Warner/Chappell Music, through a series of acquisitions, had been collecting royalties for the song since 1988. They asserted that a 1935 copyright, obtained by one of their predecessor companies, applied to the lyrics and melody. This allowed the publisher to demand licensing fees, estimated to be up to $2 million a year, from anyone using the song for commercial purposes, such as in movies, TV shows, and public performances.

On March 10, 2022, the U.S. Court of Appeals for the Ninth Circuit held—in a precedential decision in Gray v. Hudson—that Katy Perry’s song “Dark Horse” did not infringe a Christian hip-hop artist’s “Joyful Noise” song because the musical components at issue were not protectable under copyright law. The Ninth Circuit held that the common seminal notes in “Joyful Noise” lacked the originality required for copyright protection.Perry’s win, however, was not apparent right out of the gate. After a jury trial in 2019, a jury found defendants liable for copyright infringement and awarded $2.8 million in damages.https://www.fenwick.com/insights/publications/katy-perrys-dark-horse-comes-out-in-front-ninth-circuit-affirms-no-infringement-in-copyright-lawsuit
