pandora can now “monetize those hours from 41 onward at a much higher rate.”
- when the mobile cap was reinstituted, usage dropped 10 percent
- revenue up 58 percent year-over-year. The company predicts that it will be profitable for the full year.
q: how much does this have to do with upcoming iTunes Radio (no cap expected)?

Liberation Music sent takedown to YT @ 2010 Lawrence Lessig lecture called "Open" posted in June 2013
- Open used clips of song "Lisztomania" by Phoenix
- Lessig and EFF suing Liberation for violating DMCA with overly aggressive takedown.
- he used a small proportion of the song, his lecture doesn't compete with the market for the song in any way, and his lecture is an entirely new creation.
- 512(f), the section of the DMCA that requires copyright owners to pay damages when they go too far in issuing a takedown.
- Lenz v. Universal "dancing baby" lawsuit. That case, filed in 2007, is just now lumbering towards an appeal court. Universal backed down quickly on this. Liberation threatened to sue of Lessig reposted.

In episode #380 you mentioned a possible future where your encrypted files are held on a cloud that is distributed amongst many strangers. There are two platforms that are/were doing something this exact thing: Freenet and Wuala. Wuala is a Cloud Storage similar to Dropbox that encrypted your files before sending them off, and used to allow you to offer some of your hard drive space to Wuala. They would then store the encrypted files on multiple HDDs so that it would always be available to the user who uploaded it. Freenet is a similar technology, storing encrypted files on multiple computers. Nobody can get at the files on their computer, but it's always available when you want the file. This concept is being played with right now, and while not perfected, is a promising concept.

Hey guys love the show. On your story about Yahoo having the most traffic on the web in July you did not mention that Yahoo was expiring usernames unless people logged into Yahoo. They also opened up the expired usernames for the taking in July. I would think the expiring usernames would have caused the web traffic with be higher then usual, but the numbers for August will tell if it was only temporary.

The Inquirer article talking about the usernames are now up for grabs:
