Evaluation Language

We have been negotiating weekly all summer.

So far, we have Tentatively Agreed to:

  • Article 9.1 - General Provisions and Emergency Evaluation Language for the COVID-19 MOU
  • Instruments in Appendix B:
    • Portfolio Table of Contents for Full-Time Teaching Faculty - NEW
    • Portfolio Table of Contents for Full-Time Non-Teaching Faculty - NEW
    • Faculty Observation for Online Teaching - NEW

  • Articles 9.2 and 9.6 the last 6 instruments must be negotiated, voted on, and board approved before faculty can be evaluated in Fall 2020.
  • The District has been dragging their feet, but we are pushing as hard as we can to complete negotiations by next month.

  • The rest of the sub-articles in Article IX have been agreed to be negotiated in the next full contract negotiations because we ran out of time.
    • Article 9.3 - Special Administrative Evaluations

    • Article 9.5 - Evaluations of Temporary Faculty

COVID-19 MOU

  • The current MOU expired on June 30, 2020
  • Both Unions have negotiated all summer with the District in order to have an MOU that is active and guarantees the safety of our members.
    • What we are fighting for:
      • Mandatory COVID-19 testing done on campus at St. John’s for all faculty, staff, and students
      • St. John’s conducting contact tracing to mitigate the spread of COVID-19

COVID-19 MOU

  • What we are fighting for:
    • $500 stipends for all faculty who complete and turn in their DE Canvas Certifications by the end of December 2020 - Paid for by CARES Act
    • Emergency faculty evaluation procedures that are fair and equitable during campus closure
    • In-person instruction will resume according to COVID-19 Industry Guidance: Institutions of Higher Education from the State of California
    • Both Unions must negotiate and sign off on the Campus Reopening Plan pursuant to Government Code 3543.2.

COVID-19 MOU

  • We are pushing to have the COVID-19 MOU extend to the end of Spring 2021 to cover all faculty evaluations for the academic year and to lock in the provisions of the agreement for a longer period of time. We know we will have to negotiate this MOU again in 2021.
  • We will do everything we can to get to a TA by next month
    • Our Actions Committee will be reaching out to all of you soon for your help

After a year and half of negotiating, we have essentially agreed on 7 Articles with the District:

  • Article 4 - Federation Rights
  • Article 6 - Divisions and Division Chairs
  • Article 11 - Leaves
  • Article 15 - Calendar
  • Article 17 - Salary
  • Article 22 - General Provisions (years of the contract)
  • Article 23 - DE Language

But, just as we were about to close, the District decided they wanted to talk about 5 more Articles!

  • Article 5 - Faculty Consultation and Participation
  • Article 7 - Instructors Rights, Duties and Responsibilities
  • Article 8 - Transfer and Reassignment

  • Article 12 - Retirement Options

    • 1.56% - On-Schedule - Retro for 2019
    • 1.50% - Off-Schedule - Retro for 2019
    • 0.72% - Off-Schedule - 2020
    • 0.72% - Off-Schedule - 2021

Total = 4.50% for the 2019-2022 contract

  • Part-Time Faculty
    • 5.00% - On-Schedule - Retro for 2019
    • 1.00% - Off-Schedule - Retro for 2019 (includes Sum & Win)

    • 1.00% - Off-Schedule - 2021(includes Sum & Win)

Total = 8.00% for the 2019-2022 contract

The Full Contract

  • The CCCFE provided a counter to all 5 articles by accepting some language in each of the District’s proposals.

  • Now the ball is in their court. Our next negotiations session for the Full Contract is August 24 at 3pm.

  • The District needs to TA on the contract and stop holding our salary increases hostage!
    • The President has gotten a 28.8% increase in last 3 years
    • Management has gotten a 16% increase in the last 3 years
    • Faculty have gotten 0% since 2017!
