  • Confirm that the LEA student handbook includes the statement in English and Spanish for students receiving interventions that may need services.
    • Right to Information: TEA is required to provide school districts and charter schools a written statement of the options and requirements for providing assistance to students who have learning difficulties or who need, or may need, special education services (Texas Education Code §26.0081).
      • The statement must explain that a parent may request an evaluation for special education or Section 504 services at any time.
      • Parents must receive the statement in a written format every year.
      • A school may include the statement in the student handbook, or a school may disseminate the statement through other means such as a letter or newsletter to each parent and ensure that each parent receives a copy.

Failure to comply could be considered contract abandonment and could result in certification sanctions.

This committee is composed of a child’s parent(s) and specific school personnel involved in the child’s educational program. The ARD Committee determines eligibility to receive special education services and develops the individualized education program (IEP) for the child. This committee is the IEP team as defined in federal law.

  • ESY – Extended School Year; ESY provides IEP services for students with disabilities beyond the regular school year. The need for ESY services is determined on an individual basis by the child’s ARD committee using formal and/or informal data. To be eligible, data must indicate a loss or regression in critical skills that cannot be recouped in reasonable time.

  • PEIMS – Public Education Information Management System; encompasses all data requested and received by TEA about public education. Data includes student demographics, academic performance, personnel, financial, and organizational information.

  • Residential Facility Tracker (RFT) - This is an application in TEAL under the TSDS portal which districts use to report students receiving special education services who reside in residential facilities (RFs). School districts and charter schools are subject to the residential facilities monitoring system (RFM) if they serve students with disabilities who reside in residential facilities within their geographic boundaries or jurisdiction. The definition of an RF, for the purposes of the RFM system, is a facility that provides 24-hour custody or care of students who reside in the facility for: detention, treatment, foster care, or any non-educational purpose. This does not include traditional foster homes licensed by the Texas Department of Family and Protective Services as Foster Family Homes (Independent).

  • State Performance Plan (SPP) - Each state is required to develop a performance plan that evaluates the state's efforts to implement the requirements and purposes of the Individuals with Disabilities Education Act. This plan illustrates how the state will continuously improve upon implementation. School districts and charters are required to submit data for SPP indicators through TEAL.

  • Time and Effort (T&E) – The federal time-and-effort reporting requirement comes from Office of Management and Budget (OMB) Circular A-87, Attachment B, Section 8h. OMB A-87 requires employees who work on multiple activities or cost objectives to document their time and effort with monthly personnel activity reports (PARs) or through an approved "substitute system” of reporting.
