Amendment and supplementation of certain articles of the Constitution focusing on regulations on the Vietnam Fatherland Front, socio-political organizations and the delimitation of administrative units and local government organizations.

The National Assembly established a Committee to draft amendments and supplements to certain articles of the 2013 Constitution.

Inspect the compliance with laws in the fields under the state management of ministries without a Ministry Inspectorate.

Inspect complicated cases involving state management responsibilities of multiple ministries, ministerial agencies and provincial People’s Committees.

Inspect the management and use of state capital and assets in enterprises.

Request ministries, ministerial agencies, Governmental agencies, provincial People’s Committees to appoint persons having professional expertise to join its inspection delegations when necessary.

The Politburo sets out tasks and solutions to promote the development of the private economy as follows:

Eliminate unnecessary business conditions; reduce at least 30% of the time to process administrative procedures, legal compliance costs and business conditions.

Abolish license fees and exemption from corporate income tax in the first 3 years of establishment for small and medium-sized enterprises.

Ensure that carry out inspections and examinations only once a year, unless there is clear evidence of violations.

Propose amendments to criminal, civil, criminal procedure, and civil procedure code so that violations and civil-economic cases are prioritized for the application of civil, economic, and administrative measures first.

Electronic commercial invoices are invoices used by organizations, enterprises or individuals (exporters) that export goods or provide services to foreign countries and meet conditions for transmitting data on electronic commercial invoices to tax authorities using electronic means.

Where an exporter fails to meet conditions for transmitting data on electronic commercial invoices to tax authorities using electronic means, the exporter shall use either electronic VAT invoices or electronic sales invoices.

The time of issue of an electronic commercial invoice, electronic VAT invoice or electronic sales invoice shall be determined by the seller provided that such an invoice must be issued no later than the working day following the day on which the goods are granted customs clearance.

Supplementing regulations on electronic commercial invoices as follows:

1. The following foreign indirect investment transactions in Viet Nam must be conducted through the opening and use of accounts:

Purchase and sale of securities on the Vietnamese stock market and purchase and sale of other valuable papers.
Capital contribution, share purchase, or equity purchase in unlisted enterprises are not subject to the requirement for opening a direct investment capital account.
Entrusted investment in VND through fund management companies and other organizations authorized to carry out entrusted investment.
Purchase and sale of other types of securities.

2. Foreign investors are permitted to open only one indirect investment account at a licensed bank, except for certain special cases such as where the investor is a securities company or a foreign fund/organization managed by multiple fund management companies.

“Accounts created and issued by the National Public Service Portal and Information Systems for handling administrative procedures at ministerial and provincial levels to agencies and organizations shall be used until the end of June 30^th, 2025”
