Piracy, Skull & Crossbones or Video & Headphones?

  • It’s not moral, it’s not right, but it’s there and it’s easy and there’s no one to stop you from doing it, and never will be.
  • Piracy is not raiding and plundering Best Buys, smashing the windows and running out with the loot.
  • It’s like being placed in a store full of every DVD in existence. There are no employees, no security guards, and when you take a copy of movie, another one materializes in its place, so you’re not actually taking anything.

Major Findings

  • DMCA (the “Digital Millennium Copyright Act,”)
  • The terms piracy and theft are often associated with copyright infringement.
  • Piracy is generally a small part of the media population
  • Changing the law is easy. Changing the practice is hard.
  • Criminals can’t compete with free.
  • Enforcement hasn’t worked.
  • Prices are too high.
  • Competition is good.
  • Antipiracy education has failed.

The Current State of Pirates

  • “Piracy is a service problem.” - Gabe Newell (Steam)
  • The best way to fight piracy isn’t with laws and lawsuits attempting to kill the immortal hydra, it’s by offering your product as cheaply as you can, as easily as you can.
  • Pirates generally fall into two camps.
  • Collectors or those who just can’t afford it

  • Video- Previously pirates were downloading eight pixelated seasons instead of buying a $200 series box set, now all they have to do is have a $8 a month subscription in order to be able to access not only that series, but countless others.
  • Music- iTunes, Spotify, Pandora, etc. Nothing else really needs to be said.
