It is a stunning scene that captivates the attention of the viewer, evokes empathy for the combatants, and sparks curiosity in the subject matter.

  • But there are consequences to copyright violations.

Houston School District Ordered To Pay $9.2 Million In Copyright Infringement Case

Following the verdict, the school district issued a statement noting that all of its employees would participate in online copyright training each year.

This case is an extreme example, but there can be consequences. I highly advise you to follow Teacher Pay Teachers copyright laws, and not cover up copyright markings!

  • Another consequence of violating copyright laws in the classroom is that we are modelling unethical and illegal behavior to our students.

  • “Copyright is a type of intellectual property that protects original works of authorship as soon as an author fixes the work in a tangible form of expression.”
    • It is the protection of the original intellectual property of copyright holders that we often think about, all the things we can’t do like:
      • Reproduction, distribution, derivatives, public display, etc.
    • However, know the laws also protect copyright users from limitless restrictions, and we have rights to use these materials:
      • Fair Use, the “first sale doctrine,” some reproductions by libraries and archives, etc.

So what is Copyright all about???

  • “Copyright is a type of intellectual property that protects original works of authorship as soon as an author fixes the work in a tangible form of expression.”
    • Fixed meaning, the second you originally create something tangible, it is automatically protected under US copyright law.
    • Meaning…whether you know it or not, all of you are copyright holders! Look at the pics on your phone, those are protected by law! Congrats!

So what is “Fair Use” all about???

  • 107. Limitations on exclusive rights: Fair Use
  • Fair Use of a copyrighted work… for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include—

​

  • (1) the PURPOSE and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
  • (2) the NATURE of the copyrighted work (nonfiction vs fiction);
  • (3) the AMOUNT and substantiality of the portion used in relation to the copyrighted work as a whole;
  • (4) the EFFECT of the use upon the potential market for or value of the copyrighted work.

  • The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

So what is Public Domain all about???

  • Public Domain are materials that not protected by copyright laws due to never being eligible or having their copyrights expired.
  • Meaning they are safe* to use, but how do you know what’s in the public domain? It’s complicated…
  • Depends on when created, format, publication, notice…see here
    • Everything* published in the US prior to 1928 is public domain
    • It gets murky from 1922 - 1989: in, out, 120 years from creation, 95 years after publication, and other craziness
    • After 1989, protected for 70 years from date of author’s death
