  • EBHS is a CLOSED CAMPUS throughout the school day.
  • All gates will be locked at the beginning of first period.
  • Late students must enter through the Attendance Office.
  • Students must show ID when entering after first period.
  • Students may not leave campus during the school day due to health and safety.

Skateboards, Bikes, Scooters

  • All skateboards, bikes, scooters must be locked in the area next to the administrative building.
    • The area will be locked until the end of the school day.
    • Students must provide their own locks.
    • Students are not allowed to ride skateboards, bikes, and scooters on campus.
    • Students who violate this rule will have their skateboard, bike, or scooter confiscated and brought to the dean’s office to pick up at the end of school day.

DISCRIMINATION AND THE LAW

California Education Code 220 states “No person shall be subjected to discrimination on the basis of disability, gender, gender identity, gender expression, nationality, race or ethnicity, religion, sexual orientation…, including immigration status, in any program or activity conducted by an educational institution that receives, or benefits from, state financial assistance, or enrolls pupils who receive state student financial aid.”

Kern High School District BP 5145.3 states “Unlawful discrimination, including discriminatory harassmentintimidation, or bullying, may result from physical, verbal, nonverbal, or written conduct based on any of the categories listed above.  Unlawful discrimination also occurs when prohibited conduct is so severe, persistent, or pervasive that it affects a student's ability to participate in or benefit from an educational program or activity; creates an intimidating, threatening, hostile, or offensive educational environment; has the effect of substantially or unreasonably interfering with a student's academic performance; or otherwise adversely affects a student's educational opportunities.”

BEHAVIOR THAT MAY BE DISCRIMINATION

  • Not allowing someone to participate in an activity because of race, ethnicity, sexual orientation, gender identity, gender expression, or other protected group characteristic
  • Making mean comments or jokes regarding someone else because of race, ethnicity, sexual orientation, gender identity, gender expression or other protected group characteristic
  • Use of gender specific slurs or racial slurs
  • Social media posts that are derogatory because of someone’s race, ethnicity, sexual orientation, gender identity, gender expression or other protected group characteristic

  • Blocking someone’s entry to the bathroom that corresponds to his/her/their gender identity
  • Making fun of someone because of participation in a sport or an activity more typically favored by someone of another sex or gender
  • Revealing someone’s transgender status without consent from the individual
  • Physical assault of a student motivated by hostility toward them because of race, ethnicity, sexual orientation, gender, gender identity, or gender expression or other protected group characteristic

  • Disciplining, disparaging, or excluding a student from participating in activities for behavior or appearance that is consistent with their chosen gender identity or that does not conform to stereotypical notions of masculinity or femininity as applicable
  • Threats, verbal abuse, derogatory comments, or degrading descriptions because of race, ethnicity, sexual orientation or other protected group characteristic
  • Jokes, social media posts, derogatory posters, notes, stories, cartoons, drawings, pictures, or computer-generated images that are offensive to or target a protected group characteristic

BULLYING HARMS EVERYONE

Students who are the target of bullying behavior and those who exhibit bullying behavior toward others may suffer serious, lasting consequences. Bullying is…

  • Deliberate Act:  To cause emotional or physical harm to another individual.
  • An Imbalance of Power:  Those who bully use their power—such as physical strength, access to embarrassing information, or popularity—to control or harm others. Power imbalances can change over time and vary in different situations, even if they involve the same people.
  • Repetition: Bullying behaviors that occur more than one time or have the potential to happen more than once.

BULLYING IS AN UNWANTED, AGGRESSIVE BEHAVIOR THAT INVOLVES A REAL OR PERCEIVED IMBALANCE OF POWER BETWEEN INDIVIDUALS WITH THE INTENT TO CAUSE EMOTIONAL OR PHYSICAL HARM.

Bullying can be physical, verbal, or social/relational. Bullying involves repetition of a deliberate act.

EXAMPLES OF BULLYING

Physical Bullying – hitting, kicking, pinching, spitting, tripping, pushing, taking or breaking someone’s possessions, or making cruel or rude hand gestures.

Verbal Bullying – saying or writing hurtful things, such as teasing, name-calling, inappropriate sexual comments, taunting, or threats to cause harm.

Social/Relational Bullying – harming a person’s reputation or relationships, such as leaving a person out of an activity on purpose, influencing others not to be friends with someone, spreading rumors, or embarrassing someone in public.

Cyberbullying – can involve all three types of bullying and takes place using electronic technology and may include sending demeaning or hateful text messages or emails, sending rumors by email or by posting on social networking sites, or posting embarrassing photos, videos, website, or fake profiles.

SEX AND GENDER DISCRIMINATION AND THE LAW

Title IX of the education Amendments Act of 1972 is a federal law that states:

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance.”

SEX-Based DISCRIMINATION

  • TREATING SOMEONE DIFFERENTLY OR EXCLUDING THEM because of sex-based characteristics, sex-based stereotypes, pregnancy or related conditions, sexual orientation, gender identity.
  • DISCRIMINATION AGAINST ANYONE because of LGBTQ+ status, gender, perceived gender, gender identity, gender expression, actual or perceived sexual orientation, or association with a person or group with one or more of these actual or perceived characteristics.
  • DISCRIMINATION AGAINST ANYONE that includes unwelcome sexual advances, unwanted requests for sexual favors, sexual violence, or other unwanted verbal, visual, or physical conduct of a sexual nature made against another person of the same or opposite sex in the educational setting.

Sex-Based Discrimination including Sex-Based Harassment is prohibited in the Kern High School District.

Sex-based discrimination including sex-based harassment are not allowed on campus, at school related activities, and off campus in some cases. Students who violate this will be subject to discipline.

BEHAVIOR THAT MAY BE SEX-BASED HARASSMENT

  • Unwelcome leering, sexual flirtations, or propositions
  • Unwelcome sex-based slurs, labels, threats, verbal abuse, insulting comments, or sexually degrading descriptions
  • Graphic verbal comments about an individual's body or overly personal conversation
  • Massaging, grabbing, fondling, stroking, or brushing the body
  • Sex-based jokes, offensive posters, notes, stories, cartoons, drawings, pictures, obscene gestures, or computer-generated images of a sexual nature

  • Spreading sex-based rumors
  • Teasing or sexual remarks about students enrolled in a predominantly single-sex class
  • Any sexual relationship between a student and staff member
  • Touching an individual's body or clothes in a sexual way
  • Impeding or blocking movements or any physical interference with school activities when directed at an individual on the basis of sex
  • Displaying sexually suggestive objects
  • Sexual assault, sexual battery, or sexual coercion
  • Electronic communications containing comments, words, or images described above

DEFINITION OF CONSENT

  • Sexual conduct that is UNWELCOME or done without CONSENT may be sex-based harassment.
  • Consent is explicit permission, or an agreement between two or more people. 
  • Consent involves communication and setting up boundaries.
  • Everyone has the right to decide what another person can do to and say about their body, and they can change their mind at any time.

SEX-Based DISCRIMINATION INCLUDING SEX-BASED HARASSMENT IS NOT ALLOWED

NO student should endure sex-based discrimination including sex-based harassment under any circumstance. It is not your fault if you are sexually harassed.

ANY student who believes that he/she/they have been subjected to sex-based discrimination including sex-based harassment by anyone or has witnessed someone else being harassed is strongly encouraged to report the incident to his/her/their teacher, the principal, or any other available school employee. All school employees are required to notify the principal or district’s compliance officer within one school day of receiving the report of sex-based discrimination including sex-based harassment.

ALL sex-based discrimination including sex-based harassment reports will be investigated and prompt action will be taken to STOP any harassment, PREVENT further harassment, and ADDRESS any continuing effect on students.

ALL complaints and allegations of sex-based harassment shall be kept confidential except as necessary to carry out the investigation or take other subsequent necessary action.

Student safety and welfare is the Kern High School District’s primary concern.

  • In addition to being against the law, sex discrimination/sex-based harassment is a violation of Kern High School District rules.
  • Reports can be verbal or written to any school employee. ALL reports of sex-based harassment will be taken seriously and investigated
  • Sexual assault and dating violence is considered sex-based harassment.
  • ALL sex-based harassment allegations will be investigated regardless of any separate rule violation involving a victim or any other person reporting a sex-based harassment incident. YOUR SAFETY IS OUR PRIMARY CONCERN.
  • All rule or policy violations will be addressed separately and will not affect how the sex discrimination/sex-based harassment complaint will be received, investigated, or resolved.

  • The district will provide supportive measures to students to protect the safety of the complainant, respondent, and the district’s educational environment during any investigation and/or resolution process.
  • Retaliation for reporting or participation in an investigation will NOT be tolerated. Retaliation for not participating in an investigation is also not allowed.
  • Students also have the right to file a civil or criminal complaint in addition to reporting the matter to the school.

CHILD ABUSE AND NEGLECT

Child Abuse can be any of the following:

    • A physical injury inflicted on a child by another person other than by accidental means.
    • The sexual abuse, assault, or exploitation of a child.
    • The negligent treatment or maltreatment of a child by a person responsible for the child’s welfare under circumstances indicating harm or threatened harm to the child’s health or welfare. This is whether the harm or threatened harm is from acts or omissions on the part of the responsible person.
    • The willful harming or endangerment of the person or health of a child, any cruel or inhumane corporal punishment or any injury resulting in a traumatic condition.

If you believe that you are being abused by an adult, report to any school employee.

All school employees are required, by law, to report all known or suspected cases of child abuse or neglect to law enforcement or Child Protective Services.
