Tribal Applicant Definitions

Tribal Applicants

Applicants whose Lead Applicant is a California Native American Tribe or Tribally-owned nonprofit are referred to as “Tribal applicants” throughout the Guidelines.

California Native American Tribe

A “California Native American Tribe” is a federally recognized Native American Tribe or a non-federally recognized Native American Tribe listed on the California Tribal Consultation List maintained by the Native American Heritage Commission on February 19, 2026).

Tribally-owned Nonprofit

A California Native American Tribally-owned nonprofit (also referred to as a Tribally-owned nonprofit) refers to an organization exempt from taxation under Internal Revenue Code 501 (c)(3) (26 U.S.C. § 501(c)(3)), nonprofit organization incorporated under Tribal law, California nonprofit public benefit corporation (Corp. Code, § 5110 et seq.), or an equivalent entity that has a majority Tribal-led board, is operated by a Tribe, and advances the Tribe’s goals and priorities. This term does not include nonprofit organizations owned or controlled by individuals who are Native American or individual member(s) of a California Native American Tribe when the organization is not associated with a California Native American Tribe.

In addition to the Funding Goal and priority points, there are several additional proposed changes impacting California Native American Tribes.

As in the prior round, Tribes have several areas of additional flexibility for certain program requirements. These requirements come in two: Requirements where Tribes automatically have flexibility, and ones where Tribes can request a modification to the requirement and propose an alternative, if necessary. To qualify for this option, the Lead Applicant generally must be a Tribe or a Tribally led/owned nonprofit, which SGC defines as a nonprofit with a majority of board members belonging to a specific California Native American Tribe that exists as an arm of that Tribal nation to represent and pursue the interests of the Tribe. It is distinct from a Tribal-serving nonprofit.

One important area where Tribes have flexibility is that Tribes with a federally negotiated indirect cost rate can use that rate. If a Tribe doesn't have that rate (including nonfederally recognized Tribes), they can submit a request with justification for why they need a rate higher than the 15% allowed for other applicants.

Additionally, SGC will notify California Native American Tribes of applications received in their region.

Applicants may demonstrate DAC designation and eligibility of an unincorporated area using one or more of the following methods:

*Prior designation through a TCC PG or PDG
Verification by the Local Agency Formation Commission or equivalent, and CalEnviroScreen DAC designation
*Located in a CalEnviroScreen DAC, contains at least one cluster unincorporated parcels with sufficient density, AND is a Hard-to-Count census block group.

One of the biggest changes we are proposing is to introduce a funded Pre-Development Phase for Implementation Grants. The goals are: to reduce the burden of applying for an Implementation Grant and to provide more support to grantees before and during the implementation phase.

Under the prior process, applicants needed to have fully developed project plans and meet every program requirement by the time they submitted their application. After being selected for award, they then spent 6-12 months refining their plans with SGC staff and executing their grant agreement. This period was largely unfunded, with a small amount of funding for staff time for TCC grantees, but no support for project work.

Under the new, proposed process, the 6-12 months of back-and-forth will be replaced by a quick 2-3 months to get a basic grant agreement executed. Grantees will then enter the Pre-Development Phase, which will last up to one year. During the Pre-Development Phase, grantees will have access to a portion of their grant funding to fully develop detailed project plans and to conduct the pre-development work needed to prepare for the implementation phase. SGC will also provide additional technical assistance during this phase. Previously, most of this work took place during the application process and was unfunded.

If grantees successfully develop compliant project plans during the Pre-Development Phase, they will proceed to the Implementation Phase and gain access to the remainder of their grant funds. The Implementation Phase will be shortened by one year so that the overall grant term remains the same.

Here is an example of the difference between and Application Requirement and an Implementation Requirement.

Previously, Project Development and Implementation Grant applicants had to submit a formal Collaborative Governance Agreement (called a Partnership Agreement in prior rounds) with their application. This document described how the Lead and Co-Applicants had committed to collaboratively governing the funded work over the lifetime of the grant, including decision-making procedures, legal and financial agreements, roles and responsibilities of all parties, and public meeting procedures. These documents were required because collaborative governance and accountability to residents are foundational components of TCC and CRC, but these documents were extremely time-intensive to produce.

Under the new proposal, applicants will still need to come together and decide on these same items during the application process, but they can document their decisions in a straightforward worksheet SGC will provide, rather than as a draft memorandum of understanding with lots of formal language. If an applicant is selected for an award, they will have a few months (before executing the grant agreement) to turn the worksheet into a formal agreement and have it executed by all parties. For all other Implementation Requirements, they will have even longer—until the end of the Pre-Development Phase (up to 1 year).

In both programs' upcoming rounds of funding, we can expect to see a few different grant types. *Amounts subject to change, can only apply to one grant type, for R6

TCC Round 6 will include three grant types that applicants can apply for: planning grants (which are up to 300K per grant) that will fund activities like community engagement, feasibility assessments, action plans, in general the activities that respond to or prioritize community needs; project development grants (which are up to $5mn per grant) that will fund basic infrastructure activities such as project design, pilot projects, activities that provide access to basic environmental infrastructure; and implementation grants (approx $25-30mn) that fund multiple, coordinated projects that reduce GHG emissions and achieve community benefits (we'll have some examples later on)

TCC Project Development Grants

Project Development Grants funds activities that advance community climate goals, such as demonstrations and pilots, and prepare projects that have completed prior planning and identified priorities but require additional development.

Project Development Grant Objectives

Explain how proposed activities build on previous community planning efforts and advance TCC Program Objectives.
Explain how how proposed activities addresses at least two Transformative Elements. Community Engagement and Climate Adaptation and Climate Resilience, at a minimum.
Demonstrate consistency with State Planning Priorities in Government Code Section 65041.1.
