tmAn EFF Freedom of Information Act request has declassified a US Foreign Intelligence Surveillance Court decision that declared some NSA data collection unconstitutional. The 85-page October 3, 2011 opinion by FISC judge John D. Bates rules the NSA exceeded its authority in collecting upstream Internet data. Bates noted this was the third time the government misled the court in what data was being collected. The Washington Post reports the NSA put in a filter in response, and destroyed the previously collected information. The Director of National Intelligence has also launched a Tumblr at icontherecord.tumblr.com declassifying more documents.http://www.washingtonpost.com/world/national-security/nsa-gathered-thousands-of-americans-e-mails-before-court-struck-down-program/2013/08/21/146ba4b6-0a90-11e3-b87c-476db8ac34cd_story.html

Opinion: Oct 3, 2011 Chief Judge John D. Bates FISC
- EFF requested under FOIA. 1st time granted
- Tapped fiber optic cables coming into US. NSA brought the collection method to court's attention (3 years later)
- entire internet transactions, including strings of email some of which did not involve the target
“The court is troubled that the government’s revelations regarding NSA’s acquisition of Internet transactions mark the third instance in less than three years in which the government has disclosed a substantial misrepresentation regarding the scope of a major collection program,”
- Technical fix and retention dropped from 5 to 2 years.
- April 2012, purged all data collected since 2008 section 702 inception
- Bates expresses frustration over the fact that he cannot get independent verification of what the NSA says.
“Contrary to the government’s repeated assurances, NSA had been routinely running queries of the metadata using querying terms that did not meet the required standard. . . . The Court concluded that this requirement had been ‘so frequently and systematically violated that it can fairly be said that this critical element of the overall . . . regime has never functioned effectively.’ ”
-In other words, you have proven NSA, that you can't be trusted to supervise yourself.
- WSJ report says telecom sources say this has been going on for more than a decade. 2002 SLC Olympics

Ubuntu Edge -- failure was inevitable http://www.zdnet.com/ubuntu-edge-failure-was-inevitable-7000019727/

.

- The Ubuntu Edge IGG campaign didn't make its goal of $32M
- Canonical did raise $12.8M, but since Canonical did not make its goal, backers will be refunded their money within five working days
- Mark Shuttleworth penned an update to backers proclaiming "the big winner form this campaingn is Ubuntu" and that "Thousands of you clearly want to own an Ubuntu phone and believe in our vision of convergence, and rest assured you won’t have much longer to wait."
- Shuttleworth says they will be contacting its biggest referrers personally
- He says that crowdfunding is a great way to give consumers voice and they might try it all over again
- The Edge would have had some crazy specs with dual booting Android and Ubuntu Mobile with a desktop component
An article over at ZDNet by Matt Baxter-Reynolds said that the Ubuntu Edge's failure was inevitable saying
- "The Ubuntu Edge looks to solve a problem which doesn't seem to exist -- namely that what people want is a tiny, powerful PC that they carry around with them."
- "When docked the device isn't a good phone or smartphone"
- Baxter-Reynolds said the naming was weak and that the marriage of a phone to a computer is really a hybrid, not a convergence device. He says the Edge was "always a solution looking for a problem"

Q: Was the Edge doomed to fail from the beginning?

Hey TnT crew.

Just wanted to comment about today's show when you talked about Netflix my list addition. I actually enjoy the change because when you go to the app or website there is no way to easily get a list of all your favorite shows like you would when browsing on the Apple TV.

If I have my favorite show that I'm watching currently and it is not on the top of the list, it's harder to get to, but hopefully with the my list update all my currently watched shows will show up on the front page and I don't have to browse around.

Also, Tom mentioned he didn't use the queue at all, but those of us with kids will tell you it is a major help because you don't have to help them search every time for a show, all the shows you allow them to watch can be in one place. Thanks guys!

Kyle from Jacksonville, FL
