SITUATION + wHAT’S AT STAKE

  • 3 Democratic retention elections to protect the Democratic majority on the court.
  • Losing all three seats would create a 2D-2R deadlocked court.
  • Losing any seats will put Dems in jeopardy of losing the majority in 2027 and 2029, and require additional expensive special elections in 2027.

Republican spending is Accelerating & Retention race is heating up

  • Over the past two weeks, a flurry of Republican spending has begun, all being carried out by groups funded by Tik-Tok billionaire, Jeff Yass

  • Yass groups are flooding the zone with direct mail (up to 7 pieces sent so far)

  • RSLC continues to spend on digital, and are being joined by Yass groups

  • Citizens for Term Limits is on air in Philadelphia and Pittsburgh with a Vote No ad (expect expansion to Harrisburg, Erie and Scranton MMs soon

20 of 41

Their attacks

  • Yass mail is being delivered on two tracks:

    • Commonwealth Partners is sending deceptive mail to Democrats on retention to prevent Dem consolidation
    • Commonwealth Leaders Fund is targeted to Republican voters to mobilize

  • At least 7 pieces dropped statewide in last two weeks. Paired with heavy META investment and texting program to Dem voters

  • Only 2 pieces dropped on the Democratic side so far (ACLU & PJF)

Commonwealth Partners Flight

Commonwealth Leaders Fund Flight

21 of 41

Their attacks

  • Citizens for Term Limits (CfTL), another Yass organization, is carrying the Vote No message on TV
    • Definitely trying to pick up Democratic voters with current messaging

  • CfTL is now on air with “Vote No, No, No” in the Philly & Pittsburgh MMs

  • Dems maintain a lead in total TV funding, with a two week head start on CfTL, but Yass has been steadily ramping up buys and advantage may not last long

  • Prevent undervoting - stem the roll-off
  • Help partners to scale relational programs that empower their base/leaders

Long-term:

  • Improve contact rates versus traditional paid voter contact programs
  • Build up trusted messengers in a society with fewer and fewer trusted institutions
  • Create (or recreate) durable political power

25 of 41

Fund the field: Neighborhood captains

  • Anchored by Working Families Party
  • 17 PARTNERS ACROSS 22 COUNTIES
  • 985 Captains recruited – 600 of them are trained and knocking doors
  • On Election Day, onboarded captains will become poll greeters, reducing ballot roll-off in 500+ priority precincts.
