  • King-Chavez has developed a comprehensive workplace violence prevention plan (plan). You may access a copy of the plan at any time and at no cost through the King-Chavez website, emailing Luis Tovar or Brian Sheehy, or accessing it via Google Docs.
  • This training is interactive, allowing you to engage and ask questions about any aspect of the King-Chavez plan.
  • Copies of the training materials will be retained and available for inspection for at least one year from today’s date.

Plan Responsibilities

  • CEO Cindy Kelley is responsible for the overall development and implementation of all aspects of the plan, including approval and changes to the plan.
  • Chief Administrative Officer Laura May is responsible for receiving employee input on the plan, receiving reports of workplace violence incidents, and investigation of incidents.
  • Director of Operations Luis Tovar is responsible for workplace violence hazard identification and mitigation.

Employee Contributions to the Plan

  • Employees are strongly encouraged to participate in identifying and mitigating hazards related to workplace violence, offering suggestions for revising this training, and providing feedback on incident reporting methods by:
    • completing the Hazard Identification Form, communicating during staff meetings, and contacting their site administrator and/or the Director of Operations

Key Definitions in the Plan

  • Emergency: Unanticipated circumstances that can be life threatening or pose a risk of significant injuries to employees or other persons.
  • Engineering controls: An aspect of the built space or device that removes a hazard from the workplace or creates a barrier between the employee and the hazard. 
  • Log: The violent incident log required by Labor Code section 6401.9.
  • Plan: The workplace violence prevention plan required by Labor Code section 6401.9.

Key Definitions in the Plan, Cont. 

  • Serious injury or illness: Any injury or illness occurring in a place of employment or in connection with any employment that requires in-patient hospitalization for anything other than medical observation or diagnostic testing, or in which an employee suffers an amputation, the loss of an eye, or any serious degree of permanent disfigurement, but does not include any injury, illness, or death caused by an accident on a public street or highway, unless the accident occurred in a construction zone.
  • Work practice controls: Procedures and rules which are used to effectively reduce workplace violence hazards.

Workplace Violence Defined

  • Workplace violence: Any act of violence or threat of violence that occurs in the workplace that includes, but is not limited, to:
    • Threat or use of force against an employee that results in, or has a high likelihood of resulting in, an injury, psychological trauma or stress, regardless of whether the employee sustains an injury.
    • An incident involving a threat or use of a firearm or other dangerous weapon, including the use of common objects as weapons, regardless of whether the employee sustains an injury.

Workplace Violence Defined, Cont.

  • Workplace violence does not include lawful acts of self-defense or defense of others.
  • Threat of violence: Any verbal or written statement, including, but not limited to: texts, electronic messages, social media messages, or other online posts, or any behavioral or physical conduct, that conveys an intent, or that is reasonably perceived to convey an intent, to cause physical harm or to place someone in fear of physical harm, and that serves no legitimate purpose.

Types Of Workplace Violence

  • Type 1 violence: Workplace violence committed by a person with no legitimate business reason to be at the worksite and includes violent acts by anyone who enters the workplace or approaches employees with the intent to commit a crime.
  • Type 2 violence: Workplace violence directed at employees by customers, clients, patients, students, inmates, or visitors. 
  • Type 3 violence: Workplace violence against an employee by a present or former employee, supervisor, or manager. 
  • Type 4 violence: Workplace violence committed in the workplace by a person who does not work there but has, or is known to have, a personal relationship with an employee.

Inspections

  • We conducted an inspection of the workplace for hazards prior to creating this plan.
  • We will inspect the workplace for hazards:
    • After any workplace violence incident.
    • When we are made aware of a new or previously unrecognized hazard.
  • We will also conduct periodic inspections quarterly. Director of Operations Luis Tovar shall conduct the inspections. Employees are encouraged to report and discuss any workplace violence hazards with their site administrator.

Hazards Assessment

  • We use inspections to find risk factors of workplace violence at our worksites.
  • Our assessments include:
    • Exterior and interior inspection for access and attractiveness to robbery;
    • Opportunities for interaction with the public and visitor procedures;
    • Effectiveness of access management security systems.

Current Hazards Identification

Community

None at this time.

KCAE

The campus is more secure now that the first phase of construction is complete.

KCCHS

The building is newly refurbished. No identified hazards at this time.

CNO

There are times when there are a number of people present at the community center. However, access to the CNO offices is managed effectively. There is a need to fix the steps to the main house.

Current Hazards Mitigation

  • We have taken the following mitigation steps to address the hazards identified in our plan
    • Exploring the installation of “panic buttons.”
    • Coordinating with after-hours contractors to improve security procedures and limit the appeal/ opportunities for theft
    • Post updated emergency contact information for police, fire, and internal contacts.
    • Revise emergency procedures

Strategies to Avoid Harm

  • Effective workplace violence prevention utilizes strategies to avoid violence and physical harm. These include:
    • How to recognize the risk factors associated with the four violence types
    • Conflict de-escalation in hostile or threatening situations, including workplace bullying.
    • How to seek assistance to prevent or respond to violence
    • Strategies to avoid physical harm

Future Hazards Correction

  • If we find a new or previously unknown hazard that needs to be addressed, we will do so in a way appropriate for the type of hazard.
  • Depending on how we address the hazard we may also:
    • Inform you of new corrective measures and/or work procedures related to the hazard.
    • Train or retrain you on workplace violence procedures.
    • Bring services onsite or procure equipment to address and correct the hazard.

Workplace Violence Reporting

  • All threats or acts of workplace violence as defined must be reported to the site administrator in person or via email or phone call.
  • Other procedures for reporting incidents, threats, hazards and concerns of workplace violence include going through the Uniform Complaint Policy or anonymously via Google Forms
  • No employee will be retaliated against for reporting threats or acts of workplace violence.

Emergency Response Procedures

  • When we learn of an active workplace violence emergency, we will initiate a special set of procedures.
  • We will inform all affected employes of the active emergency by PA, audible/visual alarms, and electronic communications such as emails, phone calls or text messages.
  • In an emergency, follow our evacuation and/or sheltering plan:
    • Please see the School Safety Plan for each site
  • If you are experiencing the emergency, dial 911 first, then report the emergency to Chief Administrative Officer Laura May or CEO Cindy Kelley, if possible.

Post-Incident Response and Investigation

  • We will investigate all reports of threats or acts of violence. Investigations will include: 
    • Visiting the scene of the incident; 
    • Interviewing involved parties and any other relevant people, such as witnesses, security, or law enforcement; 
    • Taking written statements via the Workplace Violence Incident Log;
    • Reviewing any available video footage and access logs; 
    • Examining the workplace for risk factors associated with the incident; and  
    • Obtaining law enforcement reports, if appropriate.

Post-Incident Response and Investigation, Cont.

  • After the investigation:
    • Investigator(s) will determine the likely cause of the incident.
    • Corrective action consistent with the plan will occur.
    • The Workplace Violence Incident Log will be completed.
    • We will provide support that may include counseling services and/or an employee assistance program.
    • We will review the plan and make changes as appropriate with input from employees.

Workplace Violence Incident Log

  • Any threat or act of violence will be recorded in the Workplace Violence Incident Log. This log will record the following information: 
    • The date, time, and location of the incident;
    • The type(s) of violence involved; 
    • A detailed description of the incident; 
    • A classification of the individual(s) who committed the violence; 
    • A classification of the circumstances at the time of the incident; 
    • The type of incident;
    • Consequences of the incident; and
    • Information about the person completing the log and date completed. 
  • No personal identifying information will be in the log.  
  • The logs are available for employee review upon request.

Employee Participation in the Plan

  • Prior to the plan’s creation, we solicited your input by sending out the Hazard Identification Form, reviewing Staff Survey results, and completing the Hazard Inspection Form for each site.  
  • You are encouraged to provide more information about potential hazards or mitigation efforts by completing the anonymous Google Forms version of the Hazard Identification Form, staff surveys, quarterly safety walkthroughs, and direct communication with the site administrator.
  • You are expected to comply completely with this plan, including following all its reporting and mitigation policies and procedures. 
  • You are also encouraged to provide input on this training to help ensure its effectiveness regarding your participation in and compliance with the plan.

Employee Compliance

  • An effective plan requires all employees to follow and participate in its policies and procedures.
  • This training is designed to give you the tools needed to participate in the plan.
  • If you are found to violate the plan, we may retrain and/or discipline you for the violations.
  • We also recognize employees who demonstrate safe work practices in compliance with the plan through providing certificates upon completion of training and recognizing effective practices in the quarterly safety reports developed by the Director of Operations.

Access to Records

  • We create and maintain all records in accordance with the plan.
  • Employees may request access to, and copies of, the following records related to the plan:
    • Records of workplace violence hazard identification, evaluation and correction.
    • Training records.
    • Workplace Violence Incident Logs.
  • Employees may request access to, and copies of, the records by contacting their site administrator or the Director of Operations in person, via email or via phone call.
