This letter confirms our agreement pursuant to which you have retained Absolute Video & Multimedia and its employees and agents ("AV") to perform and AV has agreed to perform certain project management, video, web, design, & multimedia (“services”) under the terms and conditions set forth in this agreement. The purpose of the Agreement  is for AV to perform certain services and consult with you to assist you with formulating and/or implementing your requests.

Unless you request otherwise in writing, AV shall bill you upon job completion and/or monthly.  Upon request, AV will provide you with a description of the tasks performed and hours worked. AV’s bills will be sent to your attention. Our rates for (“services”) performed in the United States range from $65 to $250 per hour depending upon the task required and the background and experience of the personnel utilized. You are expected to remit payment to AV within ten (10) days after an invoice is received by you. AV reserves the right to assess a service charge on any invoice outstanding beyond thirty (30) days.  AV accepts cash, check, paypal, ACH, online payments, and all major credit cards. If a bill remains outstanding for more than thirty (30) days, AV reserves the right to stop all work. If AV must engage counsel or otherwise expend funds to collect bills over sixty (60) days old, Client agrees to reimburse AV for all associated fees, costs, & interest on the balance.

AV requires a retainer fee in the amount of 50% of the budget listed. We will apply this retainer fee at our customary rates depending on the personnel assigned to this project to our final billing. Either party may terminate the Agreement upon thirty (30) days written notice to the other. Termination shall become effective thirty (30) days following the date any such notice is received by the other party. In the event of such a termination, Client agrees to pay and reimburse AV, pursuant to the terms set forth in this Agreement for all fees, costs, disbursements accrued or incurred as of the effective date of the termination. This Agreement may be executed in one or more counterparts, all of which together shall constitute one and the same Agreement and each of which shall be an original. Your signature below on the indicated enclosed copy of this letter is your representation that you are authorized to enter into the Agreement and to agree to the terms of this Agreement on behalf of your organization. This Agreement shall be binding on all parties and their respective heirs, successors and assigns.

Please execute and return the indicated enclosed copy of this Agreement with a retainer check or pay online at www.absolutevideo.com. If a fully executed copy of this Agreement and payment is not returned to AV within fifteen (15) days of the date of this letter, AV reserves the right to cease all work immediately. In that case, AV shall be entitled to payment for all fees associated with and out-of-pocket expenses incurred in connection with AV performance of the Agreement up to and including the date work ceases, plus interest to and including the date AV receives payment and any applicable taxes.
