Areas of Success

  • 15 policies have been updated to comply with Title IX changes
  • B-Series policies will be reverted back to the June 2024 revisions to allow a smoother transition of information from the Administrative Policies to the Board (Policy Governance) Policies.
  • Policy updates are constantly evolving due to the changes being implemented at the federal level.
  • Further updates will continue to be presented to the Board of Education
  • The cell phone policy has been updated to reflect our current “away for the day” approach

Areas That Will Need Additional Attention

  • Federal changes have caused numerous changes in policy for the education sector, leading to multiple policies requiring updates and takes many staff hours to complete.
  • Continuous review of the B-Series Administrative Policies must be done to ensure any changes that impacting Title IX is addressed to uphold compliance
  • Many policies in addition to Title IX that will need to be addressed this year

Next Steps/Updates

  • Continue with ongoing policy updates in order of highest priority
  • Implement Special Policy Updates (SPUs) as they are released from the Colorado Association of School Boards (CASB)
  • Continue sharing updates with the Board on a regular cadence
  • Notify the Board President once A/B/C series policy updates are completed and ready to enter the approval process

Rationale:

To comply with reversion back to Title IX regulations of 2020. A series policies are to be approved by the Board of Education per policy GP-9 - Communication and Support to the Board

Changes Made:

Refined definitions for:

  • Bullying (linked to Policy JICDE & AC-R-1 if tied to protected class).
  • Harassment (differentiated for students, employees, community).
  • Sexual Orientation, Gender Identity/Expression, Race, Protective Hairstyle.
  • Supportive Measures (counseling, deadline extensions, grade remedies, schedule modifications, no-contact orders)

Other Changes:

  • Requirement to restore lost opportunities for complainants.
  • Clearer link between policy AC and implementing regulations.

AC-R-3 Sexual Harassment Investigation Procedures

Changes Made:

  • Revised definitions for key terms (Complainant, Respondent, Title IX Coordinator, Retaliation, Supportive Measures, Remedies).
  • Clarified jurisdiction of Title IX complaints (education program/activity and U.S. requirements).
  • Strengthened emphasis on equitable treatment of all parties.
  • Training requirements expanded: staff, students, Title IX Coordinators, Investigation Decision Makers, and facilitators all receive role-specific training
  • External reporting options clarified: Office of Civil Rights (OCR) (U.S. Dept. of Education) and Colorado Civil Rights Division (CCRD).

AC-R-2 Sexual Harassment Investigation Procedures - Students/Staff

How the District Maintains the Same Level of Protections:

  • Definitions are more specifically worded
  • Several additional definitions have been added providing more clarity and protection (i.e. formal complaint, Investigator, Retaliation and several others)
  • Other Title IX 2024 protections are covered in Equity and Discrimination race and religion provisions.
  • The “Grievance Procedure” is stricter and requires districts to use a three-person investigation model: (1) Title IX Coordinator, (2) Investigator, and (3) Decision-Maker
