II. CURRENT EPR SYSTEM IN VIETNAM

Subjects, pathways of package recycle

1. WASTE RECYCLE RESPONSIBILITY OF PRODUCER, EXPORTER

Fulfill the responsibilities according to the Obligatory recycling rate, mandatory recycling specifications

• Recycle (Self-recycle; Hire recyclers; Assign PRO)OR
• Financial contribution to recycling: F = R x V x Fs

Objects and time of performing the responsibility �of waste collection and treatment

EXCLUDING:

• Producers and importers of products and packages for export or temporary import for re-export or production or import for research, study or testing purposes.
• Packaging manufacturers whose revenue from sales and service provision in the previous year is less than VND 30 billion;
• Importers of packaging with a total import value (calculated by customs value) of less than VND 20 billion in the previous year.

• EPR affects the beginning and the end of the collection and recycling chain:
• Beginning: manufacturer, importer
• End: recycler
• EPR does not directly regulate collection (does not regulate collection operations)
• Regulations on obligatory recycling rates:
• Forcing manufacturers to participate directly in recycling, increasing demand for recycling, increasing demand for recycled materials (increasing collection demand)
• The scale and nature of the processing will increase and follow the direction of modern industry
• Regulations on mandatory recycling:
• Forced recycling in a certain form: increased requirements for the quality of the collected material (collection must be clean)
• The scale and nature of collection will increase, automate and modernize
• Support for collection, recycling and treatment activities:
• Funding for sorting, collection, recycling and treatment activities

III. EPR IMPACTS TO COLLECTION, REYCLE AND TREATMENT

IV. CHALLENGES

• Although EPR has been around for a long time, it is voluntary, the mandatory EPR system is new, so it is still awkward in implementation (from the business side and from the government side).
• Enterprise: who has to do, what to do, how to do it?
• State: establish organization, coordinate control?
• The habit of sorting waste at the source is still low, in fact there is none
• Weak collection system
• Waste management has been around since the Law on Environmental Protection 1993 but so far has not made a clear change, mainly concentrated collection and not classified, mainly buried without recycling.
• Regulations on solid waste management under the Law on Environmental Protection 2020, which have been prescribed in a modern and appropriate direction (collection of collection and treatment services based on volume), have been issued in Decree 08/2022/ND-CP and Circular 02/2022/TT - The BTNMT regulations are implemented but still new,
• Detailed technical instructions are required
• Funding is needed to restructure URENCO, it takes time
• Collection infrastructure is still weak and backward; mainly rely on scraps
• The recycling system is still outdated on a small scale, most of them are craft villages

V. FUTURE REQUIREMENTS

• It is necessary to implement waste separation at source, collect fees by volume, the determination of the provincial level
• Need to promote PPP cooperation on local solid waste management
• EPR will support local implementation of PPP
• There must be an inter-provincial and inter-regional plan on collection and recycling
• Streaming collection, modernizing and automating collection
• Highly specialized recycling according to regional advantages, large industrial scale
• There must be guidance on classification, collection and sanctions for each type of packaging product to ensure its effectiveness
• Active participation of parties to carry out sorting, collection, recycling and treatment activities to receive support from EPR
