The IHE International Patent Disclosure Policy is defined in the IHE Principles of Governance, Appendix A, section A.3. Under the procedure for implementing this policy, patent holders having potential Necessary Patent Claims are requested to complete letters of assurance describing such claims and the Submitter's licensing position with respect to them. IHE member organizations wishing to disclose potential Necessary Patent Claims are request to have the individual within the organization having authority for intellectual property rights management complete, sign and submit this Letter of Assurance
The assurance is irrevocable once submitted and accepted and shall apply, at a minimum, from the date of the Technical Document's approval to the date of the Technical Document's withdrawal. Note: Nothing in this Letter of Assurance shall be interpreted as giving rise to a duty on the part of the Submitter to conduct a search of its patent portfolio. IHE International takes no position with respect to the validity or necessity of Patent Claims or the reasonableness of rates, terms, and conditions, if any, provided in connection with submission of a Letter of Assurance or in any license agreements offered by the Submitter.
