IDEA and 504 have some fundamental similarities but significant differences.

The similarities are that they both have a team of professionals that work with the students school. The teams meet on an annual basis to make educational decisions.

IDEA- Purpose is to find, evaluate, verify and educate students with disabilities in the school district. Maps out a specific and formal process that provides federal protections for students and parents regarding evaluation procedures, and documentation of a diagnosed disability that has a direct and significant impact on the regular educational classroom. Procedural safeguards, and a variety of placement options in the least restrictive environment. IDEA also provides a formal due process system that parents can access if any disputes arise. Additional funding is available for school districts that have students that qualify for services under IDEA.

504- A broad civil rights law that focuses on individuals with disabilities.

Purpose is for schools to eliminate barriers that prevent the student from full participation in programs and services offered in the general school curriculum. 504 plans have a written plan that states that reasonable accommodations, supports and auxiliary aides are provided that allow the student to participate in the general curriculum.

Evaluation draws on information from a variety of sources in the area of concern. A group decision is made with persons knowledgeable about the student, evaluation data, and available educational placement options. Written consent is not necessary before completing an evaluation; however, notice must be provided to parent or guardian.

The student must receive a free and appropriate education with his/her non- disabled peers. Meeting is not required for a change of placement. Students are served in general education with or without modification.

Due processes hearings are before the Office of Civil Rights and compensatory damages are possible.

Descrimiation in schools is not allowed. This is includes students with disabilities. Section 504 of the Rehabilitation act of 1973 was created to stop descrimination of students with disabilities.

Definitions of students with disabilities is a defined in broad terms in Section 504

(3) is regarded as having such an impairment.

Disability. Under Section 504, an individual with a disability (also referred to as a student with a disability in the elementary and secondary education context) is defined as a person who:

(1) has a physical or mental impairment that substantially limits a major life activity;

(2) has a record of such an impairment; or

The determination of whether a student has a physical or mental impairment that substantially limits a major life activity (and therefore has a disability) must be made on a case by case basis. In addition, when determining if someone meets the definition of a disability, the definition must be understood to provide broad coverage of individuals.

Physical or mental impairments. Section 504 defines a physical or mental impairment as any • physiological disorder or condition, • cosmetic disfigurement, or • anatomical loss affecting one or more of the following body systems: neurological; musculoskeletal; special sense organs; respiratory, including speech organs; cardiovascular; reproductive; digestive; genito-urinary; hemic and lymphatic; skin; and endocrine.

Major life activities include certain acts a person does (such as hearing, speaking, lifting) and a person’s bodily functions (such as lung disease that affects a person’s respiratory system, or a traumatic brain injury that affects the function of the brain).
