  • FAMLI was approved by voters in 2020 and ensures that Colorado workers have access to paid leave during life events that pull them away from work.
  • FAMLI is a social insurance program with both employers and employees contributing to the �benefit fund.
  • FAMLI provides workers 12 weeks of paid leave when they are…
    • Caring for a new child during the first year after birth, adoption, or foster care placement.
    • Caring for a family member with a serious health condition.
    • Caring for their own serious health condition.
    • Making arrangements for a family member’s military deployment.
    • Addressing the immediate safety needs and impact of domestic violence and/or sexual assault.

Rules & Regs: Upcoming Deadlines and Effective Dates

  • As soon as possible: member employers must register for a FAMLI account under their own FEIN (instead of under the PEO’s FEIN) to ensure proper federal taxation of FAMLI benefits.
  • By December 1, 2025: self employed individuals voluntarily participating in FAMLI must upload prior year’s tax transcripts and W2’s; without these, account eligibility moves to “NULL”
  • On August 20th, 2025: Self-employed individuals must confirm their account is listed under their full legal name, not their business name.

Upcoming Rulemaking Dates

  • A proposed amendment to the rule governing private plan maintenance fees was filed July 31, 2025.
    • Proposed amendment is published on FAMLI’s Rules and Guidance page.
    • Public rulemaking hearing on Tuesday, September 3.
    • Adopted amendments will be effective October 30, 2025.
  • Additional proposed amendments to other FAMLI rules to implement the new neonatal care provisions will be proposed on September 15.
    • Adopted amendments will be effective January 1, 2026.

Tech Updates – R16 for Employers

  • ATE Updates: “1-9” for small employers (rather than “2-9”)
  • Self-Employed Individuals: voluntarily register their “account” as an individual (not as their business “organization”)

Rules & Regs: Upcoming Deadlines and Effective Dates

  • UI Employer account reactivations, and liability/qualifying date changes: Division staff will review and implement requested changes in order to maintain data integrity in employer accounts. Requests to reactivate an account or make changes to liability or qualifying dates can be submitted via “Contact Us” in MyUI Employer+.�Please include the following information when submitting your request:
    • Employer Name
    • Account number
    • Federal Employer Identification Number (FEIN)
    • New Payroll Start Date
    • Date when you paid at least $1,500 in qualifying wages

Rules & Regs: Upcoming Deadlines and Effective Dates

  • Wages in Multiple States: Colorado's unemployment law provides guidelines for deciding where to report multi-state workers. Visit the Wages in Multiple States page for more information.
  • Out-of-State Wage Credits: Effective Q2, 2025 the Division will only review wage credit requests if:
    • the adjusted wages were reported to CO within the last six quarters, and
    • *the wages filed in another state are verified by the Interstate Connection Network (ICON) system.

If the adjusted wages cannot be verified with ICON, or if the request is for a period older than six quarters, the request will be denied. Visit the How to Manage Out-of-State Wage Credits page for more information.

  • UI Support Rate System Display Update for SB 25-242: Employer/TPA system screens are updated to comply with Senate Bill 25-242, renaming of the Employment and Training Technology Fund to the UI Program Support Fund. UI fund distribution totals have not changed.
    • Changes in rate allocations will be implemented in 2026 UI rate calculations.

Division of Workers’ Compensation

  • The role of the DOWC is that of an administrative conservator and regulator of the Colorado workers’ compensation system.
    • In other words, the DOWC’s job is to make sure that the system is operating correctly, all the stakeholders are following the rules to keep the system operating correctly, and to make adjustments to the rules when the system can be improved.
  • The DOWC’s five main external stakeholder groups are injured workers, employers, insurers, attorneys, and medical providers.
  • The DOWC and the insurance carrier are separate entities. The DOWC does not pay benefits.
  • The DOWC also facilitates the process for resolving disagreements between carriers and claimants.

  • The DOWC is modernizing its claims database system to enhance how the DOWC serves stakeholders. The new system, called CoComp, will feature an updated, user-friendly design that automates work processes where possible, significantly reducing the need for batch processing.

Upcoming Engagement Opportunities

HB25-1300 Listening Sessions

Recent legislation, HB25-1300, known as "Workers' Compensation Benefits Proof of Entitlement," goes into effect on January 1, 2028. In preparation, the Governor tasked the DOWC with collaborating with stakeholders to determine the best policies and tools for implementation. The DOWC is holding listening sessions on Zoom on October 8, October 22, and November 5. The meetings will run from 4 to 5:30 p.m. To register, visit the DOWC's Events and Training page.

Recently enacted laws that may impact employers

  • House Bill 25-1001 (effective Aug. 6, 2025) makes several amendments to the Colorado Wage Act, including:
    • Changing the definition of “employer” for purposes of wage and hour laws to include an individual who owns or controls at least 25% of the ownership interest in an employer;
    • Allowing DLSS to waive the penalty for an employer's failure to pay claimed wages in certain cases;
    • Requiring DLSS to publish violation citations on its website; and
    • Providing for fines for misclassifying employees.
  • House Bill 25-1328 (effective Aug. 6, 2025) implements recommendations made by the Direct Care Workforce Stabilization Board, including:
    • Requiring DLSS to collaborate with the board and other entities to establish a comprehensive “know your rights” (KYR) training for direct care workers and requiring direct care employers to document each direct care worker’s completion of the training;

Upcoming Pre-rulemaking Stakeholder Meeting

  • DLSS will be holding an informal, in-person stakeholder meeting on Thursday, September 4, 2025, to discuss anticipated Fall 2025 rulemaking.
  • The stakeholder meeting will start at 9 a.m. at 633 17th Street, Denver, CO 80202, in Conference Room 12A on the 12th floor.

  • Topics that the stakeholder meeting will address include:
    • Implementing and updating rules to conform with new laws enacted in spring 2025, including House Bills 25-1001 and 25-1208;
    • Issuing a new rule set as to hazardous occupations and investigation procedures under the Colorado Youth Employment Opportunity Act (“CYEOA”) C.R.S. § 8-12-101, et seq.;
    • Issuing a new rule set as to processes for Division appeals under the Colorado Administrative Procedure Act, C.R.S. § 24-4-103; and
    • Implementing the annual adjustment of the minimum wage, as mandated by the Colorado Constitution, and other related minimum wage and salary figures adjusted annually.

  • DLSS recently posted an updated and renamed Labor Law Guidance & Education webpage. This webpage includes multiple forms of published guidance for Colorado employers and employees:
    • INFOs: (Interpretive Notices and Formal Opinions) — the Division’s approved notices, opinions, and explanations on various labor law topics.
    • KNOWLEDGEs: (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) — one-page summaries for employees on their labor rights.
    • Labor Law Videos: short educational videos about Colorado labor laws, including “Break Times,” “Final Pay,” and “What are Impermissible Deductions,” with many more educational labor law videos coming soon.

  • Program oversight includes:

    • Fuel products, including LPG, CNG, LNG and Hydrogen
