What is Investor-State Dispute Settlement (ISDS)?

The key provision in NAFTA grants rights to thousands of multinational corporations to sue the U.S. government before a tribunal of three corporate lawyers.

These lawyers can award corporations unlimited sums to be paid by U.S. taxpayers, including for the loss of expected future profits.

These multinational corporations need only convince the lawyers that a U.S. law or safety regulation violates their NAFTA rights.

Their decisions are not subject to appeal and the amount awarded has no limit.

3. Present and table at NAFTA at local meetings

  • Ask if you can present or table at local meetings.

4. Meet with your Member of Congress

  • Email Nikki at nchiappa@replacenafta.org with “I’d like to schedule a meeting with my Member of Congress!”
  • Call your Representative’s local office and ask to schedule a meeting.
  • Find faith, labor, environmental, and other civic leaders to attend the meeting with you. Invite other constituents.
  • Prepare for the meeting by role-playing.
  • Ask: Your Member of Congress to commit to vote “no” on any trade agreement that includes ISDS.
