Questions Coming Up….

Should we remove references to “diversity” on our website?

How much funding do we receive from the federal government?

Is my job secure if we lose federal funding?

Do we need to stop doing “equity work?”

“…[w]hat typically happens … when people are managing new legal restrictions. Research shows that the swirl of dialogue can create chilling effects far beyond laws’ requirements. We need to be vigilant to this tendency…they call it repressive legalism.”

Federal Actions Related to Education

  • Executive Orders: January - cut federal funding from K-12 schools promoting “illegal and discriminatory treatment and indoctrination, including based on gender ideology and discriminatory equity ideology.”

March - close the Department of Education and “return authority over education to the States and local communities while ensuring the effective and uninterrupted delivery of services, programs, and benefits on which Americans rely.”

  • Dear Colleague letter February - the Department of Education warned schools and colleges against race-based programs, citing the 2023 Supreme Court ruling on affirmative action.
  • Immigration Protections Rescinded: January - White House rescinded protections in certain areas—such as schools, churches, and hospitals—from immigration enforcement. To date, no immigration actions have happened at K12 schools, but a lawsuit from Denver Public Schools failed to reinstate protections
  • Fiscal Targeting Begins: In February some federal grants were cut – NOT including Title I & SpEd. In March, specific universities were targeted for funding cuts based on political actions.
  • EndDEI portal It also launched a site for reporting alleged discrimination tied to diversity, equity, and inclusion efforts.

For School Staff

  • Under California law, school officials are not required to allow immigration agents to enter schools without a judicial warrant. Contact your district's legal department or network supervisor immediately if there are immigration agents who are asking to enter the school campus or who are requesting student information.

  • The California Department of Education (CDE): every student in California has the right to attend public school in the state free from discrimination, harassment, violence, intimidation, and bullying. (California Education Code [EC] 220, 234, et seq.)

  • CDE hotline for any immigration enforcement issues at (916) 319-0795.

For Families

  • Provide the most up-to-date contact information to your school, including family members and trusted friends who could potentially pick a child up from school.

  • Complete a family preparedness plan and contact sheets that you can find easily at home. Find the forms in multiple languages here: English | Spanish | Chinese

  • Save key phone numbers: your school’s main office and afterschool providers

  • Learn your rights: Regardless of immigration status, all people have certain rights and protections under the U.S. Constitution. Know your rights by printing red cards from the Immigrant Legal Resource Center or these flyers (English / Spanish). These can be kept in your wallet and other places as a reminder.
