Asian SMP Constitution Simplified

System: Constitutional presidential unitary republic (Basically the U.S. Gov’t)

Judicial Congress or Jury: The lawmakers/court jury. Made up of 5 members, elected every 35 days through block voting. Have the powers to: impeachments, lay and collect taxes, pay debts and provide common defence and general welfare of the SMP, whitelist players, regulate commerce, coin money and regulate the value, establish post offices and roadways, define and establish punishments for crimes, make rules to govern land, water, and sky in all dimensions, approve cabinet members, establish Departments or Agencies, and among others.

Governor of JC: Oversees government and presides over the Judicial Congress. Composed of 1 member, only replaced when in permanent vacancy or removed. Has powers to: establish order in chamber, set legislative agenda, adjourn the court, appoint temporary officers in time of temporary vacancy, administer oaths, count and declare votes, create emergency session, review and revise to ensure Constitutionality of all parts of government, and among others.

President: The head of state/head of government and executive. Composed of 1 member + cabinet, elected every 70 days (FPTP, aka most votes). Have the powers to: (w JC) appoint cabinet members, pardon offences, is Chief of Militias, appoint the Governor, appoint Jury vacancies, executive actions, and among others.

Article IV contains 9 Constitutional rights to all/most SMP players.

Article VII is a list of Judicial Congress chamber rules that don’t require Constitution amendments to change.

In order to provide resolve, establish justice, insure tranquility, provide common defense, promote general welfare, and govern the security and liberty of the server, do ordain and establish this Constitution for the Asian SMP.

-All legislative and judicial powers shall be vested in the Continental Court; or the Judicial Congress. [Legislative branch + Judicial branch =(Judicial Congress)]

-The Continental Court shall be composed of 5 members known as the Jury chosen every 35 days by the preference of the players through block voting; no person shall be elected to the Jury more than four times consecutively.

-No person shall be a Jour if they adhere to one or more of the following: Players who haven’t attained 2 weeks since whitelisting, is the incumbent/elect Head Of State, is the incumbent/elect Vice-Head Of State, or Players who have been convicted with High Crime(s).

-The Continental Court (leg.) has the sole power of impeachment of all officers and Governor. They shall also have the sole power to try all impeachments. No person shall be convicted without the concurrence of unanimous consent of the Jury. Judgement in cases of impeachment shall not extend further than the removal of office and the disqualification to hold and enjoy any office and trust or profit of the SMP: But the party convicted shall nevertheless be liable and subject to indictment, trial, judgment, and punishment, according to Law. See ARTICLE III of Section 4/ARTICLE II of Section 3 for proceedings and rules.

Section 1

-Every proposed piece of legislation which shall have passed been the Judicial Congress (Legislative branch) by a simple majority, shall, before it becomes Law, be presented to the Head Of State: if they approve they shall sign it, but if not they shall return it, with their objections and criticism to the Judicial Congress (leg.). If after reconsideration by the Judicial Congress (leg.), if they agree unanimously, it shall become Law.

- The Legislative branch of the Judicial Congress shall have the power to:

lay and collect taxes, duties, imposts, and excises, to pay debts and provide common defence and general welfare of the SMP; but all duties, imposts, and excises shall be uniform throughout the SMP; to admit new players into the SMP (whitelisting); to borrow money on the credit; to regulate commerce; to coin money and regulate the value; to provide punishments for counterfeiting the securities and the current coin of the SMP; to establish post offices and pathways, trails, roadways; to define and establish punishments for theft and other crimes committed throughout the SMP; to define and establish High Crimes and their punishments; to raise and support armies; to make rules and regulations in order for the governance of land, water, and sky of all dimensions; to provide calling armies to execute Laws and suppress insurrections; to exercise exclusive legislation at spawn (spawn borders shall not exceed 15,000^2 blocks) for the erections of needful buildings and regulate its development; to elect and approve executive officers/cabinet members, and in case of a vacancy-

-; to set times, places, manner, and rules of the Elections, returns, and qualifications of its own members, and a majority of each shall constitute a Quorum to do business, and member penalties; to make Laws which shall be necessary and proper for carrying into execution the foregoing powers; establish Government Departments or Agencies; and all other powers vested by this Constitution in the Government of the SMP, or in any Department.

-Individual Jours have the power to propose:

Punishments, amendments (whether to existing proposals, Laws, or this Constitution), legislation, and the adjournment of the Court (leg. & jud.). All proposals need a simple majority to enact, bind, or pass, except in cases of Amending this Constitution (See ARTICLE VI).

-No proposal of attainder or ex post facto Law shall be passed.

-Neither Continental Court (leg. & jud.) branches during session shall adjourn for more than 7 days.

-The Governor and Jours shall receive compensation for their services directly from the treasury; members shall not receive compensation raises or lowers until the next session.

-No incumbent person holding a Jour/Governor seat shall not accept a title, bribe, or incentive by any party, group, or persons with the intend to corrupt the Jour/Governor power. Members who have been corrupted shall be impeached. If convicted, they shall be removed from office and may be disqualified from holding any office again.

-No players shall enter nor form into a Treaty, Alliance, Confederation, or a separate state than the Continental (Asian) SMP.

-No money shall be drawn from the Treasury unless passed in a appropriation bill; and publishing of the receipts and expenditures of all public money shall occur from time to time.

Section 2

-The Judicial powers of the Continental Court will consist of the same 5 Jury members of the Legislative powers.

-The Judicial power shall extend to all cases, in Law and equity, arising under this Constitution, the Laws and definitions of the SMP, civil and commerce disputes, and criminal justice.

-The trials of all suits shall be tried by the Continental Court (jud.) Jury.

-The Judicial branch of the Continental Court has ultimate and largely discretionary appellate jurisdiction over all court cases that involve a point of central Law, and original jurisdiction over a narrow range of cases.

-The tenure of the Jury is limited and dictated in Article I, Section 1 of this Constitution.

-The goal of each case shall resolve or correct:

Resolving a conflict in the interpretation of general/central Law or a provision of this Constitution, correcting an egregious departure from the accepted and usual course of judicial proceedings, resolving an important question of general/central Law or of this Constitution, or to expressly review a decision of the Head Of State and its cabinet, or of the legislature-

-that conflicts directly with a previous decision of the Continental Court, resolving commerce suits, resolving civil and land disputes, blacklist current or possible SMP players, and establishing criminal justice with punishment set by the legislative branch of the Continental Court.

-All proceedings shall begin with an oral arguments that both parties file briefs on the merits of the case; the number of oral arguments shall be at least a few; the minimum duration of the oral arguments shall endure for at least 30 minutes total for both parties. In cases of commerce suits, criminal justice, civil and land disputes, parties have the ability to reserve time for witnesses or testimonies for their argument. In the cases of criminal justice, the prosecution may bring witnesses and testimonies, if applicable, to speak before the Jury. The defendant may also bring witnesses and testimonies, if applicable, to speak before the Jury. General proceedings and rules are set for each trial by the Jury. In order to convict a defendant guilt of charged crime(s), it shall be of unanimous consent of the Jury; in order to acquit a defendant of charged crime(s) it shall be of unanimous consent of the Jury. In cases of civil, suits, rulings, settlements, and defining it shall be of ⅘ consent of the Jury.

-All Jours are required for the Quorum in Judicial sessions.

-After an issued subpoena, if said party refuses to attend trial, the Jury shall have the power to charge such person(s) with criminal contempt or obstruction of justice.

-The Jours shall have the basic powers: to order recess, to call for the voting, and to issue subpoenas, all of which need consent of a simple majority of the other Jours.

-The presiding officer of the Continental Court (Judicial Congress) shall be known as the Governor of the Continental Court.

-The Governor is composed of one person that is appointed by the Head Of State at time of permanent vacancy.

-No person shall be appointed as Governor if they adhere to one or more of the following: Players who haven’t attained 8 weeks since whitelisting; Players who have been impeached and removed from their office; and Convicted with High Crime(s).

-The Governor is to preside over the proceedings within the legislative and judicial branches of the Continental Court.

-The Governor within the legislative branch shall have the power: To establish order in the chamber; to organize the legislative agenda; to request adjournment of the court no longer than 7 days; to appoint a temporary officer in times of temporary vacancy; to administer the oath of office; to grant the permission for Jours to speak; to count and declare votes; to excuse members of the Jury and spectators; to declare an emergency session; to review and revise to ensure Constitutionality; and all other powers vested in this Constitution or established Court rules.

-In case of the removal of the Governor, death, failing to-

Section 1

-The Governor within the judicial branch shall have the power: To establish order in the chamber; to organize the judiciary; to order recess not exceeding 1 hour unless approved by simple majority, but can also be rejected by a simple majority by the Jury; to question or give instructions to the Jury or both parties; to appoint a temporary Judge in time of temporary vacancy; to administer the oath of Honesty; to grant parties and Jours to speak; to call for voting, if in opposition, the Jury shall overrule with a simple majority; to count and declare votes; to excuse members of the Jury, of both parties, and spectators; to issue a subpoena for party participant refusing to attend trial; to review and revise to ensure Constitutionality; and all other powers vested in proceeding rules set by the Jury.

Section 2

In order to maintain flow and Constitutionality of the Government, Pickyman shall be seated as the first Governor of the Continental Court.

-appoint temporary officers exceeding 14 days establishing a permanent vacancy, resignation, or inability to discharge the powers of the said office, establishing a vacancy, the Head Of State shall appoint to replace the Governor.

-The Governor and Jours, shall be removed from office on impeachment for, and conviction of, Treason, Bribery, Corruption, Obstruction of Justice, Perjury, Abuse of Power, Incompatible Behavior, Misuse of the Office for an Improper Purpose, Obstruction of the Judicial Congress, High Violation of This Constitution, and other High Crimes and Misdemeanors.

-Jours who are currently being tried (for criminal justice and impeachment) shall not hold the office until resolved, convicted, or removed, the temporary vacancy shall be filled by the President.

-See ARTICLE III of Section 4 for impeachment process.

Section 4

-The Governor shall be head operator and director of the Library Of Congress, which shall store legislative proposals, Laws, rulings, records, and other documents stemming from the SMP government.

-The executive power shall be vested in the the President of the Asian SMP.

-The President shall be chosen every 70 days by the plurality of the players; no person shall be elected to the presidency more than twice consecutively.

-No person shall be eligible for the office of the President if they adhere to one or more of the following: Players who haven’t attained 8 weeks since whitelisting; Convicted with High Crime(s).

-In case of the removal of the President, death, resignation, or inability to discharge the powers and duties of the said office, the same shall devolve to the Vice President, and the Judicial Congress may provide a Law regarding for the Case of Removal, Death, Resignation or Inability, both of the President and Vice President, declaring what officer shall then act as President, and such officer shall act accordingly, until the disability be removed, or a President shall be elected.

-The President shall receive compensation for their services directly from the treasury.

Section 1

-Before they enter the office, they shall take the following oath or Affirmation:-"I do solemnly swear that I will faithfully execute the Office of President of the Asian SMP, and will to the best of my Ability, preserve, protect, and defend the Constitution of the SMP."

Section 2

-The President shall be Commander in Chief of the Militias or Armies; they may require the opinion, in writing, of the principal officer in each of the government Departments, upon any subject relating to the duties of their respective offices, they shall have power to grant reprieves and pardons for offences against the SMP, except in cases of impeachment, and replace the Governor during permanent vacancy.

-They shall have power, by and with the advice and consent of the Judicial Congress, to nominate and appoint executive officers (heads of Departments or Agencies), public ministers, consuls, and all other officers of the SMP, whose appointments are not herein otherwise provided for, and need to be established by Law: but the Judicial Congress may by Law vest the appointment of such inferior officers, as they think proper, in the President alone or in the heads of Departments.

-The President shall have Power to fill up vacancies that may happen during the session of the Judicial Congress, which shall expire at the end of the session.

Section 3

-The day of or near the middle of the term of the President, they shall give time to the Judicial Congress on the State of SMP, and recommend to their consideration such measures as they shall judge necessary and expedient; they may, in rare cases, convene with the Jury, and in times of disagreement between them.

Section 4

-The President, Vice President, and all executive officers of the SMP, shall be removed from office on impeachment for, and conviction of, Treason, Bribery, Corruption, Obstruction of Justice, Perjury, Abuse of Power, Incompatible Behavior, Misuse of the Office for an Improper Purpose, Obstruction of the Judicial Congress, High Violation of This Constitution, and other High Crimes and Misdemeanors.

-Impeachment Procedure:

First, the Judicial Congress (leg./jud.) shall investigate; Second, the Judicial Congress (leg.) shall pass, by a simple majority of those present with the approval from the Governor, articles of impeachment, which shall constitute the formal allegation(s);

Third, the Judicial Congress (leg.) shall try the accused. In times the Governor of the Court is tried, the Vice President-

-shall preside. Conviction shall require the concurrence unanimous of all 5 Jours. The conviction shall result in the removal from the office, and if added, the disqualification from holding a office again.

Section 5

-When all successors of acting President as described in the Law regarding for the Case of Removal, Death, Resignation or Inability, both of the President and Vice President, have been removed or became suddenly vacant, the Governor of the Judicial Congress shall become acting President until the next election.

-Players of the SMP shall have the right to a speedy, public, and fair trial.

-Players of the SMP shall not endure excessive bail, and cruel and unusual punishments.

Section 3

-Players shall have the right not to be searched or have something taken away within reason.

Section 4

-Players shall not be enslaved nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted.

Section 5

-All players are equal under the law. Laws against a certain appropriate skins, appropriate IGNs shall not be passed. No law shall be passed that deprives any player of liberty or property, without due process of law.

Section 6

-No player shall be subject for the same offence to be twice put in jeopardy.

Section 7

-Private property shall not be taken for public use, without equal compensation.

Section 9

-Players who are whitelisted the day of opening, shall be excused from minimum whitelisting duration requirements to vote or hold some offices.

Section 8

-All players shall have the right to vote once their minimum whitelisting duration requirement is met, unless they have been convicted of High Crimes.

-Before the SMP begins, just before the ratification of this Constitution, a Caretaker Provisional Government shall be appointed to act as the legislative and executive branch, with the purpose to: polish and ratify this Constitution; form basic rules, law, and policy; form election procedures; setup server; and whitelist players.

-The Provisional Government shall consist of 5 members, one of which shall be Governor Pickyman, and 4 others appointed by him.

-The Provisional Government shall follow the proceedings as laid out in this Constitution. With limitations as long as the members give consent.

-Once the first election, has been completed, the Provisional Government shall dissolve and inaugurate the newly elected members for the 1st Judicial Congress and Head of State and officially establish the rules of this Constitution.

-Whitelisting by the Provisional members is prohibited once the election begins. The Judicial Congress (leg.) will assume whitelisting power.

The Judicial Congress, when ⅘ of the Jury deem it necessary, shall propose Amendments to this Constitution, or, ⅔ of the SMP players call for a Convention for proposing Amendments, which in either case, shall become valid with its intents and purposes, as part of this Constitution, when ratified by the legislature unanimously, or by Conventions in ¾.

JUDICIAL CONGRESS CHAMBER RULES

- When the courtroom is called to order, you shall obey.

- If violence or unprofessionalism is shown by a Jour, one or both parties, or spectator, they shall be excused from the courtroom by the Governor.

- When you are not called to speak do not do so.

- Weapons are not welcomed in the Capitol and must be left outside. Except for chosen police, by the Governor.

- Armor is not welcome in the Capitol Building.

- Formal wear is expected.

- DO NOT ring the gavel bell unless given the jurisdiction to do so.

Courtroom rules may be amended without the Constitution Amending clause. The rules shall be Amended by simple majorities or agreed rules set by the Jury.

-The Head Of State is not establish in this current Version of the Constitution. One the people and Jury agree with the position, it shall be added as an Amendment to this Constitution.

-In order to set a more perfect, fair, and democratic system, adopt these powers and rules for the Head Of State: The Head Of State shall be composed of one person that is chosen every 70 days by the plurality of the people; no person shall be elected to the Head Of State more than twice consecutively; no person shall be the Head Of State if they adhere to one or more of the following, Players who haven’t attained 4 weeks since whitelisting, Players who have been barred from any office through Impeachment;
