Significant Disproportionality Year 3 Requirements

If an LEA is found to be SD in one or more of the SD categories as published in the Results Driven Accountability (RDA) report for three years in a row, LEAs are required to:

  • review (and, if appropriate) revise policies, procedures, and practices,
  • reserve the maximum amount of funds to be used for early intervening services, and
  • report on the revision of policies, procedures, and practices.

SD Year 3 LEAs have received notification from TEA.

  • Child Find collection for the school year (SY) 2022–2023 opened on September 12, 2022, for LEAs to promote data for students with a SPED-ELIGIBILITY-DETERMINATION-DATE (E1716) between July 1, 2022, and June 30, 2023.
  • LEAs can start completing their Child Find submission on May 15, 2023, and the submission deadline to clear fatal validation errors and complete the submission is July 27, 2023, at 11:59 PM.

Special Paper Administrations of Online Tests

  • Paper tests are ARD and 504 decisions (may need to be in notes since this is not indicated through your IEP management system).
  • Not by parent request or because the student would do “better” on paper
  • Must be a rationale for paper administration

30 of 98

Paper Eligibility Recommendation

  • Have district-wide expectations for eligibility and documentation for paper tests

  • Can either attach the form or use it as a guide for discussion to be documented in ARD notes

Permissive Mode

No longer requires ARF submission to TEA.

Permissive Mode is available for computers running supported desktop Windows and Mac operating systems only. Technology Guidelines for Permissive Mode

Amendments?

  • No need to amend IEP or 504 if you wrote “pending TEA approval” for a paper test or permissive mode

  • No need to amend IEP or 504 if you wrote Extra Time (same day). There are no longer time limits to STAAR testing.

Charter School

Significant Expansion of Enrollment Funds

Open-enrollment charter schools that have been awarded 2022–2023 Every Student Succeeds Act (ESSA),

OR

Individuals with Disabilities Education Act, Part B (IDEA-B) federal grants may qualify for additional funding

To claim significant expansion of enrollment for both ESSA and IDEA-B, your open-enrollment charter school must meet both of the following criteria based on the newly expanded enrollment:

  • A minimum total student enrollment (ages 3–21) of 50
  • At least a 50% increase in the total student enrollment (ages 3–21) from previously reported student counts

If your LEA meets the criteria, email the Federal Fiscal Compliance and Reporting (FFCR) Division of the Texas Education Agency (TEA) at compliance@tea.texas.gov with your charter school name, county-district number, and a request that your 2022– 2023 SC5050–LEA Enrollment Data Request (SC5050) has opened

Recruitment of New VI Professionals

Elaine Sveen, VI/DB Consultant

elaine.sveen@region10.org

Kelly Bevis, Program Coordinator

kelly.bevis@region10.org

66 of 98

Grow Your Own VI Professional

Why?

Critical shortage of vision professionals exist across the nation, state, and Region 10. Texas Tech University (TTU) & Stephen F. Austin University (SFAU) are doing their best to identify, recruit, and graduate students, however, additional supports are needed.

Statistics show employees work within 10-20 miles from where they grew up. Many want to work and live in the communities for which they were raised.

67 of 98

Impact of Shortages

  • Impacts the Child Find process
  • Impacts a LEAs opportunity to hold fully constituted ARD meetings
  • Impacts service time, thus creating issues with compensatory services
  • Impacts relationships with families of children with visual impairments
  • Impacts students’ overall quality of life
  • Etcetera, etcetera, etcetera….

68 of 98

District Recruitment Process

How?

  • Understand the VI professional certification processes
  • Identify quality candidates
  • Share university information on opportunities to become a VI professional, including current and future employees, such as high school students
  • Work with HR for Emergency Certification for TVIs

69 of 98

What makes a quality candidate?

  • Collaboration skills/team player
  • Effective communicator
  • Explicit writing skills
  • Organizational abilities
  • Time management
  • Willingness to learn new technologies
  • Life-long learner
  • Flexible
  • Promotes the belief that everyone can learn and holds high expectations of students

Annual Registration of Students with Visual Impairment

What is it? An annual count of all students identified as having a visual impairment. This count includes students under the age of three, deafblind (or VI & DHH), and receiving accommodations under 504.

How it assists you? The count generates State Supplement Visually Impaired (SSVI) funds and federal quota funds to obtain educational materials from the American Printing House (APH) for the Blind. The data collected assists in regional and statewide program planning, as well.

75 of 98

Things that you will need to complete the registration process:

  • Current eye report (within 3 years of date on the eye report or the ARD/504 committee determined it current, i.e. “rolled over”)
  • Parental Consent Form signed by the parents. The consent form allows data from VI Registration to be share with other agencies that support individuals with a visual impairment. LEAs must register students even without consent.

Timelines and Communication

Email blasts

  • Begin in December through January
  • Signature of Superintendent in February

Other information

  • Students are counted if they are in attendance the first school day in January upon returning after the winter break
  • 504 coordinators manage registration of students under Section 504
  • For additional information, go to the TSBVI’s website. Updated information is coming soon.

TSDS FAQ

Does E1713 ECI-TRANSITION-CONFERENCE-DATE need to be reported if the parent opted out of the ECI transition conference for one of the SPPI-12 children being reported. If so, what date should be reported?

Yes. E1713 ECI-TRANSITION-CONFERENCE-DATE is a required data element for all SPPI-12 children.

If the parent opted out of the ECI transition conference, the LEA should report data element E1713 ECI-TRANSITION-CONFERENCE-DATE as the same date reported for E1712 ECI-NOTIFICATION-DATE.
