Legislative Issues

  • SLOs should remain current about federal, state and local legislation
  • SLOs do not report solely on legislative issues—that’s the primary responsibility of the LLO
  • SLOs also serving as LLOs need to send separate reports to the ANACO-–CC with copies to the BC-BDx and the DVC-BD LLO Issue auxman 4-14
  • SLOs are encouraged to attend regular meeting of the State boating advisory council and commissions as well as public meetings on boating issues.

Public Appearances

  • Auxiliarists may appear as private citizens at legislative hearings or political meetings without USCG approval
  • If appearing/testifying on a matter related to USCG or Auxiliary, the local DIRAUX and BSX must be given advance notice
  • If as a private citizen, Auxiliarists may not be in uniform, use their title, nor otherwise indicate USCG or Auxiliary affiliation

Legislative Hearings Regarding RBS

  • Auxiliarists may appear/testify in an official capacity
  • Only on matters related to RBS when determined to be in the best interests of DHS and the USCG
  • Normally limited to appearances before legislative bodies with jurisdiction over boating safety matters
  • When testimony will help educate legislators on factual matters

Processing and Approval of Requests for Official Testimony

  • Upon receipt of request, Auxiliarist notifies DCO via the SLLO
  • DCO shall expeditiously review, endorse and forward to DIRAUX. If a positive review, this will include recommendation of a knowledgeable Auxiliarist
  • The recommended Auxiliarist should be a resident of the state where testimony is to occur
  • DIRAUX will expeditiously consult with RBSS and District Staff Legal Officer to see if testifying relates strictly to RBS and whether it is in the best interest of DHS and USCG.

Processing and Approval of Requests for Official Testimony (2)

To assist parties in making informed determinations, the following will be consulted:

  • Does this lead to improved knowledge, safety skills, and operating environment for recreational boating
  • Does it impact other regional matters concerning USCG or other department by the person holding the hearing
  • If time is of the essence, DIRAUX may contact the District Duty Legal Officer for timely determination

Processing and Approval of Requests for Official Testimony (3)

  • RBSS shall inform the Boating Safety Division
  • RBSS shall assist the SLLO in preparing the Auxiliarist for giving testimony
  • In all circumstances DIRAUX shall obtain prior approval from the District Commander after obtaining concurrence by the District Legal Officer or the duty attorney if after working hours

Public Appearances: After Action

  • Testifying Auxiliarist will provide:
    • A complete copy of their testimony
    • All questions discussed
    • Associated responses made during their appearance
  • Written report shall be made to:
    • Their DCO
    • Auxiliary SLLO
    • DIRAUX
    • DIRAUX will provide a copy to CG-54222 (Commandant)

  • No opinions, conjecture or speculation whether requested or not
  • Refrain from addressing questions or requests for commentary on:
    • Federal legislative change proposals
    • Federal Homeland Security missions and activities
    • Budgetary or resource proposals
    • Non-RBS missions, activities, or legislative initiatives
