BENTUK NEGARA

Bentuk negara terbagi menjadi 2 yaitu bentuk kesatuan dan serikat. ��A.KESATUAN��Negara kesatuan merupakan suatu negara yang tersusun tunggal, tidak ada negara dalam negara. Kedaulatan sepenuhnya berada di tangan pusat. Dalam negara kesatuan, hanya ada satu kepala negara, satu undang-undang dasar, satu dewan menteri, dan satu parlemen. Meskipun terdapat banyak bagian dari sebuah negara, tetapi mereka tidak berdiri sendiri. Menurut C. F Strong (2004:65) terdapat dua sifat penting negara kesatuan. �1) Adanya supremasi dari dewan perwakilan rakyat pusat.�2) Tidak adanya badan-badan lainnya yang berdaulat selain �pemerintah pusat.���

BENTUK NEGARA INDONESIA

Indonesia adalah negara kesatuan yang sering disebut dengan Negara Kesatuan Republik Indonesia (NKRI). Hal ini secara tegas dinyatakan dalam Pasal 1 UUD NRI Tahun 1945, “Negara Indonesia adalah negara kesatuan yang berbentu Republik”. Bentuk negara kesatuan pada pasal tersebut diperkuat pasal-pasal lain, di antaranya Pasal 18 ayat (1), Pasal 18B ayat (2), Pasal 25A, dan Pasal 37 ayat (5). Selain itu, Majelis Permusyawaratan Rakyat (MPR) sepakat untuk tidak mengubah tentang bentuk Negara Kesatuan Republik Indonesia.� Kesepakatan ini didasari adanya pertimbangan bahwa negara kesatuan merupakan bentuk yang paling cocok untuk mewadahi sebuah bangsa majemuk dengan berbagai macam perbedaan suku, agama, bahasa, budaya, dan lainnya. Hal ini sesuai dengan pembukaan alenia keempat UUD NRI Tahun 1945, “…melindungi segenap bangsa Indonesia dan seluruh tumpah darah Indonesia…”

BENTUK PEMERINTAHAN

Pada era sekarang hanya ada 2 bentuk pemerintahan yaitu republik dan monarki.

A. REPUBLIK

​

• Secara etimologi, istilah republik berasal dari bahasa Latin respublica. Res = milik atau kepunyaan dan publica = umum (orang banyak). Berdasarkan metode pendekatan etimologi (asal-usul istilah republik), secara harfiah pengertian republik adalah segala sesuatu yang menjadi milik atau kepunyaan orang banyak (umum). Bagir Manan mengemukakan bahwa istilah republik yang berasal dari peradaban Romawi, yang dalam bahasa Latin disebut respublica, sebagai segala sesuatu yang berkenaan dengan (kepentingan) umum (rakyat).
• Bentuk pemerintahan republik memiliki dua ciri pokok. Pertama, corak ketatanegaraan suatu negara yang berbentuk pemerintahan republik demokratis. Di sini, kekuasaan negara tidak terpusat di satu tangan atau satu lembaga, tetapi tersebar di berbagai organ negara. Kedua, rakyat dilibatkan secara aktif dalam penyelenggaraan negara. Keterlibatan rakyat merupakan suatu keharusan karena aspirasi rakyat dapat disalurkan kepada penguasa.

B. MONARKI

• Secara etimologi, istilah monarkhi berasal dari kata monos=satu dan arkhein=memerintah. Secara harfiah, monarki dapat diartikan sebagai pemerintahan yang diselenggarakan oleh seorang penguasa. Monarki mengandung arti bahwa dalam menyelenggarakan pemerintahan, segenap kekuasaan negara dipusatkan di tangan penguasa sehingga kekuasaan penguasa bersifat mutlak. Doktrin yang melandasi kekuasaan raja yang bersifat mutlak adalah doktrin yang bersifat teokratis, yakni doktrin kedaulatan Tuhan. Raja yang bertahta dianggap sebagai wakil Tuhan. Raja memiliki hak untuk bertahta karena kehendak Tuhan (The Divine Rights of the King).
• Adapun ciri-ciri bentuk pemerintahan monarki adalah sebagai berikut:

1. Monarki dalam penyelenggaraan negara dipimpin oleh satu orang penguasa, yakni raja.

2. Raja memegang kekuasaan secara terpusat dan bersifat mutlak karena dianggap sebagai wakil Tuhan.

3. Raja memperoleh hak untuk bertahta karena kehendak Tuhan.
