  • FAMLI was approved by voters in 2020 and ensures that Colorado workers have access to paid leave during life events that pull them away from work.
  • Both employers and employees contribute to the benefit fund. Self-employed individuals are also eligible to participate.
  • FAMLI provides workers 12 weeks of paid leave when they are…
    • Caring for a new child during the first year after birth, adoption, or foster care placement.
    • Caring for a family member with a serious health condition.
    • Caring for their own serious health condition.
    • Making arrangements for a family member’s military deployment.
    • Addressing the immediate safety needs and impact of domestic violence and/or sexual assault.

  • The Division of Unemployment Insurance (UI) helps people who have lost their jobs by providing temporary wage replacement.
  • Unemployment benefits are funded by employers and help workers pay their bills during job transitions and contribute to the economic stability of the state.

Rules & Regs: Upcoming Deadlines and Effective Dates

  • 2026 Employer Premium Rates - Now available in MyUI Employer+. Employers will also receive their annual Rate Notice in the mail in the coming weeks.
    • Each rate component is calculated and rounded to the nearest cent, using Generally Accepted Accounting Principles (GAAP). Individual rate component percentages are listed on the employer Rate Notice, and available in MyUI Employer+.
    • Please compute and round each rate component to calculate your total premiums owed each quarter.
  • 2026 Rate Protest Period ends Monday, December 15.
    • Legislatively-mandated rates, including the Support Rate and the Solvency Surcharge cannot be protested.
    • Rate Protest must be submitted online in MyUI Employer+.

Rules & Regs: Upcoming Deadlines and Effective Dates

  • 2026 Voluntary Premium Payments (VPP) - Employers may be eligible to submit a VPP to change their percent of excess, which may lower their UI rate.
    • VPPs are not a prepayment for premiums an employer will owe and cannot be refunded.
    • VPPs must be submitted online in MyUI Employer+ by Saturday, March 14, 2026. Paper checks are no longer accepted for VPPs.
  • Out of State Wage Credit Processing - The Division is currently reviewing wage credit requests submitted as of Q1 2025. Credits are only reviewed/approved if:
    • the adjusted wages were reported to CO within the last six quarters;
    • the credits are equal to or less than the state’s chargeable wage base;
    • the adjusted wages are verifiable within the Interstate Connection Network (ICON) system

Tech Updates

  • Employer Rate Notice Display Update - In-system employer rate notice and amended rate notice displays now show a full breakdown of the components used to calculate the employer's rate, including Support Rate allocations.

Employer Questions

  • When filing quarterly unemployment wage reports and using the previous quarter report for names and ssn; how are those names arranged? Can they be organized alphabetically?
    • Answer: Wage records copied from the previous quarter are sorted numerically by SSN. At this time, data cannot be sorted alphabetically. We are exploring options to expand data sorting functionality.
  • Is there a way to give employers more than 48 hours to answer claims?
    • Answer: By law, employers have seven days to respond to the Division’s initial request. If we do not receive a response in seven days, additional requests will be made via email and phone calls, and employers have two days to respond. Division of Workers’ Compensation

  • The role of the DOWC is that of an administrative conservator and regulator of the Colorado workers’ compensation system.
    • In other words, the DOWC’s job is to make sure that the system is operating correctly, all the stakeholders are following the rules to keep the system operating correctly, and to make adjustments to the rules when the system can be improved.
  • The DOWC’s five main external stakeholder groups are injured workers, employers, insurers, attorneys, and medical providers.
  • The DOWC and the insurance carrier are separate entities. The DOWC does not pay benefits.
  • The DOWC also facilitates the process for resolving disagreements between carriers and claimants.

Rules & Regs: Upcoming Deadlines and Effective Dates

  • January 1, 2026: DOWC Rule 18 takes effect.
    • All providers (excluding interpreters) submitting 25 or more workers’ compensation bills per month will be required to submit electronic medical bills. Likewise, all payers (excluding self-insured employers) must accept these electronic medical bills in a HIPAA-compliant 837 format. The DOWC hosted a webinar to discuss preparations for the 2026 E-Billing requirements.
  • January 1, 2028: HB25-1300, known as "Workers' Compensation Benefits Proof of Entitlement," takes effect.
    • This legislation will affect nearly all employers in Colorado. The DOWC just wrapped up “listening sessions” to discuss how to successfully implement the bill. If you have any questions or feedback, please email Education & Outreach at cdle_dowc_communications@state.co.us.

    • The DOWC is modernizing its claims management system with a new system called CoComp. CoComp aims to create an easy-to-use, transparent, and efficient system for workers' compensation activities in Colorado.

  • The Division of Oil & Public Safety (OPS) is responsible for a variety of regulatory functions related to environmental and consumer protection and public safety.
  • Program oversight includes:
    • Amusement rides and devices
    • Explosives use
    • Boilers
    • Conveyances (Elevators and Escalators)
    • Fuel products, including LPG, CNG, LNG and Hydrogen
    • Petroleum Storage Tanks and Cleanup of Petroleum releases
    • The Underground Damage Prevention Safety Commission has enforcement oversight for the one call law

Rules & Regs: Upcoming Deadlines and Effective Dates

  • The fees for the Amusement Rides & Devices program are changing.
    • Effective January 1, 2026: the operator fee will increase from $600 to $700 per operator, and the ride fee will increase from $180 to $220 per ride in accordance with the fee table in the Amusement Ride regulations and on the Application Information webpage.
  • Regulation updates are coming to the Boiler and Conveyance programs.
    • Updates become effective January 1, 2026, and those interested can learn more at https://ops.colorado.gov/ProposedRules.

  • New Colorado Minimum Wage effective January 1, 2026: The 2026 statewide minimum wage will be $15.16, up 2.36% from $14.81 in 2025. Local minimum wages are published on cdle.colorado.gov/dlss (also ColoradoLaborLaw.gov)
  • New / Amended Rules in effect January 1, 2026: The following seven sets of rule were adopted on November 10 and will be in effect on January 1.

What’s new in labor rights & responsibilities in 2025?

  • DLSS recently updated and renamed its Labor Law Guidance & Education webpage. This webpage includes multiple forms of published guidance for Colorado employers and employees:
    • INFOs: (Interpretive Notices and Formal Opinions) — the Division’s approved notices, opinions, and explanations on various labor law topics.
    • KNOWLEDGEs: (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) — one-page summaries for employees on their labor rights.
    • Labor Law Videos: As of November, 3 new short educational videos about Colorado labor laws, including “Wage Payment,” “Paid Sick Leave,” and “Vacation Pay at Separation,” with many more educational labor law videos coming soon.
