SLAPP is an abusive lawsuit filed by a private party with the purpose of silencing critical speech

  • There is a power and financial imbalance between the parties;
  • The arguments relied upon are legally or factually baseless
  • The lawsuit appears to be part of a wider campaign to bully, harass, or intimidate the defendant;
  • The plaintiff engages in procedural manoeuvres designed to drive up costs
  • Winning the case is not the primary aim
