BACKGROUND

    • The Housing Inventory passed unanimously by the Board of Supervisors and was signed by Mayor in December of 2020 (Ordinance No. 265-20).

    • Section 37.15, "Reporting Obligations: Licensing," was added to the Rent Ordinance.

WHAT DID IT CHANGE?

PRIOR LAW

    • A landlord does not need permission from the Rent Board to impose an annual or banked rent increase.

NEW LAW

    • All property owners are now required to provide certain information to the Rent Board.
    • Landlords will receive a license allowing them to impose annual allowable and/or banked rent increases.

HOW DO I SUBMIT THE INFORMATION?

    • Rent Board Fee and Inventory Portal: portal.sfrb.org
      • Create an account
      • Add your property to your account
      • Submit units individually or multiple units at one time
      • License is always available to print or download

    • Alternative reporting options available for individuals unable to report on the Rent Board Portal.

    • The system will generate an license for each unit reported

as "Occupied by non-owner."

RENT INCREASE LICENSE

    • Only units reported as non-owner occupied will receive a rent increase license and will be eligible to impose annual allowable and/or banked rent increases
      • No penalties are assessed for reporting after the deadline

    • Rent controlled tenants may file a Tenant Summary Petition with the Rent Board if they have received a rent increase notice that goes into effect while the landlord is unlicensed.

    • Rent increases under Section 37.3(a)(1)-(2) to be effective while the landlord is unlicensed will render the entire rent increase null and void. (See Rent Board Rules and Regulations Section 13.14).

WHAT IS THE DIFFERENCE BETWEEN THE RENT BOARD FEE AND HOUSING INVENTORY REQUIREMENTS?

RENT BOARD FEE

    • The City and County of San Francisco imposes a per-unit fee payment system on owners of residential property to carry out the Rent Ordinance.
      • Failure to pay the Rent Board Fee does not impact the landlord's ability to increase the tenant's rent or obtain a rent increase license.

    • Requesting a Rent Board Fee exemption does not satisfy Rent Board Housing Inventory reporting requirements.

WHAT IS THE DIFFERENCE BETWEEN THE RENT BOARD FEE AND HOUSING INVENTORY REQUIREMENTS?

HOUSING INVENTORY REQUIREMENTS

    • Property owners must provide certain information to the Rent Board about their residential properties to receive a Rent Increase License to impose annual and or banked rent increase.
      • Failure to submit the information can impact the landlord's ability to increase the tenant's rent.

    • Reporting into the Rent Board Housing Inventory does not satisfy requesting an exemption of the Rent Board Fee.

OTHER CONSIDERATIONS

    • Tenants will have the option to report certain information into Housing Inventory themselves.

    • Most information reported into the Housing Inventory is public and non-confidential.

    • The Housing Inventory is not a rental "registry" as defined in State law.
